American injustice- US is the only country in the world - Imprisoning children for life

Lawyers for an 11 year old child in Pennsylvania who allegedly shot and killed his father's pregnant fiancée worked hard to convince an appeals court not to hold him as an adult to prevent life imprisonment.

America's unsympathetic juvenile justice system has many questioning the morals of the court. In America a policy known as "life means life" allows children under the age of 18 to be tried as adults for certain crimes and can lead to life imprisonment without any chance of parole.

Like Somalia, the US has continually refused to ratify the UN Convention on the Rights of the Child which would prohibit the American judicial system for holding children for live without the possibility of parole.

In the US state of Pennsylvania, where the case is being heard, all juvenile offenders are automatically treated as adults unless the judge specifically rules otherwise.
Jordan Brown, the child in question, is accused of casually shooting and killing his father's pregnant fiancée with a hunting rifle, and then going about his school day as normal. Prosecution argued evidence indicated the act was premeditated.
A number of human rights and child advocates have protested Brown’s treatment, alleging it violates international law.

Ashley Nellis, a research analyst with The Sentencing Project, a Washington bases advocacy organization, explained no other nation has children serving time in prison for life without parole and America’s system is extremely harsh on children.
“We have a very harsh tough-on-crime sentencing structure that prides itself on throwing away the key without regard to age, or maturity or level of knowledge,” she said. “International law, the international standard, is there is no life without parole sentencing for children.”

Brown’s case is, unfortunately, not unique.
“There are 2,500 or so people serving life sentences without the opportunity for parole for crimes committed when they were under 18. Pennsylvania has more than any other state,” she said.

Many Americans are unaware the sentencing of children to life without any opportunity for parole even occurs.
“We are trying to educate the public,” Nellis said. “The public is completely unaware that we have this practice when in fact there have been people sentenced to prison for life from the 60s that are still there.”

Dungeons & Dragons: A Threat to Prison Security

Sometime you read a story and it takes a lot of re-reading and double checking before you can bring yourself to accept it truly is legitimate. This is one of those stories.
The seventh circuit of the United States Court of Appeals has just published a ruling on a case heard last September. Let us peruse the opening line and consider whether this may be the greatest legal ruling in history:
After concluding that the popular role-playing game Dungeons and Dragons (“D&D”) represented a threat to prison security, officials at Wisconsin’s Waupun Correctional Institution took action to eradicate D&D within the prison’s wall.
Yes, you read that right. This is a ruling on whether or not prison officials were justified in confiscating D&D material. It wasn’t a case of officials being concerned that multi-faceted dice could be fashioned into weapons (only “twenty-one books, fourteen magazines” and handwritten notes were confiscated), but an even more serious matter:
Waupun’s long-serving Disruptive Group Coordinator, Captain Bruce Muraski, received an anonymous letter from an inmate. The letter expressed concern that Singer and three other inmates were forming a D&D gang and were trying to recruit others to join by passing around their D&D publications and touting the “rush” they got from playing the game.
The prisoner concerned, Kevin Singer, complained the confiscation was a violation of first amendment rights. He then, in the words of the court, sought “a panoply of relief”, which sadly turned out not to be a D&D spell.
Singer maintains that rather than D&D playing encouraging gang activity, it actually deters prisoners from joining gangs.
After losing the case, Singer took it to appeal. There, an expert on prison gangs argued not only that having a Dungeon Master issue direction to other players “mimics the organization of a gang”, but that the game encourages players to become obsessed with mentally escaping the restrictions of prison life, which could threaten “the safety and security of the institution.”
Although Singer produced witness testimony from 11 other inmates who said they had never heard of D&D leading to gang-related activity, the judges at the appeal ruled this was irrelevant: all that mattered was that it was reasonable for the prison officials to believe it might do so in the future.
And what is the evidence for this argument? Well, in a 2009 case, a prison gang leader “established and enforced rules.” You know, just like in D&D. And hell, there’s even a risk of “D&D players looking to Dungeon Masters, rather than to the prison’s own carefully constructed hierarchy of authority, for guidance and dispute resolution.”
In any case, the judges noted, the prison wasn’t banning all books or games. After all, in a 2005 case when some games were banned, ” strategy games like Risk, Stratego, chess, and checkers remained available to prisoners.”
In conclusion, the judges pointed out that Singer had failed in his duty to prove conclusively that D&D could not lead to gang activity. (Which may be because even the most creative role-player can’t prove a future negative.)
The court therefore rejected the appeal.

US inmates go on strike, demand wages and education

Inmates in a prison in the US state of Georgia are striking, demanding the justice system provide them with better medical and health care, wages, and additional educational opportunities.

Thus far the strike has been peaceful and non-violent, with inmates refusing to do their assigned work duties, opting to leave their cells only for food and showers.
Family members and supporters of the inmates are now seeking to meet with prison officials to discuss implementing the inmates’ demands.

Inmates from a diverse set of backgrounds, including white supremacists, African Americans, Muslims and multiple gangs have come together in their efforts.
Glen Ford, the executive editor of The Black Agenda Report argued American prison policy is one of mass incarceration, and it’s time for that to change. He contended that grater human rights must be recognized within the penal system.
“What the prisoners are basically demanding is that they be treated with human dignity,” he said. “The top demand today is there be a halt to the retaliation against the prisoners.”

Ford claimed groups of guards beat inmates and then transfer them to maximum security sites within the state, and sometimes to prisons in other states.
“The imamates have also been demanding that they not be transferred out-of-state so they might never see their families again and they are demanding a fact finding committee that is approved by inmates to look into the conditions in the Georgia prison system,” he said.

In addition, inmates are calling for greater medical facilities and basic healthcare, which they assert they are not receiving.

Currently, 1 in 12 adults are in prisons or jails in the State of Georgia.

Dr. Malik Zulu Shabazz, the chairman of the New Black Panther Party said the strike was impressive, not only because it was non-violent, but because it brought together many groups of people who normally feud with one another.

“I’m impressed,” he said. “They have chosen to rise and take a stand for their human rights and their legal rights which have been violated and continuously violated. I hope that what they are doing will send a message out across state lines to others who are behind bars that they must organize behind bars and take the necessary risk to take a stand for their human rights and for a better life.”

He argued the American prison system is a vestige of slavery itself.
“Incarceration and coercion has been a means to control black people who compose a majority of those in the prison system,” Shabazz added. “It’s a prison industrial complex.”
