"A US appeals court has ruled that an anti-Castro Cuban exile and former CIA operative accused in Cuba of a 1976 plane bombing that killed 73 people should stand trial for an immigration violation, court records showed on Friday.

(Please read my 'take' at the end of this piece).

Posada Carriles, 80, who lives in Miami, has been sought for trial in Cuba and Venezuela for masterminding the bombing of a Cubana Airlines jet.

He has denied involvement in the incident but Cuba and Venezuela, which are close allies, have accused the Bush administration of hypocrisy in its "war on terrorism" for not prosecuting Posada Carriles.

Posada was arrested by US authorities in May 2005 after entering the country illegally. He sought asylum, which has not been granted.

In January 2007, he was indicted on seven immigration fraud charges arising from a naturalization application and an immigration hearing.

Granma, the newspaper of the ruling Communist Party in Cuba, said on Friday that the latest court decision was "a new episode of delay tactics" by the Bush administration in what Cuba views as White House efforts to protect Posada.

Along with the plane bombing, Posada, who worked for the CIA during the Cold War, is accused in Cuba of plotting 1997 hotel bombings in Havana that killed an Italian tourist.

He was jailed in Panama for plotting to kill Castro during an Ibero-American summit in 2000 but was pardoned by outgoing President Mireya Moscoso in 2004.

The pardon was canceled last month by the Panama Supreme Court, opening the door for a possible extradition request from that country."

I'm torn between what is true and not. The Communist governments says this man did the plane bombing as well as plotting to kill a president and bombing a hotel. That's a tall indictment. In America, he is treated as a freedom fighter for the exiled Cubans. Maybe so, but if these crimes are true, is it OK for America to use terrorists' tactics while they fight terrorism?

Or ...

Is the word "terrorism" simply another word for people or governments that have no massive weapons arsenal, and have to resort to using anything as a weapon, including throwing rocks, in order to defend their property and their view of freedom.

    • The foreign policy of USA is actually the foreign policy of the coorporations who profit from keeping things biased in their favour. American government is riddled with 'bought' politicians who push the needs of their business backers not the needs of the people.

      The CIA are paranoid terrorists.

      Obama and McCain are both members of the Council for Foreign Relations whose basic plan is to run the world. Not in the interests of American citizens but in the interests of the big business elite.

      Take it one step further; "The friend of my enemy is my enemy", therefore the people calling for this man's prosecution are treasonous.

      This means that the Posada Carrillas is a hero in the fight against communism, and should get our protection.

    • Terrorism or instilling fear upon the populace is a tactic used in fascist history and perfected by Fox News and the Whitehouse since 911. It is used everyday in America to keep the people from speaking out against the government. When the people are in a constant state of fear they no longer question authority and depend on them even more for their "safety".     • I read the article and I don't understand how you get from that article to your headline. The article says nothing resembling your claim. The most that might be inferred is that the US has some double-standards when it comes to who it considers a terrorist, which is hypocritical to be sure, but hardly a shock.

Starting in 1953 with covert CIA activities destabilizing democratically elected Mossadeq in Iran, only to replace him with the Shah. Followed by decades of meddling in south american politics and propping up US friendly strongmen against the will of the population. In the 80's, democratically elected president Daniel Ortega of Nicaragua fought and lost to the CIA backed "contras", only to be replaced by a puppet. Iran-Contra anyone?
      And on and on it goes. The media in the US branded muslims as islamofascists, which is an oxymoron in itself. Then named Ahmadinejad of Iran and Chavez of Venezuela as major threats to US "security". And the media drumbeat is unrelenting.
      Americans: WAKE UP! The American way of life is economically and ecologically unsustainable. This has been known for thirty years, yet most still deny or ignore it. But realize that you do so at your own peril!

    • The US supported the 'terrorist' contras in 1986 in Nicaragua. The US was actually found guilty of unlawful acts of aggression by the UN and was ordered to pay reparations. The US of course vetoed the decision, so nothing happened.

    • This shouldn’t come as a surprise to anyone. Is there any business bigger than war, whether supplying arms or securing resources? Are there any countries that the U.S. would stop at nothing to support or replace the leadership of if it wasn’t in their best interest? I don’t think so. If this decade in particular has taught us anything, it’s that our own gov’t is to be feared as the real terrorist threat to our “life, liberty, and pursuit of personal happiness”.

    • It saddens me that when I see headlines like this I'm not surprised. When one country acts like it has the right to police the world in the name of freedom and democracy, we have neither. The ability to respect differences in other countries methods and ideologies and punishing people within our own country who disrespect the law is key in having the respect of the global community. Sadly the US is losing face globally because the Bush administration has no respect for its own countries laws let alone the laws of other countries.

It's this vague description that is the foundation of war related activities including what is or isn't "torture", Homeland Security operations, personal privacy infringements, cover-ups and so forth.

    • One thing that has been lacking in our school education is that we learn history as we are supposed to learn it, censored and very much misinformation. In the middle east, the Americans deposed the ruling leader of Iran and installed the Shah. In Cuba US had kept Batiste in Power until Castro came along. In Venezuela US had installed yet another dictator named Jiminez in power and that lasted until he was ousted and a real democratic government was installed. The problem with the world has been that Not Americans per se, but those big power wielding power brokers had set up an group of American puppets who robbed the people, but those people had gotten fed up and ousted the puppets and divorced the USA. But the price was and still is high. The Ayotollah was worse than the Shah but the Iranians have paid a heavy price. Castro was not such a good choice but some one had to face these power brokers and he filled the bill. And so it goes on and on and will continue too do so until the world can disembowel these power brokers who have no respect for the human life under them. Americans must be educated in the interest of morality and justice. This world is not infinite but greed and violence fostered by political arrogance is unforgivable.

      I's wondering when has power placement or government placement by anyone except the people worked out well?
      I can't think of any, even when legally placed by "the people" it doesn't always work out.
      At least in a system like ours, and several others, we can truely re-decide every few years.

      In the main story though, I'd take accusations by Chavez and Castro with a shaker full of salt.

      Sad thing is, you say you take accusations by cuba and venezuela with a grain of salt, but it should be the other way around. The US is protecting a terrorist. He bombed a plane full of innocent people, period. Or don't the lives of venezuelans and cubans count?

      yea, you're right...someone flips out and without investigation, he is called a terrorist. He was just someone who 'flipped'....a terrorist should be someone that uses force just for the heck of it and without reason, a reason like protecting their property or defending themselves against an occupier and/or aggressor. Thats what I always thought of it being...like the bully in school terrorizing kids for their lunch money or clothes they wear..THATS terrorism.
