California cops to DEA: Help us undermine state law

"Perusing material submitted by the DEA in response to a query from House Judiciary Committee Chairman John Conyers, marijuana reform activist Dale Gieringer catches the the California Police Chiefs Association actively subverting state law. The documents received by Conyers, who is looking into the DEA's raids on medical marijuana dispensaries, include an October 2006 letter in which Steve Krull, the association's president, urges DEA Administrator Karen Tandy to "become more actively involved in working with local law enforcement to close these [medical marijuana] distribution centers, seize their profits and all marijuana which might be located and to take these cases into the federal judicial system." Krull suggests that "a concentrated effort sustained over a period of time would send a strong message to local and county government that 'medical marijuana' is not allowed and that those who profit from the sales and distribution of marijuana under the guise of 'medicine' will face the consequences."

Under California law, of course, marijuana is allowed for qualifying patients and is considered a medicine. That's why Krull complains to Tandy about the "dangers and frustrations that law enforcement has experienced in California with trying to enforce marijuana laws." He reports, with apparent amazement, that "some situations have reached the point where state judicial officers (local judges) are ordering our members to return marijuana which has been lawfully seized"—i.e., instructing police to give back the medicine that patients are permitted to have under state law. Evidently Krull and many of his colleagues find obeying state law to be an intolerable nuisance, one they want the feds to help them avoid. The DEA has been happy to oblige, conducting 130 enforcement actions and making 365 arrests related to medical marijuana from 2004 through July 2008. Gieringer, coordinator of California NORML, notes that a state appeals court ruled last year that "it is not the job of the local police to enforce the federal drug laws." Both the California Supreme Court and the U.S. Supreme Court have declined to hear an appeal of that decision."

    • Capitalism isn't a political concept, it's an economic concept. Just like Communism is not an economic concept, it is a political one. If you want to bash capitalism for the prison-industrial complex, then you have to also realize that its survival is dependent upon political, not economic cooperation. There is no demand by the people to support a prison population as we do, but through government support, the prison systems become profitable. Capitalism isn't to blame, government influence in capitalism is to blame. Socialism doesn't work when there is a centralized governing body orchestrating the distribution of goods, and the same goes for capitalism. Some smart guy said something like, 'We can either have a democracy in the United States, or we can have a large amount of wealth in the hands of a few, but we cannot have both.'

    • I've noticed something..All I ever see the cops doing is harassing Motorists. I can only speculate that what the local Governments are into is Generating Income. These cameras at stoplights are another thing that irk Me. With a possible 3-$400 Ticket. I've watched these things click off 2,3,4 times in a single line of traffic. I'm sure they are raking in thousands per hour. Our Local Governments help us out by creating silly as shit Parking rules and Traffic Laws. They are all Money Grubbing Entities. Funding taxpayer paid Lunches and Buffets for themselves Let's not forget retreats and Seminars, New Furniture, Computers, City Vehicles and it just goes on and on. I was a City Employee for five Years in L.A. I know the deal. Of course I was a Maintenance Employee working out in the field so very rarely were We invited. The Office Staff live large I'll tell You that. They use drug tests to help screen out applicants which I believe personally to be Illegal Search and Seizure. to have to give up Body fluids to get a Job is paving the way for mandatory D.N.A. Testing for risk management. It's all about revenue generation. And that's all above and beyond the exorbitant Taxes and Fees We are required to pay for the privledge to drive a fucking car. Let's not forget the perks for Doctors to prescribe Drugs for the Drug Manufacturers, Food and Drug Administration monitoring it all. As white noise has stated that the Prison System is privatized now so it's profit for them and everyone up and down the line. We are only just now seeing the formation of the North American Union. They dumb down our Kids so they can turn out good little taxpaying Robots. Meanwhile the Parents have to work 2 and 3 Jobs to keep up with Poverty Levels while the School System raises our Kids for us, feeding them lies and bullshit that still don't make them competitive with Third World Level Education Systems. I am sick and tired of hearing America love it or leave. I believe it's America, Love it or change it! They keep us distracted with shit like Britney Spears or Lindsey Lohan, Paris Hilton Drama.How about the last six months of the constant Election Bullshit every nite. There is other more important news out there but You won't see it or hear it on the Major Media Outlets. The whole shit house is on fire but We don't know it. Our Political Leaders are really all the same. Fucking Lawyers turned into Judges, all to build themselves up for the Political Arena. Mayors screaming for the hiring of More Police. Legislating Morality. FUCK THEM ALL! I hate to say this but I'm sure I'm correct to say it. Obama is just another cog in the wheel for Corporate Slavery along with the Federal Treasury creating false, inflation. "Meet the new Boss, same as the old Boss.!" I hope I'm wrong but I doubt it. Time to wake up America! I fear it's too late. When You stand up and voice Yourself Your labeled as a "Conspiracy Freak" it's so easy to dehumanize when You get a label. So simple to persecute and hide the truth. Why are the Marines manning check points in California. Why are so many being brought Home. Could it be for fear of food riots? I don't want to be seen as Paranoid or just another Whacko. The Truth is there. You have to get Your face out of the T.V. sitcoms and Bullcrap the Media feeds us to keep us distracted. You have to get Educated and to be informed. That's a start but that does not end it. Maybe this next Generation will be the ones to work to stop it all. My Generation Sold Out just like our Parents did. Look at this massive Debt that has been left to our Childrens Children. We are Screwed!

