Breckenridge, Colorado overwhelmingly votes to legalize marijuana

Breckenridge voters passed Measure 2F, which removes criminal penalties from the town code for the private possession of up to one ounce of marijuana by adults 21 and older. The ordinance also removes criminal penalties for the possession of bongs, pipes and other drug paraphernalia.
It passed 73 percent to 27 percent.
"This votes demonstrates that Breckenridge citizens overwhelmingly believe that adults should not be punished for making the safer choice to use marijuana instead of alcohol," said Sean McAllister, a Breckenridge attorney who proposed the ordinance.
The measure's victory is considered symbolic because it conflicts with state and federal laws. However, supporters of the measure say it inches the whole state closer to full legalization.
Other cities around the country have taken similar action in recent years, including a measure in Denver that decriminalized possession of marijuana up to one ounce.
Advocates say the Breckenridge proposal goes further than others because it allows paraphernalia as well. Drug paraphernalia possession in Colorado is considered a petty offense. Though "head shops" selling bongs and pipes are common in Colorado, the wares are ostensibly for smoking tobacco.
Paraphernalia charges are usually only filed along with possession charges. Both are misdemeanors punishable by a $100 fine and court fees.
The penalties aren't serious, but about 100 people a year in Breckenridge are cited for possession of either marijuana or paraphernalia, often both. Supporters of the effort say it's not right to leave small-time pot smokers with a criminal record.
The Breckenridge campaign, which had no formal opposition, received endorsements from Breckenridge Town Councilman Jeffrey Bergeron, Fmr. Colorado State Rep. and Breckenridge resident, Gary Lindstrom, and the Summit Daily News.
Measure 2F was placed on the ballot when more than 1,400 people signed a petition supporting it. It only needed 495 signatures to get on the ballot. The ordinance change will go into effect on Jan. 1, 2010.
Several Breckenridge residents heartily backed the local marijuana effort.
"People think it's a waste of time for the police to be prosecuting these people," said Elisabeth Lawrence, 30. Smoking pot, she said, is "not the worst thing in the world to be doing."
Nancy Skaj, a clerk at a Breckenridge grocery store, said the measure could be a boon for ski tourists who don't have clearance for medical marijuana. "With all the injuries people get skiing up here, instead of popping pills, they should just be doing this. It's a lot more natural," she said.
Breckenridge has roughly 3,300 voters.

Yeah, but the term "legal" has been used in all the stories. I think that it is effectively decriminalized since nobody can legally sell it, but the word is used as symbolism.
Hopefully California one-ups them next year, and provides a mechanism for individuals to buy it. Whenever I go to Breckenridge though, I am always asked by 20 somethings for weed because it is pretty easy to find somebody. Or, you just gotta get in the right gondola to get smoked up for free.

Is there a difference between denver and Breck once this happens? Shouldn't they say it is just decrimed if its not still legal to sell?

It's the same as the law Denver passed. It was a statewide initiative in 2008, but didn't pass. I belive it was approximately 54% to 46%.

Good luck with that. Colorado is expensive any way, and resort towns like Breckenridge, Vail, Steamboat, and Aspen are worse. You're better off moving to the Dillon/Frisco area and commuting to Breck.

talk about a way to increase tourism, Breckinridge won't have enough hotel rooms to accomodate the people who will flock there to do their skiing. I think I should move there and open up a bed and breakfast fully equiped to let my guest smoke their way to oblivion. This is a rolling stone that is going to gather the moss as it rolls accross the country.

President Obama could change things with the stroke of a pen. He could change the classification of cannabis and let the research really begin. Richard Nixon changed the classification of cannabis. President Obama could right the wrongs of Richard Nixon, the facts are on his side.

I agree, but i think Obama did an important thing recently by declaring that the Feds will no longer meddle in state affairs concerning medical marijuana. that means that it will be up to states and local governments, like in this article, to take it upon themselves. maybe now communities across the country wont feel federal pressure when broaching the issue, and more municipalities will go the way of Breckenridge, more and more until one day...

Obama did open the door to acceptance, in a chicken shit way but he still did it.
Reclassification is definitely the next step. Hopefully states will start dropping like dominos.If he could undo anything Nixon did it would be a step in the right direction.
I really think hes trying to make sure this is movement by the people and not another executive decision that can be changed by the next president.

LOL. As I was reading this article I kept thinking how this would go over here in Raleigh. My wishful thinking gets the best of me and I think it just may pass. A hopeful 1st step may be getting cannabis legalized for medical purposes. Write/call your reps in NC and ask them to support H1380 and H1383!!!
