The Gaza Strip is one of the most densely populated pieces of property in the world. The presence of militants within a civilian population does not, under international law, deprive that population of their protected status, and hence any assault upon that population under the guise of targeting militants is, in fact, a war crime.
Moreover, the people Israel claims are legitimate targets are members of Hamas, which Israel says is a terrorist organization. Hamas has been responsible for firing rockets into Israel. These rockets are extremely inaccurate and thus, even if Hamas intended to hit military targets within Israel, are indiscriminate by nature. When rockets from Gaza kill Israeli civilians, it is a war crime.
Hamas has a military wing. However, it is not entirely a military organization, but a political one. Members of Hamas are the democratically elected representatives of the Palestinian people. Dozens of these elected leaders have been kidnapped and held in Israeli prisons without charge. Others have been targeted for assassination, such as Nizar Rayan, a top Hamas official. To kill Rayan, Israel targeted a residential apartment building. The strike not only killed Rayan but two of his wives and four of his children, along with six others. There is no justification for such an attack under international law. This was a war crime.
Other of Israel’s bombardment with protected status under international law have included a mosque, a prison, police stations, and a university, in addition to residential buildings.
Moreover, Israel has long held Gaza under siege, allowing only the most minimal amounts of humanitarian supplies to enter. Israel is bombing and killing Palestinian civilians. Countless more have been wounded, and cannot receive medical attention. Hospitals running on generators have little or no fuel. Doctors have no proper equipment or medical supplies to treat the injured. These people, too, are the victims of Israeli policies targeted not at Hamas or legitimate military targets, but directly designed to punish the civilian population.

Please be aware that no country, save the US, has as much accountability during war time as Israel. If you can name one I'd like to see.
Please also be aware that while Israel was designed to protect "Jews," from persecution abroad, internal trials are conducted.
Please be aware that mistakes are made by individuals, and that the individuals are due a trial and are innocent until proven guilty. If those individuals are deemed guilty they will be brought to justice and jail. Racism would be to condemn an entire race for the mistakes of a few.

If Israel agrees to a two state solution and allows the Palestinians to govern and run their own country it would be completely different.
Israel runs the Palestinians territories as modern concentration camps. They regulate the food, electricity, water, medicine and all other goods, aid and have systematically taken the land of Palestinians. When ever the Palestinians argue them they shut all borders, water and electricity into Gaza.
As long as Israel keeps killing the innocent, destroying their homes, infrastructure and pushes the Palestinians further into poverty, they will have groups resist them such as Hamas which is by the way the democratically elected government of the Palestinians.

This is me n my girlz in Africa, a trip I got to take for free because I was one of four Magna Cum Laude students. I did aid work for Zambian agencies with USAID and am still in contact if you have something for them. They do horticulture. I've been to Palestine, compared to how these kids live, Gaza is a resort town. No clothes, no school, no food most of the time. We should send our US Dollars there. where thugs break into peoples houses every night to steal toting guns. Gazans recieve more aid per capita than any other refugee population in the world. Highroller since reading your post I took a bit to study where the Koran came from and the origin of Islam. So. A prophet has visions no one but he can see. He writes a new bible which incorporates christian and Jewish writings. Over the course of many years he has new revelations which "over write" previous visions which are presented as "corrections" of the word of god. After he is dead several versions and interpretations of the book are created but eventually through the influence of a Caliph one version is produced and the others destroyed. Hmmm. Ever hear the story of Joe Smith and Mormonism? The Koran is the word of God because the Koran says so. The existence of the Koran is proof that it is the word of God. Only those people who are fluent in an ancient dialect of Arabic can truly understand the meaning of the Koran but God has guided the hands creating other texts that tell you what God really meant. This is like reading translated versions of the Torah or New Testament. You cant tell me what the Koran really said or meant because what you think is just your opinion and no matter how scholarly or informed an expert you quote it still is just his opinion. You cant claim Gods guidance because who has the truth? Sunni? Shiite? Every group thinks they are the only ones with the truth. And the most damning fact is that in many if not most places in the world I could be imprisoned, flogged or executed for the words I have written here. Not that the Christians didn't have their moments of mass murder but tell me where a man would face the same punishment for questioning Christian beliefs in this manner?

