It was an inevitable landmark: A Twitter post has become the sole basis for a libel suit. Amanda Bonnen mentioned her "moldy apartment" to her 20 followers, and now her management company is taking her to court.Horizon Group Management's complaint says the claim of mold is false — though it offers no evidence — and seeks $50,000 plus court costs. Unlike the "first" Twitter libel suit, against Courtney Love, this one involves no other social networking services (the Love suit also involved MySpace postings), and only a single tweet. Our adorable microblogging service is growing up so fast! The offending tweet:
"Who said sleeping in a moldy apartment was bad for you? Horizon realty thinks it's okay."

From Decider -Twitter Lawsuit Could Hold Up: Lawyer
This is Chicago's first Twitter-related case, according to Evan Brown, an intellectual property and technology lawyer with local firm Hinshaw & Culbertson LLP. He says Horizon might have a case. All it has to do is prove a defamatory statement was published, adding, "In defamation law, publication has a special meaning--all it means is that words were uttered, or made available to someone else."

It's not "Horizon Realty" it's "Horizon Realty Group." And whether or not the statement was meant to be a "humerous rhetorical question" it is still a defamation to Horizon Realty Group. No matter what anybody says, Horizon Realty Group has a right to file this lawsuit. If HRG feels that this statement has tarnished their reputation, they have very good reason to do so. $50k is pushing it a bit though. They should have just come out and made a public statement to Twitter claiming their side of the so called "mold" problem. If they were then able to prove that the statement damaged their business, then they sould have followed through with the lawsuit.
I'm not defending HRG, I just know the system. The article did not mention that HRG was previously or currently (I can't remember) involved in a lawsuit with Amanda Bennen as one of the plaintiffs. She shouldn't have gone and opened her mouth about a pending matter to the public. This can not only damage their reputation, but it could have been used against them in court.

How many entities are doing business as Horizon realty anyway? I got 6 distinct corporate entities doing business as "Horizon Realty" in the first 10 search results, so the first question is how can anyone claim specific damages? Who is to say which entity she was talking about? Perhaps more importantly, the tweet was clearly meant to be a humorous rhetorical question, making satirical reference to the commenter's frustration over the handling of a troubling problem. Making a snide remark in a humorous manner is quite different from libel, and someone should shake the legal department over at Horizon until they wake up. 20 people followed this person's tweets... this was a dumb move that increased the number of people who heard the so-called "libel" exponentially, so any damages were self-inflicted.

Ugh seriously people are just idiots, this will get dropped before it ever sees a courtroom.
I had a guy threaten to sue me for libel because I posted a comment on an article about him stating I didnt care for the artist's work and when I hired him I thought he was unprofessional. Apparently people cannot express their opinion anymore without somebody getting their panties in a bunch.

Someone from the company actually told the reporter that they sue and ask questions later. That's how they maintain the sterling reputation they claim has been libeled in their suit. Frankly, if they're suing every single person who calls them on being dicks, it might be cheaper if they just put hits out on all of them.

In libel cases, Freedom of Speech, does not usually apply. One is taking the name of a public entity and "tarnishing" its reputation.
There are a ton of stipulations to this, read a torts book on the subject of Libel and you will see how complicated this crap can get.
Anyway, hopefully the judge will dismiss the case on the basis of being nonsensical. And $50,000, really? Tha's just crazy!

Lawsuits are a big problem in this country. They drive up the cost of every kind of insurance, yes, especially the cost of health insurance. Perhaps we should go back to settling disputes in the street and not in the court room, it is much quicker and cheaper.

I dont know about the health care statement, but lawsuits in America as seriously out of control. I think the worst example is the McDonalds lawsuits because it made people fat. I know there are a ton of other ridiculous things Americans have sued for. I took the post as Americans sue too much. Instead of suing, people should duel.

BullDogg, I agree lawsuits are a huge problem in US and this problem must be addressed. We have people bring lawsuits when they fall into manhole while texting, spilling hot cafe while driving, and on and on and on. Where is the limit? In my opinion, some of these ridicules cases should not even be heard. We have a society of victims and it appears to be a competition on who is the bigger victim? Where are the personal values? Pride? Self respect?
On the other hand, as in this case this tenant should be able to bring up the issue of health treat due to negligence of the apartment owner/management company. There should be no monetary compensation but the issue must be addressed and corrected. - 7 months ago
