A judge ruled that Florida's ban on gay and lesbian adoption, is unconstitutional. Declaring the adoption to be in the boy's "best interest," Circuit Judge David J. Audlin Jr. ruled the Florida ban contrary to the state Constitution because it singles out a group for punishment, the Miami Herald said.Same sex adoption has been illegal in Florida for 31 years. Only one other state, Mississippi also bans same sex adoption.
According to gay.com, "The state Department of Children and Families did not contest the case or attempt to uphold the ban, the Herald noted; nor did Florida's attorney general.
Thus it's not clear if anyone will appeal Audlin's ruling; until they do, legal experts told the Herald, it will hold little sway against the state and federal appellate rulings that have upheld the adoption ban, most recently in 2005.
"On the one hand, this is one trial judge in Key West," Stetson University law professor Michael Allen told the Herald. On the other, he said, "cracks begin to develop in legal doctrine. Even if it has no effect as precedent and it is not repeated someplace else, it's a crack.
"If you get enough cracks, things break."
Florida is set to vote for a constitutional amendment banning marriage equality this November. The initiative was sponsored entirely by the Republican National Party. It is unclear how a change in the constitution would hinder same-sex adoption. Experts agree it won't be good for gays and lesbians.
John McCain opposes same sex adoption. Barack Obama is in favor of equality.

With so much hatred and hardship in the world today, how can anyone deny the right to a child to a loving home. Instead of refusing to allow gay couples to adopt we should be thanking them for wanting to care for someone's refusal to care for their own. How many opponents of gay adoptions have these unwanted children in their homes?

Why should it matter what the gender of the parents are. At least it would keep the kid from being an orphan for to long, scenarios like that for kids is a breeding ground for criminals and drug dealers. Why doesn't the government, state and federal, get off homosexual's ass. If 2 men or 2 women want to raise a child, as long as they teach him right from wrong then gender should be totally out of the question.

Let just say for example " A man can not be a woman and visa versa", I thought for the past oh about 100 years women have been pushing for equal rights ( I do support ). I could go on and on about how your response doesn't hold water. The bottom line is Children need love in there life and people need children in there lives, It doesn't have anything to do with your sex or your sexual preference is.
I think if you look at all families equally (Male/Female,Female Only, Male Only,Female/Female, Male/Male, Gay Male Only, Lesbian /Female Only) you will more then likely find that kids may just be a bit well rounded when being raised by individuals who have been pigeon holed there entire lives and this adversity will give them tools to better parenting then others will have. Our society is built on diversity and openness . I would suggest that if you feel the way you do, maybe you could climb back under your rock and enjoy yourself. It's funny how people can't take pictures of their kids in a park, but then no one wants to protect these kids from gay couples. I don't hate people, I hate sin. You know what every gay person I've known does? Sleeps around, takes drugs, and surrounds themselves with social drama. That's not even mentioning the sexual abuse that takes place when gay couples adopt. (not every time but enough of the time)

There are certain requirements to be able to adopt anyways. The gay and lesbian couples that do adopt are nice. Not all gays are like that, and there is no evidence that being gay means liking little kids. Do fathers get boners caused by their 12 year old daughters? No, only in erotic fiction.
And hey, everyone gets ridiculed by peers about something. "Haha your shirt is green," "You got a B on that test! ," "You hugged the teacher, you're gay!"
It's normal to be ridiculed in school for something, and the kid will learn, most likely, to just shine it on if some asshole makes fun of him for having two dads or two moms.
If you don't like social progression, then go to Saudi Arabia.

Yes we have a few friends that as you say "sleep around" but I know far more hetero. (M/F) that are looser then people of the gay community. I think that when you categorize gay men as pedophiles you truly need to do your home work before making that statement. Pedophilia has more to do with control and power then it has to do with sex. In all sexual match ups the attraction is different but the same, physical features take on primary role in the attraction Lesbians usually look for opposite female features, Gay men do some what the same thing, for heteros it is opposite physical features(Male to Female and visa versa. Then you get into other features such as skin color, ethnicity, hair color, size,etc...
Pedophilia's seem to be attracted by youthfulness. I am not going to get into things like the Catholic Priests, this is a situation created by our society for not allowing people to be who they are. You went into the priest hood to hide and hope that God would save you. Save you from what? It was forced on young men to save the family from embarrassment. Now that was smart wasn't it? Sex drive is sex drive if the only way you can attain it then you do. Look also at pornography it basically does the same thing, It keeps hidden different thought that only come out when accompanying pornography.
I would say that I don't agree with multiple wives or polygamy but I am in no uncertain terms able to pass judgment on those that follow that living structure.It is funny how you would would think that LGBT people are committing sins. According to you, anyone that doesn't follow your values is a sinner. Would you say the same thing about a man and a women who got drunk at a party, had sex and gave that child up for adoption because it was a mistake and this mistake didn't fit in with the plans of either party? You may think differently then me but I have no respect for people who live there life that carefree. I wouldn't say that they were sinners but I think bringing this child into a world in this way is a sin of get proportion and although I personally don't agree with abortion this option is one I do not pass judgment on but think it should be considered in many situations.

I applaud this ruling. Whether someone is straight or gay, both will be able to provide a safe and healthy environment for the child to grow up in. And for anyone who says that the child will not have a mother, that is a shotgunistic view brought by Freud that women should stay home and take car of their children. He did a research of an orphaned monkey. WHen paired with a male monkey or a female monkey, it was shown that the female monkey would accept it while the male would reject. What he didn't do was that if he kept the situation ongoing, he would have noticed that the male monkey began to slowly bond with the orphaned monkey.
Not only that, but if that is the argument against same-sex homes, then what about single-parent homes? I have yet to see a study that says same-sex homes are bad.

Just the fact that this is a discussion is progress. People will fight, and cry and moan about it, but in time, it will pass. Some of us in a society will always resist what we do not understand, mostly because of fear and ignorance. Every group has been persecuted by another at one point or another. The fight that the LGBT community must go through to even get to the point of two individuals even contemplating taking in a child that has been shut out of a so called normal life. To be told that "Because you Love the way you Love" you are to be excluded from giving love and protection to a child has to be one of the most unrealistic train of thoughts in the world. These thoughts tend to come from the same individuals who tend to be of the elitist set and who think that because of the power they wield they can button hole the rest of society.

This is rediculous. It should not be an issue for a gay couple to adopt. A gay couple could do as good a job as any couple when rasing a child. Hopefully, one day people will focus on more important issues and just let gay/lesbian couple live like everyone else. This should be as big an issue as it is.

There are so many children that need a home, so anyone willing to take care of and love one should be allowed. Even if you believe homosexuality is wrong, any sort of stable, permanent home is better for child than an orphanage -- plus it saves the state money. A real win-win situation

Same sex adoption and same sex marriage have always been a big issue among American people. In my opinion if a couple, gay or straight, can provide a loving and nurturing environment, than there should be no problem in the adoption.
If a child can thrive in it's environment and become a smart, hardworking part of society, then let the family, gay or straight be the ones to teach this.