(b) Incendiary weapons do not include:
(i) Munitions which may have incidental incendiary effects, such as illuminants, tracers, smoke or signalling systems;
(ii) Munitions designed to combine penetration, blast or fragmentation effects with an additional incendiary effect, such as armour-piercing projectiles, fragmentation shells, explosive bombs and similar combined-effects munitions in which the incendiary effect is not specifically designed to cause burn injury to persons, but to be used against military objectives, such as armoured vehicles, aircraft and installations or facilities.
2. "Concentration of civilians" means any concentration of civilians, be it permanent or temporary, such as in inhabited parts of cities, or inhabited towns or villages, or as in camps or columns of refugees or evacuees, or groups of nomads.
3. "Military objective" means, so far as objects are concerned, any object which by its nature, location, purpose or use makes an effective contribution to military action and whose total or partial destruction, capture or neutralization, in the circumstances ruling at the time, offers a definite military advantage.
4. "Civilian objects" are all objects which are not military objectives as defined in paragraph 3.
5. "Feasible precautions" are those precautions which are practicable or practically possible taking into account all circumstances ruling at the time, including humanitarian and military considerations.Article 2
Protection of civilians and civilian objects1. It is prohibited in all circumstances to make the civilian population as such, individual civilians or civilian objects the object of attack by incendiary weapons.

We are trying to move forward in this world and become more compassionate for one another as all your human religions preach love as the most important thing yet you and many fail to embrace it by justifying a reason for killing by hiding behind fear which your government imbred in you and your people(not specific to any nation).
Israel should stand for war crimes for their use of phospherous bombs and cluster bombs and for keeping the Palestinians in the terrible conditions in Gaza. Further this action should set a new initiative for prosecuting all nations that kill civilians, because a specie at war with itself is doomed in the end.

I find derek901's comparison to Chechnya interesting. For those who don't know, organizations such as Human Rights Watch have, and continue to call for Russian accountability in the region (just as they have in the recent Georgian invasion).
Derek's comments however reminded me of one similarity between these different disputed states and the conflict that surrounds them: racism.
Boris Yeltsin called Chechans "rabid dogs," just as Menachem Begin labeled Palestinians "beasts walking on two legs." I'm not saying the other side aren't guilty of their own prejudices, but the other sides in these conflicts don't claim to be democracies and don't give the impression to the rest of the world that they promise equality to all their citizens.
Yet what really raised my eyebrows was derek901's claim that there were no peace demonstrations (he calls them "bigoted hate-fests") for Rwanda or Darfur. How odd, especially since I have pictures of myself participating in more than one for each cause. They must have been photoshopped and planted on me by anti-Semites.

I know Human Rights Watch continues to call for war crimes tribunals. And the people involved should be brought up on charges.
The public outcry for Israel is far greater than ever there was for Chechnaya, Darfur, Ruwanda, ect.
The public outcry for Israel is much greater than the one for the Bush Admin. in the US.
All of the above have committed war crimes.
The Geneva Convention is only as good as the paper it is written on.
Since war seems to be the standard operating procedure for many countries, there needs to be a line which if crossed, will immediately bring all of the other nations not involved in the war, together as one, and press for war crimes prosecution.
I am not saying Israel should not be brought up for war crimes. Far from it. What they have done in the name of defense is dispicable.
Perhaps prosecuting Israel for war crimes, would set a precedent, which could be used as a model for other countries. - 3 years ago

Another Ad Hoc theory by World Peace
As mentioned earlier, there is a difference between argument and explanation. If we're interested in establishing A, and B is offered as evidence, the statement "A because B" is an argument. If we're trying to establish the truth of B, then "A because B" is not an argument, it's an explanation.
The Ad Hoc fallacy is to give an after-the-fact explanation which doesn't apply to other situations. Often this ad hoc explanation will be dressed up to look like an argument. For example, if we assume that God treats all people equally, then the following is an ad hoc explanation:
"I was healed from cancer."
"Praise the Lord, then. He is your healer."
"So, will He heal others who have cancer?"
"Er... The ways of God are mysterious."
ie: "well they're fighting in a crowded area they must be targeting civilians."

