Protesters marched into the early morning in Los Angeles yesterday, expressing their anger against the passage of Proposition 8.
A federal judge in San Francisco will decide Wednesday whether gays and lesbians have a constitutional right to marry.
U.S. District Chief Judge Vaughn R. Walker, who presided over a trial earlier this year on the constitutionality of Proposition 8, will release his long-awaited ruling Wednesday on whether the 2008 ballot initiative violates the U.S. Constitution, a court spokeswoman said. [Updated, 5:50 p.m.: His ruling is expected to be released between 1 p.m. and 3 p.m.]
Walker, an appointee of President George H.W. Bush, heard myriad witnesses testify about the history of marriage, the nature of homosexuality and the degree of power gays and lesbians possess in the political system during the 2 1/2-week trial in January.
Most of the testimony favored marriage rights for homosexuals. Walker’s decision is expected to be appealed to the U.S. 9th Circuit Court of Appeals and then up to the U.S. Supreme Court.
A Los Angeles-based group funding the litigation hired former Solicitor General Ted Olson, a conservative, and noted litigator David Boies, who squared off against Olson in Bush vs. Gore, to represent two couples who are challenging Proposition 8.
The California Supreme Court ruled 4 to 3 that gays and lesbians were entitled to marry under the state Constitution in an historic ruling in May 2008. Voters passed Proposition 8 six months later, amending the state Constitution to ban same-sex marriage.
Walker will decide whether California’s ban on same-sex marriage violates equal protection and due process rights guaranteed by the U.S. Constitution.

The idea that any authority could strip the civil rights of any group based on race, gender, creed, sexuality, health, religion, or income is so great an affront to the fundamental fabric of this country that it defies any description. Pardon me, but I don't give a damn what fundamentalist Christian Conservatives think; justice is blind.
I just pray that that's more than a comforting saying on this day.

Erwin Chemerinsky knows his Constitutional law. Personally, I think that prop 8 does violate equal protection, and there's a good long line of case law to support such an equal protection violation. This one is definitely headed to the Supreme Court.

I didn't read that one, but I have read his casebook and treatise on constitutional law. It's one that is used in a significant number of U.S. law schools. He is one of the foremost constitutional law authorities in the country, and his analyses of the Equal Protection Clause of the Fourteenth Amendment are usually dead on.

PROP 8 TRIAL SF COURTHOUSE X390 (GETTY) | ADVOCATE.COMU.S. district chief judge Vaughn Walker will issue a written decision on the federal challenge to California's Proposition 8 on Wednesday.
High-profile attorneys Ted Olson and David Boies argued for the repeal of Proposition 8, representing two same-sex California couples in Perry v. Schwarzenegger. The ballot initiative, passed with 52% of the vote, overturned a California supreme court ruling that legalized same-sex marriage from June to November 2008.
Erwin Chemerinsky, a professor at the University of California, Irvine, School of Law, believes Walker will strike down Prop. 8 on grounds that it violates equal protection principles of the U.S. Constitution. Even if Chemerinsky is wrong, the case will likely head to the ninth circuit court of appeals, but that will "surely take more than a year," he says.
UPDATE: According to the court, a decision in Perry will be filed between 1 p.m. and 3 p.m. Pacific time on Wednesday. The decision will be available soon after on the court's website, available here.

California gears up for ruling on same-sex marriage

August 4, 2010 3:21 a.m. EDT(CNN) -- A federal judge in California is expected to issue his ruling Wednesday on whether the state's voter-approved ban on same-sex marriage is unconstitutional.
The closely watched case, to be decided by Chief U.S. District Judge Vaughn Walker, comes some two years after Californians voted to pass Proposition 8, which defined marriage as a union between a man and a woman.
Wednesday's ruling, expected in the early afternoon, will decide whether that ban violates the U.S. Constitution by creating separate classes of people with different laws for each.
Though stakes in the case are high, neither opponents nor supporters of same-sex marriage say Walker's ruling will likely be the last. Both sides say the decision will be appealed and eventually wind up in the U.S. Supreme Court.
"We have little doubt that this trial judge is going to knock down Prop. 8. I hope I'm proven wrong tomorrow," said Maggie Gallagher, chairman of the National Organization for Marriage. "This has been a judge that looks pretty eager to make a historic decision."
She added Walker's ruling will likely have national implications as he is a federal judge.
Rick Jacobs, founder of the Campaign Courage, which supports same-sex marriage, said he was hopeful about Wednesday's decision because of what happened during the trial.
"I can only say that based on the evidence in the trial, it is absolutely clear that allowing gays and lesbians to marry will strengthen families and the nation," he said. "No matter how the judge rules tomorrow, we've already won a significant victory because the other side admitted they have no argument."
Jacobs said if the case is appealed, it would go next to the 9th U.S. Circuit Court of Appeals before possibly heading to the U.S. Supreme Court. It is expected to set legal precedent that would result in a landmark decision that could settle whether people in the United States can marry people of the same sex.
Kristin Perry and Sandy Stier, along with Jeffrey Zarrillo and Paul Katami, are the two couples at the heart of the case. They had asked Walker to issue an injunction against Proposition 8's enforcement.
Proposition 8 is part of a long line of seesaw rulings, court cases, debates and protests in California over the contentious issue of same-sex marriage. It passed with some 52 percent of the vote in November 2008.
"Whatever happens tomorrow is the beginning -- not the end," said Jacobs.

This is not the end, I know the judge will decide in favor of liberty and justice and allow people of the same sex to marry. But it will be fought all the way to the Supreme Court and hopefully by then...we will have a new judge on the bench. Even though it conservatively stacked 5-4 currently, I am hoping that they will decide in favor of equality and equal protection under the 14th amendment.

Is it just me? But I do not understand what the opposition is to gay marriage. What is wrong with it? These are human beings we are talking about that have the same rights in everthing else, but not marriage? Marriage is a bond that two mature people make to each other. Really want is the worse thing that will happen if gays and lesbians marry? More money for the divorce lawyer!!!! They should behind this. Are we afraid that gay marriage might last longer that ours and show a more loving environment than we do? I just don't know. There are bigger problems out here. Yes, I am for gay marriage. Can we concentrate on the fact that our food and water is posioned,that people are not working, that our children are bulling each other in schools. Maybe even the real big thing is that, some of us, the elite, want us DEAD, so they can rule the rest of us. There are bigger things happening. Do you know what is in the meat or vegatables that you eat? Did you know that while you think your eating healthy, you re slowly dying? No no, lets deny simple basic right to a group of people. That is easier for us to handle, something we can actually control, Right? Just my thoughts!!!!!
