Brazil Supreme court suspends N.J. father's custody of boy

A Brazilian supreme court justice has suspended a court order granting custody of a 9-year-old boy to his U.S. father.

The decision by Justice Marco Aurelio was in response to a request by a Brazilian political party. David Goldman is in Brazil and had hoped to retrieve his son Wednesday.

The Supreme Court said on its Web site that because of Aurelio's decision the matter must now be reviewed by the full court. No date was specified, but scheduling hearings can take anywhere from days to months.

Goldman has been in a multiyear custody battle that has reached the highest levels of the Brazilian and U.S. governments.

The supreme court said in a statement that the Progressive Party believes the boy should stay in Brazil.

The boy had been scheduled to be handed over to his father Wednesday afternoon at the U.S. Consulate in Rio de Janeiro.

The boy's mother, Bruna, took him for a two-week vacation to her native Brazil in 2004 and never returned. She divorced David Goldman in Brazil and married Rio de Janeiro lawyer Joao Paulo Lins e Silva. She died last year of complications from the birth of another child, and Sean has been living with his Brazilian stepfather.

Sergio Tostes, an attorney for the boy's Brazilian relatives, said they have filed a petition requesting the handover order be delayed.

"The judge's decision handed down Tuesday afternoon was shocking because it demands the immediate execution of his order, depriving us of enough time to file an appeal," Tostes said.
