Subpoenas upheld in Palin trooper investigation

An Alaska judge refused Thursday to throw out subpoenas for members of Gov. Sarah Palin's administration in the State Legislature's investigation of her firing of her public safety commissioner.

Anchorage Superior Court Judge Peter Michalski rejected a request by Palin's Republican allies to shut down the investigation and ruled that the subpoenas were issued properly by the state Senate Judiciary Committee.

Kevin Clarkson, a lawyer for five GOP lawmakers who filed suit in September, said the date was arbitrarily chosen by the lawmakers overseeing the investigation.

"There's no magic to this October 10 date," Clarkson said. The bipartisan committee that authorized the investigation stated only that it be conducted "in a timely manner," he said.

Peter Maassen, the attorney for the lawmakers leading the inquiry, called the suit "a complete perversion of the process" and said the Legislature had the authority to conduct its investigation.

The former Anchorage prosecutor hired to conduct the investigation, Stephen Branchflower, is slated to complete his report by October 10. In an affidavit filed ahead of Thursday's hearing, he said he has begun to draft his report despite the refusal of several Palin aides and her husband, Todd, to comply with subpoenas issued by the state Senate Judiciary Committee.

Assistant Attorney General Jan Hart DeYoung had asked Michalski to dismiss the subpoenas for top seven members of Palin's administration, arguing that the committee had no authority to issue them.

Palin, now the Republican vice presidential nominee, sacked Public Service Commissioner Walt Monegan in July, citing disagreements over budget issues. But Monegan has said he believes that he was fired because he resisted pressure to fire Palin's ex-brother-in-law, State Trooper Mike Wooten.

    • Whoever likes her already likes her
Whoever thinks she's retarded already thinks she's retarded
I doubt this will change anything

The debate proved what everyone has been saying about her
It also proved why her supporters support

They think this is a real life movie about a small town mayor that shakes up the country.

No this is a nightmare about a puppet who serves some dark master.

Ah yes . . . Republicans are servants of some evil dark master who oppose the Democrat light beings who are trying to save us. Lovely little paranoid narrative you've got worked out in your head.

    • Interesting point to consider:

Sen McCain suspended his campaign (at least claimed to anyway) to rush back to Washington to fix the economy.

Why won't Sarah rush back to Alaska to address this very, very serious issue? Apparently serious enough that subpeonas were issued against her and many of her top aides?

Why won't Sarah suspend her Talking Points Tour of the lower 48 to rush back to Alaska (she is still Govenor, donthca know!) and handle this issue?

She is blowing it off. How very Bush-like.

The people of Alaska are entitled to have a Gov, aren't they?

And did Sarah (in typical Sarah fashion) decide that what's best for her people....is just to do whatever the hell she feels like doing? And if she decides that being answerable and accountable is too inconvenient well then, doggone it, she's just gonna blow it off until she feels like dealing with it.

      What inspiring leadership.

    • Its all about being a grown up and taking responsibility.

Just like last night in the debates wherein she insisted that she's never made a mistake....it was all the fault of the media filter and this conspiracy to make her look and sound stupid.

Sorry GOP Barbie....there was no international cabal out to make you look stupid and say stupid things. You did it all by yourself so just grow up and admit it.

      She is exactly like Bush.

She refuses to be accountable for any of her actions and refuses to admit (ever!) that she is uninformed or said things that weren't true.

We don't need another Bush for another 4 years.

Aw shucks, doggone it! There ya go again Sarah, just refusing to take any personal responsibility for your words and actions. The Joe Sixpacks of the world think your acting like a spoiled little girl, you betcha!

Now you better go back to Alaska and face the music and TAKE SOME RESPONSIBILITY FOR YOUR ACTIONS.....you betcha!

Filing an objection to a subpoena is the same as refusing to take responsibility? So due process is only for terrorists like Jose Padilla and Salim Hamdan not the Governor of Alaska?

    • I posted a rally held in Alaska against Palin on this site. I don't know how to make it available so people can see it. You can go to sueathome and view the rally. There were about 20 other pictures that I could not download. Not that computer savvy. I often wondered what Alaska people thought about a woman who seems so hard.

    • Due process folks. She had the right to object and the court has rendered its decision. Saying that if she had nothing to hide she would just comply is just plain naive. Innocent people assert their due process rights ALL THE TIME. Procedural motions and objections are part of the legal process.

    • If she has nothing to hide why doesn't she cooperate with the investigation like she originally said she would? At least they upheld the subpoenas.

    • She has not been in the inner circle long enough. She is just like Bush, smart enough to be Cheney and Rove's puppet. Stupid enough to do their bidding for The Project For The New American Century. Those bastards just want to take over the world.

    • She might not have a job when we send her home. Maybe her staff and husband will be in jail? It would be a start toward restoring the rule of law.
