Lawyers for Richard Cooey argue in a federal lawsuit that Cooey, 5-feet-7 and 267 pounds, had poor veins when he faced execution five years ago and the problem has been worsened by weight gain.
The lawsuit, filed Friday in federal court, also says prison officials have had difficulty drawing blood from Cooey for medical procedures.
Cooey, 41, is sentenced to die for raping and murdering two young women in 1986. His execution is scheduled for October 14, 2008.
Two years ago, convicted killer Jeffrey Lundgren was put to death after a federal appeals court rejected his claim that he was at greater risk of experiencing pain and suffering because he was overweight and diabetic.

It never ceases to amaze me that persons sentenced to death for murdering another person or persons, fight so hard to have their life spared. Where was the compassion when you were robbing another of their future.
Further, I have the solution for this problem...
Breakfast: bowl of porridge, 2 eggs whites, toast and a glass of orange juice or milk.
Lunch: Fruit salad, a chicken or turkey sandwich and a glass of water.
Dinner: No pasta, a salad, baked/roasted or boiled chicken breast, a single serving of green veggies or beats and whole grain rice.
That joker will drop weight like a hooker drops her self worth.

I'm okay with him spending the rest of his life in prison. I know his crimes are terrible and I'm outraged that he is trying to game the system but I would rather he spend the rest of his life making license plates or sorting recycling or something.

One of the few occasions I'd recommend a diet. I think the death sentence should be abolished and replaced with true life imprisonment, but this guy must realise in this situation that his argument will just mean they cut down his rations? Being overweight isn't permanent after all, even if it can feel like it, and you'd think that being in *prison* means he can't raid the cookie jar at night all that easily...
