Teen with 47 IQ gets 100 years in sex case

Texas - A teenager who has profound mental disabilities was sentenced to 100 years in prison after pleading guilty to charges in a sex abuse case involving his 6-year-old neighbor.

Aaron Hart, 18, of Paris, was arrested and charged after a neighbor found him fondling her stepson in September. The teen pleaded guilty to five counts, including aggravated sexual assault and indecency by contact, and a jury decided his punishment.

Lamar County Judge Eric Clifford decided to stack the sentences against Hart after jurors settled on two five-year terms and three 30-year terms, The Dallas Morning News reported Wednesday. The judge said neither he nor jurors liked the idea of prison for Hart but they felt there was no other option.

"In the state of Texas, there isn't a whole lot you can do with somebody like him," Clifford said.

Diagnosed as mentally disabled
Hart has an IQ of 47 and was diagnosed as mentally disabled as a child. He never learned to read or write and speaks unsteadily.

Despite being a target of bullies, he was courteous, well-behaved and earned money by doing chores for neighbors, supporters said. His parents say he'd never acted out sexually.

"He couldn't understand the seriousness of what he did," said his father, Robert Hart. "I never dreamed they would think about sending him to prison. When they said 100 years — it was terror, pure terror, to me."

Jurors said they sent the judge notes during deliberations in February, asking about alternatives to prison, but didn't get a clear answer. They believed the judge would order concurrent sentences, jurors said.

District Attorney Gary Young said he sympathized with Hart's situation but stands by his decision to prosecute on five counts. Prosecutors commonly pursue several charges for a single incident to see which the jury will support.

    The judge, jury, and prosecutor all say that they sympathize with him but have no other option. LIARS! People sure like to pass the blame of their actions on a system. Force the issue and create another option! They sentenced a kid with profound mental disabilities to 100 years in prison. What a joke.

    I been telling people for years, if you have a relative in the republican party hierarchy, wealthy, white visit Texas. If you don't avoid the state like it has the plague.

    I drove thru Texas several times, while the police were polite I was stopped twice for no more reason than then asked which part of New York I was from. Since my plates said PA I could only assumed they thought we were all the same on the East Coast

    Texas is the land of waiting lists for every service provided to the disabled and their families. They willingly spend $40k per year to put a kid like this in jail but can't find the money for group homes, adult day care and other services.

    They really do need to create something in texas for the mentally disabled I HIGHLY doubt he will make it the first 5 years in jail... Honestly, when having daily interaction with mentally disabled people get aggravated and since he is around criminals... Well... Good luck to that boy... The world has gone crazy....

    Unbelieveable. I'm not defending what the young man did but clearly, somebody with a 47 IQ didn't understand the gravity of what he was doing. So now he'll be put in prison where they'll turn him into a real criminal. What a bunch of yahoos. The judge should be sentenced to prison for sadism.

    He is 18 years old, but more like 8. Imagine an 8 year old in prison having to fend for himself. He will be destroyed. This is a huge mistake.

    I have worked with many non-profit organizations helping individuals with disabilities in Texas. This is a sad story, but I think the state is not to blame....it is the individuals involved you should be talking about. I was born in Texas and will most likely die in the lonestar state. Maybe the area, Paris, Texas, needs an awakening on issues of individuals with disabilities. I currently reside at the University of Texas at Austin, and I have volunteered in various instiutions, organizations, and initiatives catering to individuals like this subject that do an amazing job. You might say, "Well..yeah it is Austin. It is in Travis county...so things are different..", but I have also witnessed it in my small hometown, El Campo. Stereotypes are not the way to go....

    I'm sure that the jury, the judge and especially the district attorney will have no trouble going to sleep at night after making such a sadistic decision. With an 8 yr. old mental capacity, he was probably just curious (as boys around 6 or 8 are) and meant no harm and I'm sure didn't harm the 6 year old any more than his age appropriate curiosity would normally have led him, (and I'm sure someone will see to it the 6 yr old boy is made to see this as a huge trauma in his life and will take years getting this stigma out of his head). He is evidently well mannered and seemed to get along with neighbors otherwise. A few sessions with counselors would have probably been sufficient to guarantee his behavior would not include sexual activities with others. And no, he will not be turned into a criminal by being put into prison, any more than an 8 year old boy would. He will no doubt be passed around the hardened convict like a sex toy until he goes stark raving mad or kills himself. Then the state of Texas can "find a place for him" in a mental facility or in the groound. Sleep well, monsters, until you die and end up in a worse hell than you have sentenced this poor retarded boy...

    I did some quick research of the watchdog groups that monitor judges in the US. Texas ranks #2 in complaints of rulings issued by local and town judges. Appellate courts in Texas have a 51% rate of overturning local rulings. That is one of the highest in the country. What's up with Texas justice is the bigger question?

    just because he is your son and he has a mental condition you think that he shouldnt be in jail ? i can only begin to unerstand the pain that hsi mother is probably going through but sex offenders (all sex offenders) are more likely to commit the crime again. and if he doesnt understand that what he did was wrong, doesnt that mean that he WILL do it again? he needs to be in jail because what he did was wrong and aboviously his guardians are not atching him properly so he will be watched in jail. Mental Dissabilities should not be the reason as to why a person should not be punished. crazy. . .
