On May 15th the California Supreme Court ruled that a state ban on same-sex marriage was unconstitutional by a vote of 4 to 3. That ruling also elevated sexual orientation to the constitutional status of race and gender, an elevation that provides strong legal protection from discrimination.

I think I think it's kind of weird that these people are protesting the democratic process in our country.
It was a vote and it was a vote fair and square.The people have spoken and they have said that they do not want the marriage.
It seems they're protesting because the majority of Californians did not vote the way they would have liked.
Isn't this essentially a protest against democracy?
I didn't support Obama in this year's election. Perhaps I can go organize a protest against America's choosing of a president in a fair and democratic manner.

A complaint against voters' choice to make traditional marriage the norm by calling it _unconstitutional_ is ludicrous.
'That [9th circuit court] ruling also elevated sexual orientation to the constitutional status of race and gender, . .' Since when is one's behavior grounds for granting [new] human rights to a group? Unicyclists don't get special treatment under the law, nor do bowlers. Sexual preference is just that. Human rights apply to LGBT as with anyone, barring such special allowance as to marry two of the same sex. Your ranting in the streets won't bring what I suspect you're seeking, because it's a behavior & not a political identity as is race or gender.

As you're counting your woes over the saving of a sacred institution, take a look at how this all came about:
Black voters responded in such numbers so as to outdo any possible Mormon influence (insert others) in the voting booth. They chose to define marriage in its natural recipe by a 70% margin. [LGBT and LDS share nearly the same proportion of CA voting population at 2-4%.] So many folks were sought out to make a real presence on election day for Obama, and the result is grand. The end result is that with their participation, they pushed Prop 8 over the finish line.

You should look at a blog called article6blog.com for a treatment of how the interfaith coop has mended some old fences between Catholics, Evangelicals, etc. and Mormons. (Good fences between decent neighbors.) John Schroeder is my new hero.

Hate. Intolerance. Bigotry. These words are bandied about quite a bit by supporters of "gay" rights such as same-sex marriage.
In a very weak attempt the issues of right or wrong are clouded over by attacking those who disagree with their agenda. Don't words have meaning? At least they used to have.
Take "hate" for instance. If I, as a normal person, with normal tendencies (straight) find WHAT homosexuals/lesbians do to be disgusting, repugnant and unatural, I'm labled a "hater". Do I hate them? NO! I hate WHAT they do and the fact that they say it's beautiful. Is beauty in the eye of the beholder? Yes, to a certain extent. But a pile of crap will always stink and be repugnant. I don't care how much perfume you spary on it or dress it up in a little suit of clothes.
I was especially impressed by the homosexual protestors who were caught on tape pushing around a little ole lady who had the audacity to stand up to them at that rally in California (?). One itsy-bitsy, granny. And, the crowd showed exactly who they were by shouting, yelling, jostling her around and finally snatching her cross and stomping it into the ground. Real courageous behaviour. Bunch of spoiled brats!

If a person whom is a man is around the age of 80 and been together with another man whom is his lover and companion since they were in their 20's is dying from old age, it isn't right that the partner of the man whom is almost decesed receives no kind of help and assistance from healthcare, compensation passed on like a house, social security, anything jointly owned to become the governments property again.
I am thinking that isone of the many main reasons of marriage between anyone. If you love someone, you don't really need alot of things. But for personal gratitude, commitment and financial reasons for straight couples, gay marriage needs to be legalized sooner or later.
If lawmakers do not forsee the marriage between both a man or a man or a woman and a woman, and do not plan to make it legal, then lawmakers will need to come up with a rewrite of laws pertaining to gay couples who pay taxes and work hard all of their livers at crummy jobs working long hours - just like straight people do to be able to collect benefits and claim spouses on things such as IRS, life insurance policies, and as next of kin on wills ,etc.. without being left out in the cold.

