Bush/Obama secrets revealed, Court allows landmark torture renditions case to proceed

Ruling strikes major blow to Bush/Obama position on state secrets

A federal appeals court ruled Tuesday to reinstate an ACLU lawsuit against a Boeing subsidiary that allegedly helped the CIA transport terror war prisoners to so-called black sites where they were tortured. The Obama administration had argued the case’s very existence would endanger national security and pressed the court to dispose of it.

“Today’s ruling demolishes once and for all the legal fiction, advanced by the Bush administration and continued by the Obama administration, that facts known throughout the world could be deemed ’secrets’ in a court of law,” said Ben Wizner, staff attorney with the ACLU National Security Project, in a media advisory.

“In a 26-page ruling, the 9th U.S. Circuit Court of Appeals found that the federal government failed to document how the lawsuit would reveal state secrets, sending the case back to San Jose U.S. District Judge James Ware for further proceedings,” reported Mercury News. “Ware dismissed the lawsuit last year, concluding that litigation over the controversial flight program could prompt the disclosure of CIA secrets.”

    • I'm sure as time goes on Obama will do the right thing and he will get tough on these war crimes. He just has to have some time to get all his facts right before he makes his big move.. Give it time people

    • The issue's are very deep and you all know that Obama couldn't just come into office and flip a switch and every thing is done. Just for starters hundreds of law suits are pending the constitution was damaged so badly that any steps the President takes are going too seem irrevalant at the time. We have to give him a chance he was a constitutional professor, I believe he will get things done.

    • I am an Obama fan (but I am independent, not democrat) who is all up in arms about Impeaching Bush, so I am obviously against anything that Obama is doing that resembles or protects the Bush administration. It is one thing feel favorable towards a president in general, it is yet another thing to excuse Obama just because he's Obama, and might I add still worlds apart and immesurably better than Bush, if still imperfect. Obama is not committing war crimes (as far as I know). I will not be quiet when any president does wrong. Nobody is above criticism.

      I wish Obama would get tougher on the war crimes committed by the Bush adminstration. I wish he would end the drug war. I wish he wasn't playing politics and instead did what's right... like following the rule of law when it comes to prosecuting war cimes, etc

    • not really...actually makes me think he's even smarter.

      as someone else noted, if he rescinded it the next clown could bring it back. if the courts rule against it's dead forever.

      maybe that's too much of a spin. but you have to wonder when the dude is a top-notch constitutional lawyer. wheels within wheels and whatnot and it's certainly not the craziest theory i've heard advanced these days.

      and banshee...i don't think any of obama's supporters agree with him keeping or using this power. be serious. i think we were all basically waiting for him to end them.