Well, you can't just talk about Jews. Nor can you just talk about the Jewish state. Any discussion of war crimes must be comparative and contextual. If Russia did not commit war crimes when its soldiers massacred tens of thousands of Chechnyans (not even in a defensive war) then on what basis could Israel be accused of accidentally killing a far fewer number of human shields in an effort to protect its civilians? What are the standards? Why are they not being applied equally or selectively? Can human rights endure in the face of such unequal and selective application? These are the questions the international community should be debating, not whether Israel, and Israel alone, violated the norms of that vaguest of notions called "international law" or the "law of war."
If Israel, and Israel alone among democracies fighting defensive wars, were ever to be charged with "war crimes," that would mark the end of international human rights law as a neutral arbitrator of conduct. Any international tribunal that were to charge Israel, having not charged the many nations that have done far worse, will lose any remaining legitimacy among fair-minded people of good will,
If the laws of war in particular, and international human rights in general, are to endure, they must be applied to nations in order of the seriousness of the violations, not in order of the political unpopularity of the nations. If the law of war were applied in this manner, Israel would be among the last, and certainly not the first, charged.

THE BIGGEST LIE AGAINST ISRAEL
The Phony War Crimes Accusation Against IsraelEvery time Israel seeks to defend its civilians against terrorist attacks, it is accused of war crimes by various United Nations agencies, hard left academics and some in the media. It is a totally phony charge concocted as part of Hamas' strategy -- supported by many on the hard left -- to delegitimate and demonize the Jewish state. Israel is the only democracy in the world ever accused of war crimes when it fights a defensive war to protect its civilians. This is remarkable, especially in light of the fact that Israel has killed far fewer civilians than any other country in the world that has faced comparable threats. In the most recent war in Gaza fewer than a thousand civilians -- even by Hamas' skewed count -- have been killed. This, despite the fact that no one can now deny that Hamas had employed a deliberate policy of using children, schools, mosques, apartment buildings and other civilian areas as shields from behind which to launch its deadly anti-personnel rockets. The Israeli Air Force has produced unchallengeable video evidence of this Hamas war crime.
Just to take one comparison, consider the recent wars waged by Russia against Chechnya. In these wars Russian troops have killed tens of thousands of Chechnyan civilians, some of them willfully, at close range and in cold blood. Yet those radical academics who scream bloody murder against Israel (particularly in England) have never called for war crime tribunals to be convened against Russia. Nor have they called for war crime charges to be filed against any other of the many countries that routinely kill civilians, not in an effort to stop enemy terrorists, but just because it is part of their policy.
Nor did we see the Nuremburg-type rallies that were directed against Israel when hundreds of thousands of civilians were being murdered in Rwanda, in Darfur and in other parts of the world. These bigoted hate-fests are reserved for Israel.
The accusation of war crimes is nothing more than a tactic selectively invoked by Israel's enemies. Those who cry "war crime" against Israel don't generally care about war crimes, as such, indeed they often support them when engaged in by country's they like. What these people care about, and all they seem to care about, is Israel. Whatever Israel does is wrong regardless of the fact that so many other countries do worse.
When I raised this concern in a recent debate, my opponent accused me of changing the subject. He said we are talking about Israel now, not Chechnya or Darfur. This reminded me of a famous exchange between Harvard's racist president, Abbott Lawrence Lowell, and the great American judge Leonard Hand. Lowell announced that he wanted to reduce the number of Jews at Harvard, because, "Jews cheat." Judge Hand replied that "Christians also cheat." Lowell responded, "You're changing the subject. We are talking about Jews."

