California Supreme Court rules state ban on gay marriage is unconstitutional

- added this
The lawsuit came about after San Francisco mayor Gavin Newsom ordered his city hall clerk to change the application to read simply the gender neutral applicant one and applicant two. Word got out, and a rainy March of 2004 became a month of essentially non-stop weddings by same sex couples at the city hall.
California's state legislature has twice passed bills legalizing same sex marriage and overturning the Defense of Marriage Act, a law passed by voters at the ballot box in the form of Proposition 22. Governor Schwazenegger vetoed both, saying he wanted the courts to weigh in on the issue, but that he respects the will of the voters and the decision by the courts.
Both sides have said they are expecting the case to be appealed to the US Supreme Court, which has never addressed the question of same sex marriage.

@menmykoko et. al:
Yeah, I am baffled as well why a soleil10, an old, white, conservative person who is not an American citizen (or at least came to this country long after the formative years) would want to curtail an American state's movement towards equality and democracy.
Here's a clue: I might guess that soleil10 was a sad and lonely child, and as he has grown up he clings to the belief that those who belong in his group (white, heterosexual males) are better than those in any other group.
Probably most of the people who are vehemently opposed to gay marriage are in the same boat.
They've done studies to define this kind of behavior. In particular, people who are selfish, deluded and defensive as soleil10 is, are insecure. They've had negative relationships with their parents and insecure childhood relationships. As a result, they've grown up avoiding intimacy, dismissive of love and closeness because they are insecure and afraid. But they also bury these feelings, understandably, in order to protect themselves as adults. The result is a defensive and delusional inflation of self-esteem.
Check out Sharon Begley's excellent book, written with the Dalai Lama: "Train Your Mind, Change Your Brain."
In the meantime I'll have to send a little love to soleil10 in the hopes that he will be able to see others with the compassion that he may have lacked as a child.

Divorce is a disgrace especially when they are children.
It does not make marriage less valuable.
Most American understand that unions of husband and wife have a unique status in law and culture. They are uniquely necessary because they are the unions that both make new life and connect those children to their own mother and father.

Soleil, well, thanks for the lesson in ignorance and hypocrisy and doubletalk so indicative of a conservative mind. But your reasoning is a little lackluster. You can not claim to care about the extinction of humans yet exclude 10% of them. It's kinda like if you were in charge on a sinking boat that had enough lifeboats for everyone. And instead of saving everyone which you had the opportunity to do--You instead said everybody get in the boats except you people over there, you are not worthy.
Moreover, out of the people that you chose to live (from the families and children), SOME OF THOSE CHILDREN WILL BE GAY WHEN THEY GROW UP. Therin lies the problem with you and your kind, everyone you talk about the children you so righteously are protecting you are in fact hurting and some will eventually lill themselves before they are an adult. It's so horrible and you have just contributed to it.I find it a most egregious and insulting audacity for someone who is not half the human being I am to try and tell me I am not worthy of the same rights as he. It is infuriating to no end. I have pulled a person out of a burning car and saved their life and been a registered nurse for 14 years. As long as I play by socities rules there is no person on this rock who is qualified to tell me what I deserve but me--and I getting goddamned sick and tired of it.

The mentality has to change. The idea that marriage is so sacred, this bond between man and woman is so damn passe. Have we seen the divorce rate? People get married for the wrong reasons, or they just keep doing it, 3, 4, or 5 times. Hopefully, they'll get lucky.
It's not about what you think is morally right wrong. Many of us live by different set of rules, but as a society, you cannot keep a group of people from having the same rights and benefits as everyone else simply because you were told you that who they are is wrong. It's about equality. It's always been about equality. If what they do in the bedroom is what disturbs you, I can tell you heterosexuals can be just as deplorable as you think gays are.
Get off your horse because you're not as righteous as your views allow you to think you are.

Its not all fun an games I was once married to my partner of 7yrs. In the last 2 yrs of our being together we had the chance to get married and we did then it was played with by the system. During that time we divorced I had taken his last name so the American system for name changes was not ready for me it was a disaster. The SSA and Passport agency's had no idea what to do or what to think of me. I worry about all of those who are in Calf now much like I was and are going to rush into the even if the system is not ready.

