In a one paragraph order, the high court dismissed the case and approved Mr. Al-Marri's transfer from his solitary confinement cell in the Navy brig in Charleston, South Carolina, to a federal lockup in Illinois.
The move means that the justices will not examine the president's power to order the indefinite military detention without charge of anyone he deems to be an enemy combatant. The high court had agreed to take up Al-Marri's case. Oral argument was expected in late April.
But last week, President Obama ordered Al-Marri released from military detention and placed within the criminal justice system. Al-Marri has been held in the brig for five years and eight months.
Government lawyers argued that Al-Marri's Supreme Court case was now moot.

Very telling that Obama chose to maneuver this into a now contest. Again I am a Obama supporter but it annoys me how he had managed to avoid overturning any of the Bush war powers and assertions such as this.

This topic/thread is about this alleged terrorist/criminal that, I for one, admittedly would just rather do away with, than deal with any longer. I am weary of our continual capitulation to these evil devious m/f r's who have no compassion for anyone, even of their own kind. The evidence of this Islamic self righteous derangement is world wide and being perpetrated on the innocent every day, and if you fail to see that, I can only conclude that you choose to focus on the ideal, as opposed to the real..

I admit to being distracted by personal stuff. (Our daughter, son-in-law, and granddaughter are driving south from Atlanta. Always scary.) But whom exactly do you wish to kill?
OK. I cop to being a bleeding heart, compassionate, feed the hungry, heal the sick, save the earth liberal. And I cop to the fact that I don't really want to kill anyone.
But that doesn't mean I'm not still open and eager to learn and understand. Whom do you wish to kill? Why? On what principle and evidence?

Your forgiven, but you have the sense of humor about You. How true it is though. As We say here in the ghetto, It's better to keep him on ice for awhile. Three hot's and a cot are better than being ordered to strap on the dynamite vest. The Tropics are such a humid and uncomfortable place. While I have supported Obama's admin here is a case where government trumps the idealism of the campaign. How convenient to transfer him to the criminal justice system mere weeks before the government would have to defend its position on indefinite consignment of enemy combatants.
