The United States Govt, under the auspices of the Dept of Health and Human services filed for, and was awarded a patent on the medical uses of pot all the way back in 2003, and they still claim that cannabis has no medical use, arrest and prosecute medical cannabis users and their caregivers. Is this hypocrisy? Masterful hedging of bets? In either case, I for one am forwarding the information about this patent to my representative in Congress who is about to vote on the upcoming Hinchley/ Rohrabacher amendment which would protect medical cannabis users from Federal prosecution. I sincerely hope that everyone else who reads this does the same.

You can only patent a plant that you genetically "create". No one can own an entire species of plant that has been around for at least a few thousand years. But if you discover it you can name it. Who wants to share a bowl of Ronald Reagan weed?

They may be able to patent the chemicals in the plant, but they cannot patent the plant. It exists despite them. Unless they created to plant, they have no right to say they have any rights over it's recreation, which is pretty much what patents do.