California supreme court has just ruled that 62% of Californians who voted for marriage as the union of husband and wife are just bigots.
Most Americans understand that marriage is not bigotry. It is common sense-- unions of husband and wife have a unique status in law and culture because they really are different from other kinds of unions including in this way: They are uniquely necessary because they are the uniions that both make new life and connect those children to their own mother and father.

Dmitri that was a real coktail molotov you send me.
Based on Europe experience with gay marriage since the 90s
-95% of gays are not interested in marriage
-of the 5% who marry the divorce rate is 50% higher for homosexuals and over 100% for lesbians in comparaison to natural marriage
-interest in marriage goes down for the whole nation. It looses its value for everyone else.
In terms of adoption;
-Sexual abuse is higher in non biological parenting.
-Kids are looking for their real biological parents.
-Children have a basic right to a father and a mother more than you have to whatever you call marriage.Gay Marriage is just denial

I could get angry at your ignorance and bigotry. I could tell you you are a brainwashed and almost invariably white, male, and between the ages of 18 and 40, but you already know that. Oh you convince yourself you're right. Hell, it might even be one of your greatest convictions (Unlikely however, seeing as homophobia is usually an excuse to cover up ones own homosexuality), but you know, somewhere in the corner of your brain that's usually turned off (the part that knows your bad habits, yet also ignores them) that it is simply not true. So for right now, I'm just going to laugh quietly to myself at your impending political extinction, your lack of acceptance eliminating you from the process of political evolution like the short legs of the Dodo. Hmm. That really brightened my day in a strange way. Thank you for your utter ignorance and refusal to think for yourself, it brings me some small entertainment watching you choke up the words that will bring about the end of your like. Also I would like to salute current89 for his progressive and profound work on this matter. 2 down 48 to go-way to go California! Currently residing in the 1st state to legally allow gay marriage, Massachusetts, I can tell you that those who were finally allowed to wed & be recognized as equal in the eyes of the law instead of branded as crimminals merely reinforced what our state, "The Cradle of Liberty" was & still is all about-FREEDOM. Now, will everybody that this issue doesn't apply to take one gigantic step out of the way & tend to your own affairs so this once great country can get back on track & deal with what's truly important, like reinstating the integrity of our Constitution for a start.
Let our citizens speak out for what they want, how they want to live their lives & most importantly-with whom they want to live with & love. How did we get to a place where Americans need a court's approval to marry? I can't imagine what that must feel like, but sure can share in the joy & celebration that this monumental decision brings. Now what are you waiting for-GO TIE THE KNOT!!

With couples already lining up at San Francisco City Hall for appointments to get marriage licenses, the judgment could be a boon to California's economy should it go unchallenged. Unlike other states, California has no residency requirements for obtaining marriage licenses, meaning that same sex couples could flock to the Golden State for ceremonies (though same-sex marriages performed in California may not be recognized in other states).
As comedienne and GLBT activist Margaret Cho pointed out, "just the ice sculptures alone" could be worth a small fortune to the local economy. Living in West Hollywood, the Daily Mantra can think of a new reason to hold on to our tax refund/stimulus payment when it arrives. With the slew of gay marriages that are likely to happen over the summer we anticipate that we'll have to allocate a rather large budget for wedding outfits and gifts in 2008! Yay! We love a good wedding!

Congratulations California!
However, prepare to continue to fight the good fight. The religious fundamentalists will, with a collective voice that has not yet been heard, begin sermonizing from the pulpit to the street corners that this ruling is the beginning of the end of the human race.
Propaganda will spread across the country seducing anyone who will listen into believing (or reaffirming) that equal access to marriage for same sex couples remains a religious issue. One religious fundamentalist lawmaker from Oklahoma recently declared that granting GLBT individuals equal rights was more dangerous to this nation than terrorism.
Clearly this is a civil right that has been justly granted to the citizens of California, and religion had nothing to do with it.
An FYI: Six of the seven California supremes are Republican appointees. Go figure.
Again, congratulations!