The problem stems from the blurring of Hamas' actual definition as a terrorist organization or legitimate governing body. On the US- and Israeli-axis, Hamas has been deemed a terrorist organization, whereas nations like Iran, Jordan, and others believe Hamas is a legitimate governing body.
Hamas does have a history of activity that would make it easy to perceive them as a terrorist threat, but it stems strongly from the idea that Christianity is a threat to Islam. If the Muslim body would focus more on being proactive within their faith, and through contributions to the world with their faith, the Christian threat would appear to be no more than a thin air fairytale.
Christian-based faiths on the other hand need to respect boundaries. That is a part of the world where they are trying to spread Christ-like ideals that don't fit in with the long-term Islamic ideals of most nations. The most important thing to do would be for key Christian, and Christian-based faiths to issue messages of support for Islam and state firmly that while nations like Iran oppose Israel's existence, the country is not intended to stand in opposition to Islamic faith. As Islam's most sacred artifacts and beliefs center in that region, so do those of Christianity, which should be a clear indication that the two bodies are not meant to be enemies, but close brothers.

They are trapped within the Gaza Strip. It is by Israeli design that they cannot escape across the border. It is by Israeli design that they have no food, water, or fuel by which to survive. Lie #2) Hamas violated the cease-fire. The Israeli bombardment is a response to Palestinian rocket fire and is designed to end such rocket attacks.
Israel never observed the cease-fire to begin with. From the beginning, it announced a “special security zone” within the Gaza Strip and announced that Palestinians who enter this zone will be fired upon. In other words, Israel announced its intention that Israeli soldiers would shoot at farmers and other individuals attempting to reach their own land in direct violation of not only the cease-fire but international law.
Despite shooting incidents, including ones resulting in Palestinians getting injured, Hamas still held to the cease-fire from the time it went into effect on June 19 until Israel effectively ended the truce on November 4 by launching an airstrike into Gaza that killed five and injured several others.
Israel’s violation of the cease-fire predictably resulted in retaliation from militants in Gaza who fired rockets into Israel in response. The increased barrage of rocket fire at the end of December is being used as justification for the continued Israeli bombardment, but is a direct response by militants to the Israeli attacks.
Israel's actions, including its violation of the cease-fire, predictably resulted in an escalation of rocket attacks against its own population.
Lie #3) Hamas is using human shields, a war crime.
There has been no evidence that Hamas has used human shields. The fact is, as previously noted, Gaza is a small piece of property that is densely populated. Israel engages in indiscriminate warfare such as the assassination of Nizar Rayan, in which members of his family were also murdered. It is victims like his dead children that Israel defines as “human shields” in its propaganda. There is no legitimacy for this interpretation under international law. In circumstances such as these, Hamas is not using human shields, Israel is committing war crimes in violation of the Geneva Conventions and other applicable international law.
Lie #4) Arab nations have not condemned Israel’s actions because they understand Israel’s justification for its assault.
The populations of those Arab countries are outraged at Israel’s actions and at their own governments for not condemning Israel’s assault and acting to end the violence. Simply stated, the Arab governments do not represent their respective Arab populations. The populations of the Arab nations have staged mass protests in opposition to not only Israel's actions but also the inaction of their own governments and what they view as either complacency or complicity in Israel's crimes.
Moreover, the refusal of Arab nations to take action to come to the aid of the Palestinians is not because they agree with Israel’s actions, but because they are submissive to the will of the US, which fully supports Israel. Egypt, for instance, which refused to open the border to allow Palestinians wounded in the attacks to get medical treatment in Egyptian hospitals, is heavily dependent upon US aid, and is being widely criticized within the population of the Arab countries for what is viewed as an absolute betrayal of the Gaza Palestinians.
