Even if this were true, this proves how stupid and retarded she and her lawyers must be. If you are a celeb, you cannot sue for someone using a short film strip or photograph taken from a publicity event.
You can only sue if that ad is seeking to defame you... which it clearly is not, in fact it is giving her a little more credit than she deserves. HAHAHAHAHHHA. She could also sue if the photo was from her own personal collection and was stolen or used without her permission. Also not the case since it (the short clip) was from a red carpet or publicity event.

There is no way this is true because there simply isn't a case here. Public figures (celebs) don't have the same rights to privacy as regular folk (why you don't need releases to use their images in magazines, on TV, etc.) because they MAKE THEIR LIVING being public figures. N lawyer with any experience would take this case.

Different legal standard for going after politicians, actually, considering the courts are not happy to interfere with the "political process" (raises sticky constitutional issues). And aside from potential defamation (probably wouldn't apply here), there's the fact that you can't use someone's likeness to advertise your product without the release. McCain isn't publishing a news tabloid (even though they may have made it harder to draw the distinction).

I am no Britney Spears fan, nor do I find the party antics of too-rich-to-know-what-to-do-with-her-life hotel heiress Paris Hilton interesting in the least. However, it certainly raises my hackles that the McCain attack ad accusing Obama of being a celebrity (an empty shell?), but not a leader, uses two women as the bad examples. Are there no vapid male celebrities? It smacks of the sexism that seems to keep rearing its ugly head in McCain's history.

Last time I checked male celebs balls were not hanging out of their pants when they were getting out of cars, and male celebs aren't wearing outfits or doing things (shaving heads or releasing sex tapes)that would beg for their pics to be taken.
Plus, the point of the ad was to use celebs that are most popular in our current culture, and unfortunately it is safe to say these two whores are it! HAHAHHAA.
I can't think of any male celeb besides David Beckham that even warrants the title of most famous celeb in the world. If you can name two that are photographed as much as Brit and Paris, then maybe you got a valid point.
