'Bong hits 4 Jesus'

The "Bong Hits 4 Jesus" case isn't quite over.

Juneau attorney Doug Mertz told the Juneau Empire that the 9th U.S. Circuit Court of Appeals will hear arguments in the case in September.

Mertz represents Joseph Frederick, the former Juneau-Douglas High School student who displayed the "Bong Hits 4 Jesus" banner during an Olympic torch relay.

The school suspended Frederick for the banner display, sparking a free speech debate.

The U.S. Supreme Court handed down a decision last year that favored the school district and upheld its decision to reprimand Frederick.

Mertz says the Supreme Court ruling had not addressed whether Alaska's free speech provisions protected Frederick's actions and whether the banner constituted a legitimate political or social protest rather than a pro-drug declaration.

Superintendent Peggy Cowan says the school district is planning its arguments.

    Strong statements about hate and religion; statements meant to offend, are not nor ever were protected under free speech.

    I'm sure you can think of some examples.

    But yes, bong hits do get me closer to Jesus. Although, I can understand others taking offense from such concepts.

    How ironic is that? Condemning something guaranteed by the Constitution (speach) in defense of a law that has no Constitutional defense (the drug "war" is completely unConstitutional).

    It is a wonder how the founding fathers, infinitely wise as they were, never included a provision to protect something that they themselves may have partaken in...how are PLANTS more troublesome than rapist murderers??? HOW?! Freedom of speech only applies if you don't offend the people who are sworn to uphold it. hypocritical bastards!

    I think this kid was not only hillarious, but was truly supporting the work that Jesus did for the world. Why not let him express his appreciation in his own way/words? I can support murder and torture for war, but not drug use for religion? I don't get this...

    If more people were like Jesus, then bong hits would be perfectly acceptable for them. I say associate/promote weed with righteous behavior instead of hip-hop music and the world would be a better place.

    I still think the statement itself was nonsensical; he only used "Bong Hits 4 Jesus" because "Lines of Coke for Charles Manson" wouldn't fit on the banner. The whole point of the argument is weather or not a kid that attends a public school, funded by money provided by the local, state, and federal government has the same rights outlined by the First Amendment as the rest of us poor, tax-paying shlubs who have graduated into the "real word."

    Honestly, it shouldn't matter if the statement was "...a legitimate political or social protest rather than a pro-drug declaration." Since it clearly wasn't yelling "fire" in a crowded theater (...either in the literal sense, or otherwise) it should have been a fairly straightforward ruling by the court.

    Instead, they've perpetuated another dangerous double-standard that threatens to further undermine our basic freedoms.