California....is like a beautiful island with land on one side surrounded by states that seem to be light or right years away from them. I can not say that marriage is a natural state. I am an animal wrapped in cotton and have never understood it. I am for anything that helps support Love and Kindness and that is the basic premise. No one and I will repeat no one has the right to tell anyone anything as long as that person has not violated the rights of another. If you fall in Love with a rock then it is your choice to treat it in a positive way or a negative one. One way leads to grand things, the other is the other. If you want to marry the rock, then it is your choice alone. God which is the totality of the Universe does not come into the situation, even if you want it to. The rock is made of the same molecules as you and everything else you see. They were borrowed and you must give them back. One grain of sand in the beach we call the Universe. Treat everything with Love and respect, marry anything, but treat all things well..............Johnnie Hargrave.................

"...As a Christian, I can not approve of the Gay lifestyle. But I don't see the point in trying to stop gay CIVIL UNIONS..."
As a Christian heterosexual, this law of the land neither affects you, nor solicits your approval or sanction. Get a grip, bruh.
And, I agree with you on legalizing civil unions, which help out more than the GLBT community. Few can afford to live alone or on a single income. Yet, when it is discovered that you're getting a nickel's worth of help from anywhere, the government penalizes you. They will bail out major banks and greedy financial institutions, but not tax-paying citizens struggling to eat, buy gas to get to work, and maintain shelter.

Why do people care so much if gay people get married? How does it in any way shape or form affect your life? They will still be gay wether they are married or not, they will still love together, nothing will change about them. Get over yourself and understand that love doesn't pertain to just man to woman. Conservatives say they want less government when it comes to money and church and when it seems to benefit them and real property. Yet they want to impose their ideological views and control other peoples lives via data and abortion etc. They are hypocritical and contradictory to say the least. I try to understand their reasoning, but am baffled by it. It seems to be taking forever for them to understand what humanism means. It's almost like they lack the ability to imagine themselves in someone elses shoes. They, more than any others, care less about the consequences of their actions which is similar to sociopathic behavior, in my humble opinion and I bet that if studies were done between the left and right far more righties would tend to be sociopaths. But anyway, back to the congratulations--

Today is a day I will never forget.
It is with unimaginable joy that I write to tell you that the California Supreme Court just ruled in our favor, declaring that each of us has the freedom to marry the person we love.
This is a landmark victory for our community. It's a victory for fairness and justice. And it's an incredible victory for California land of opportunity. For 10 years, Equality California has worked tirelessly to bring us to this moment. Today, for the first time in history, lesbian, gay, bisexual and transgender (LGBT) Californians are truly equal. It is an amazing feeling.
I wish we could simply celebrate and enjoy this incredible victory.
But the truth is, this is just the beginning of the fight of our lives. Anti-LGBT hate organizations are already hard at work trying to pass a constitutional amendment this November in an attempt to take away our freedom to marry. And they have already raised millions of dollars to fund their discriminatory effort.
We can't let that happen. We won't let that happen.
It will take all of us to keep this victory. Make a contribution today to help preserve the freedom to marry from this vicious attack. Every dollar you donate will be used to fight this initiative.
Equality California Issues PAC is with a coalition of organizations working to defeat this initiative. Your donation today will help us buy media time and hire more field organizers across the state to mobilize the thousands of volunteers who have already gathered more than 76,000 signatures opposing the initiative.
Today's victory proves that by working together we can achieve equality.
Our win today would not have been possible without the generous commitment and steadfast support of our thousands of volunteers and donors. And I cannot say enough about the brilliant legal team representing EQCA as a plaintiff in the case: National Center for Lesbian Rights, Lambda Legal, ACLU, Heller Ehrman and the Law Office of David C. Codell.
Help us keep marriage in California by making a donation today to fight the ballot initiative. As a united force, we will forever have equality in our state.
Once again, thank you for supporting EQCA in the fight for equality. I have never been more proud to be a part of this community. I have never been more proud to be a Californian.
Warmly,
Geoff Kors