As for Marriage not being a civil right
Think about what this means to the individual.
Gay people in Texas run into this issue I’ve personally seen this happen.
A same sex household is devastated by a death in the family. The dead members’ family does not recognize the right of the dead individual to leave the estate to the rest of the household so they come in and sell the home and all of the belongings unless a receipt in the name of someone other than the dead person can be produced.
Losing a loved one is followed by having your home and belongings taken from you in a court case where you are a defendant having to prove you are not stealing from your lost love. Because there is no legal recognition of the relationship you are put in a position by the court of being presumed guilty and having to prove your innocence.
These "defense of Marriage acts'" are being worded to dissolve any legal protections a gay household may have sought, in essence punishing people for living in a gay household.
What’s Civil or Right about that!
I do consider it a civil right not to have belongings taken from me unless I can prove they belong to me.
Unless we seek equal protection under the law we will have our civil rights abused in this and other ways.
We cannot let our civil rights be decided by a popularity contest. - 3 years ago

With an attitude like yours no progress of any kind could ever have been made thru all of human history. Do you truly think a good idea like Democracy came to every one on earth all at once and it just happened overnight?
Can you imagine the resistance from rich white men to an idea like equal rights for my property!?!?
That property should just sit quietly be civil and respectful of the law!
You cannot have a sacred union in a secular society. That would be an oxymoron. And this is a secular nation remember our founders were fleeing religious persecution. If you require proof check the treaty of Tripoli It clearly states we are a secular nation setting up the foundation for the separation of church and state.
Remember the source of the Sanctity in your marriage is a document that also tells us how to properly treat slaves! Quit taking solace in how well you fit into the ideal of that rotting, stinking and decaying old document! It has caused more problems in the course of human history and the Constitution was meant to replace it as a standard for the rule of law in this GREAT Nation! The Bible was to be no more than a moral code with out the force of law behind it.
For those who are unsure the property I speak of were Humans and the stinking document is the Bible.
If you are shocked and offended by my words and think I am attacking your faith then just replace the word Bible with the word Koran and try to "walk a mile in another mans' shoes".
The Bible cannot and should not be the foundation of law in this GREAT Nation because is has been proven to be a flawed document over the course of human history.
And if you don’t believe the Bible is a flawed Document then go and buy yourself a slave from the local Asian massage parlor (just beat your wife and kids into submission if they say anything about it) and form your own nation (can you say Waco?) and never eat any shrimp, lobster or bacon again. Then see how much this Great Nation loves you!You can reconcile your faith with the Bible being a flawed document by remembering God spoke 'The WORD' to man who in turn put 'The Word' into a document and because man is flawed the document is flawed.
What if you had a 2000+ year campaign waged by the church to turn people who don’t see well into a scapegoat for all the worlds’ problems? You would have to walk around without glasses and pretend you can see well. You would be a safety hazard thus proving the church was right to discriminate against you. No Glasses or Contacts could legally be made because that would be defying the will of God. Then the church proposes Prop 11 to take away your right to breed thus saving future generations from the dangers of having people with poor vision among them.
The mandates of the judicial branch of our government is’ to interpret the law and protect the rights of minorities. Protecting the rights of minorities is not a pie in the sky ideal. It's what keeps the torch and pitchfork crowd from snuffing out new and better ideas and allows all of society to flourish.
So to all you Religious Zealots here is my prayer for you. I hope you have a gay child. I hope you love that child with all your heart. I hope one day you truly understand what it means to stand up for the rights of a defenseless minority.
I am a gay child of god and I was created in his image just like you.
The only difference is I was born gay, and even though I am white with no visible disabilities born into a family of moderate means and had every reason in this mans world to lie about my sexual orientation get married have kids and move on up in society and live a comfortable life. But the part of God that lives in my heart told me that it would be wrong to lie to my wife, kids and everyone else in my life for my own selfish reasons. It is interesting that protests would be held fighting against something that the majority of people supported and also that the media is sympathizing. I think this might hurt the cause more than help. I personally don't understand the argument that marriage is a civil right because almost no one has the right to marry except for a very select group of heterosexual couples. Those that do no have the right: siblings, other close family members, polygamists, minors (depending on state), any number larger than two, etc. This obviously isn't a civil right.