    • There are people who are in legitimate need of painkilling options without risking puting mass quantities of prescription drugs into their systems. I live in Oregon and personally know people who benefit from medicinal marijuana. The resource centers allow these individuals to reduce their pain without having to turn the streets and pay highly inflated prices. It is a shame that the federal government still has the ability to overturn the vote of the state and criminalize these helpful centers and or jail people who are legal to grow medicinally.

    • when I lived in AZ the people of that state voted not once but twice to legalize med. marijuana and the then governor of the state Fife Symington said I don't care what the people of the state want Im not signing the bill and he didn't. I all but lost what little faith I still had in the political process at that point. Fuck the cops and the dea and the gov. Fife Symington was later convicted of crimes and sent to the joint.[pun intended] Good for that rotten piece of shit. The people of AZ finally got legalized med. marijuana. and ole Fife got what he deserved.

    • And municipalities are balancing their budgets with their cut of the so-called "war on drugs" money. They’re profiting just as much as the underground trade. But to stoop so low & bust the easiest targets - medicinal MJ users & their supply clinics is heartless, leaving a lot of people in physical pain & distress. Why don't they bust some real gangsters? Or haven't you heard, there's a spike in juveniles smoking pot.

People politically in power were growing political roots during the height of the terribly FAILED drug war and they don't want to give up to scientific fact. It's sad and their crave for power and control is killing the liberties and lives of Americans.

    • I remember there were a few scenes about this in the movie/documentary Super High Me. The fact that the police are ignoring a law that was VOTED in by the majority of voters and is supported by doctors is disgusting. Law enforcement is supposed to uphold the laws of the people and protect us from harm. By circumventing the state laws and siding with the federal agents, the police are not doing their sworn duty.

      The only good news is that Obama has said that he will stop the federal prosecution of medical marijuana patients. We need to make sure he sticks to his words.

      The Supreme Court has ruled that "Protect and Serve" is not the Duty of the Police. In fact they have responded that they cannot protect the community which they serve. That is why You will no longer see the words "protect and serve" on Police Cruisers as in the past. The Police are here to "Enforce the Law". Welcome to "Police State" and "New World Order". There plenty to investigate here. You'll find many of the answers on youtube under, New World Order, Police Brutality, etc. Check it for yourself. It's not pretty. We and our Personal Freedoms as well as the Constitution are under attack and soon to be things of the past. I hope U have ur Documents in Order.

      Funny thing is that i used to have faith in the police department only a few years ago... the real reason they hate weed is because it lets you see through all the bullshit. Fuck the Police.

      I hear ya..My girlfriend just got her license, I am awaiting aproval for mine....but yet if the feds decide to you can still get nailed. The law in Oregon allows 1 1/2 pounds plus several plants. Quite a bit, but Californias laws are seemingly set up for profits for the centers. Those places charge street prices...here you get 1/4 oz plus cookies and capsules for about 10$ weekly + your own grow setup situation. Better than endless supplies of liver killing oxycontin or other crap by far.
