Judge Reinstates Dan Rather Fraud Claim Against CBS Over Firing
Rather, 77, filed a $70 million breach-of-contract suit in 2007, accusing the network of dismissing him following criticism of his election-year report on Bush’s National Guard service.
An employee of CBS News for 44 years, Rather said his reputation was severely damaged when management terminated him. He claimed the network commissioned a “biased” and incomplete investigation of his National Guard broadcast.
“By any reasonable analysis, this was a bad day at Black Rock,” Rather said yesterday after court, using a nickname for the network’s Manhattan skyscraper on West 52nd Street.
New York Supreme Court Justice Ira Gammerman, who continues to preside over the case after retiring, yesterday revived Rather’s fraud claim that he’d previously dismissed twice.
The “rulings by Judge Gammerman were on technical and procedural issues, not on the merits of Mr. Rather’s allegations,” CBS said in an e-mailed statement. “Most of Mr. Rather’s claims already have been rejected by the court and that has not changed. We are similarly confident that Mr. Rather’s re-pleaded fraud claim will be dismissed once the court reaches the actual merits.”

Great news! I'm glad he didn't just 'move along'. People must be held accountable. What CBS did was shameful. Dan Rather should hold them accountable and shame them in the process. It's time to stop 'moving along' from the wrongs, which have already occurred.
Peggy Noonan even stated on one of the Sunday morning shows, we should just move along, some things are better left a mystery. Then she went on to say, she would like to see more investigative journalism in the future. How convenient, her guys gets a pass and President Obama gets a microscope.