Matt Coles of The American Civil Liberties Union is arguing that "What Proposition 8 did was it put the rights of the minority up to a simple vote of the majority and constitutions are supposed to protect minorities from majorities and courts are supposed to protect minorities from majorities." Since minority rights were put up for the majority vote, it was such a drastic change to the system, and therefore a revision to the Constitution, not an amendment, and requires a more deliberative approach than an simple vote by majority. The ACLU filed a lawsuit on Wednesday under these circumstances.
Another issue being addressed is "the fundamental principle of the American Constitution in American society that you don't have to agree with people to recognize that in our society we give them rights to say and do certain things. Like the famous phrase,'I may not agree with what you say, but I'll defend to the death your right to say it' our equality principle in our constitution comes down to 'I may not love you, but I'll defend your right to absolute equal treatment in society.'"
Coles concludes by calling for a deeper understanding of civil rights and saying, "There is a higher principle at stake: our dedication, as Americans, to equal treatment for everybody. Equality means equality. You can't draw lines like that. Even if you don't agree with gay marriage just as twenty years ago or thirty years ago you may not have agreed that women should have careers and work outside the home, you don't have to agree with it to see that it's wrong to deny somebody who wants that the opportunity."
Anti-gay marriage is anti-gay. There are no lines you can draw around the issue. Just because you don't agree with a group of people doesn't mean you have the right to deny them their rights.

It really is simpler than you've painted here. Gays are due all the human rights that exist already. Prop 8 reestablishes the definition of marriage: one man, one woman. This means that other legal unions must be used to cover variances from the norm.
Rights apply to all citizens, and gaiety does not afford anyone different rights. Nor should it influence the recipe for a lawful wedding.
Laws are written to keep the order. While their intent is to govern human behavior, such as the interest some have in robbing banks, they typically do not establish new rights. The list of inalienable ones is well accepted. No privileges are accorded anyone due to a behavior, like sexual orientation.

I agree that gay couples should have the same legal rights as straight couples. But I don't think the state should have a role in defining if gay's can get married, I think that's something that churches should decide on a individual basis. It seems like this is a cross between Church and State, which will not end well. Though I feel the law that was passed in some other states that said gay couples could not adopt, was unjust and obviously not in the interest of children. Since there are many gay couples out there that would be willing to take in a child who desperately wishes to be with a family, no matter what their prefrence.

Moreover, the brain structure of a homosexual man is more akin to a heterosexual woman than a heterosexual man; the brain structure of a homosexual women is more akin to a heterosexual man than a heterosexual woman.

The constitution is an inspired document, and it is rather quiet on the nature of unions, so voters have the floor. Little tolerance can be assumed on part of the founding fathers for something other than 'natural' marriage -- what did they know would come about? Give them credit for leaving certain things to amendments and states' rights.
So here we are: opponents are displeased with the outcome on Prop 8, but rather than have the majority rule, we seem encouraged by voices here to open rebellion. Forget the law voiced by the people -- anarchy is being espoused in a childish rant.
Why seek your comfort in reactionary moves of intimidation and worse against the Mormons, Catholics, Evangelicals, blacks & latinos, married straights with children, who have all declared California safe as regarding the sacred institution? Is this different from radicalism of other sorts?
The law is now declared -- find peace with it. Be civil in response, because this has resulted a much clearer mandate than a 4-to-3 decision.

Still discrimination is discrimination I think the gay community in Cali need to get more diverse as well.
Being raised around a black/hispanic gay community all my life I find them unrepresented in the state.

As a society we are getting closer to change; and soon change will come.
To me Love is not Black and White, Love is the color of the rainbow.
I am a traditional married man but what gives me the right to say, that two people who love and care for one another the way I do for my wife ( and we aren't a perfect couple) can't commit to one another in the union of marriage. Call it non-traditional marriage or what have you.
For all the people that are against this, open up and grow with life or shrivel-up for lack of the water from the spring of life.

At times, it takes the government to protect the rights of a minority (see the 1960s).

separation of church and state - the petition placed in the bill of rights by Virginia Baptists sent to John Adams to disallow any state to sanction a state church. The Virginia Baptists were persecuted by the Anglicans at that time.
I don't see gays in the back of buses. I don't see gays using separate facilities. I don't see gays banned from any open associations. I don't see gays being restricted from government. I don't see gays being separated from schools and churches.
Please mature and refrain from name calling. This isn't sixth grade, I hope.

mrpibb i deduce from how you are reacting to this story that you would be upset if the proposition hadn't passed. i'm sure you'd be out now protesting it doing all that you can to change it back to how you deem fit. this is what these people are doing, and i believe the first amendment gives them that right, something about freedom of speech and protest or something, but i guess that doesn't matter to you. to you they are whining but they are doing what they should be doing, fighting for what they believe is right. in no way is this close to Rome, there is no bloodlust, there is no sluggishness they are being active citizens and it is only your opinion that their lifestyle is immoral. they are going about this in a respectable manner within the boundaries of the constitution.
