In any court proceeding, the highest burden of proof is proof “beyond a reasonable doubt.” When a person stands trial, the jury must therefore begin with the assumption that the accusations against the defendant are false.
The constitution requires the State to prove its accusations against the defendant. It is not necessary for the defendant to disprove anything. Nor is the defendant required to prove his or her innocence. It is up to the State to prove the defendant’s guilt by evidence.
A juror can only find in favor for the State at the end of the trial, providing the prosecution has erased all reasonable doubts about the defendant’s innocence from the juror’s mind.
So taking all that one step further… and putting the ridiculous burglary charge BS aside… it technically comes down to a charge of whether or not this was premeditated (i.e. pre-planned) 1st degree murder.
Contrary to the opinion of the clueless masses and non trial watchers, this is not a “Whodunit” trial – nor is it based on the color of Jodi’s hair… a Walmart receipt… a gas can… or on what someone might have said to someone else at some point. None of that matters.
In reality, it’s actually an overcharged self defense case, and a judicial farce to boot.
This is why there’ll be a Not Guilty verdict returned on the bullshit M1 charge.
You see, the jurors have to weigh up all the evidence – including the State’s LACK of evidence, and the obvious & accompanying lack of pre-meditation on Jodi’s part. And despite Martinez’ shambolic showboating escapades, the State has never even come close to proving their case beyond all reasonable doubt… not this week, not last week, not last month… and not at any other time either. Nor will they ever.
This quote (reproduced from an earlier post) sums it all up very well…
“As far as I am concerned, the only issue in the Jodi Arias trial is has the government proven premeditation. That of course, is important because if the government has not proven premeditation, they cannot convict her of murder in the first degree and thus the death penalty is off the table. And while the government has also alleged murder in the first degree by way of felony-murder, that allegation is so specious as not to even warrant a response.
The government has not proven premeditation, and in fact, could not do so under any circumstances. Without direct evidence, either a confession by Ms. Arias that she intended to kill Mr. Alexander, as in “I wanted to kill to him”, or an overt act such as hiring a hit man or waiting in wait in ambush, the government cannot prove premeditation beyond a reasonable doubt. Note that I am not saying she did not intend to kill him or that there is not very good reason to suspect that she intended to kill him, just that the government will not be able to prove it beyond a reasonable doubt. And that has been clear since day one. Someone asked me on twitter a question along the lines of “she lied so she doesn’t get the death penalty?”. My answer, yes, exactly right. To paraphrase Lt. Kaffee from a “Few Good Men”, it doesn’t matter what we know; it only matters what we can prove.
Instead of proving premeditation with direct evidence, the government is trying to do so with circumstantial evidence. So far the attempt has been, with the most charitable interpretation possible, pathetic. While the law does not recognize a distinction between direct and circumstantial evidence, there is a jury instruction that says exactly that, the inference the government wishes the jury to draw from the circumstantial evidence is, dare I say, comically lacking.”
Yes, Martinez has his favorite autopsy pics which he’s put to good use so far, and will do in his closings… but none of those pictures prove pre-meditation either. All they prove is that the animal Jodi was defending herself against came off decidedly second best.
Jodi - the potential VICTIM – turned the tables on her attacker. Self defense. Plain & simple.
So based on all that…. the fact still remains that some of the jurors, for reasons best known to themselves, will still believe it was pre-meditated. But some of the jurors will not. So a hung jury equates to Not Guilty.

Everyone has been speculating all weekend long about what is going to happen Monday morning in the Jodi Arias murder trial.
According to the Jodi Arias support site and one of their best contributors, this appears to be a plausible explanation of what is going to happend Monday morning:
With all the current speculation surrounding the start of the new trial week — what with Alyce LaViolette, witness tampering, Facebook death threats, Grace Wong, potential mistrials and other stuff — check out the post below from our regular contributor Al, which sheds more light on the current state of play.
Here goes…
“… I think this judge has ended up somewhere between the devil and the deep blue sea, and a lot of it is of her own choosing.
If she dismisses the case due to the public’s reaction, JM and the family is going to throw a hissy fit.
If she dismisses it due to the victim’s family’s actions it sort of puts JM in a tough spot because he probably then is faced with having to prosecute them and they’re going to throw a hissy fit.
If she declares a mistrial, the defense is going to claim that given the international hue and cry, there can be no fair trial anywhere, ever.
If I was the judge I would tell the state to make a straight up plea deal with the defense and get it over with. And the plea deal I would urge them to take is something that would be the equivalent of her having to wait for another trial, say another year or so.
I know this is going to go down rough with the Alexanders, but it’s better than opening that witness intimidation can of worms.
Now I wonder if the judge has thought this out, and the reason she wants to have Wong up first is so that, if she can find some reason to declare a mistrial based on what Wong says, it might give her a way out.
She can then declare the mistrial, have JM take a plea deal and get the whole thing cleared up. That way none of the rest of this stuff ever needs to be discussed, and she draws a deep sigh and hopes she can make sure this never happens in her court again. I bet the Hon. Sherry Stephens never has cameras in her court again.
If she cannot get some reason based on Wong’s testimony, then I suspect she’s going to have the worst few days of her life.

The majority of the ever clueless media always appear to be wheeling out BS excuses for the haters. They say that people are “entitled to their opinion”… and they have “the right to free speech”.
We wouldn’t argue with that under normal circumstances. Yes, everyone IS entitled to their opinion… and everyone DOES have the right to free speech. But the fact is… making death threats and attempting to destroy people’s careers & livelihoods does not fall into EITHER of those categories. And when the Travis Taliban (via Facebook) actively assists and encourages such activity against trial witnesses, well, it’s just turns it all into a farce.
The tweets and other social media posts began appearing by the next week. “You can show your disgust with LaViolette,” they began, and they posted her office phone number and her website, and they suggested that people write negative reviews of her bestselling book on Amazon.com.
As of Tuesday, there were more than 500 of them, panning the book and calling LaViolette a fraud and a disgrace.
People also were calling the organizations that had booked her for speaking engagements, trying to persuade them to fire her. Legal observers are not certain if it constitutes witness tampering, slander, or just an expression of free speech.
“It’s the electronic version of a lynch mob,” said retired Maricopa County Superior Court Judge Kenneth Fields. But it is probably a taste of a future to come.
Sree Sreenivasan, chief digital officer and professor of journalism at Columbia University, said he had never seen anything like the attack on LaViolette.
“This is a logical extension of witness intimidation, taken to an extreme conclusion,” he said. But he believes we will see it again. “I imagine this is going to be standard operating procedure in prominent cases,” he said.
And here’s further proof of the media’s attempts to stir up the haters.
To class it as Alyce LaViolette “feeling the social media’s heat” is a gross understatement if you ask me. “Cyber-bullying by the digital lynch mob” would be a far better description.
And with that sort of behavior currently rampant and increasing in ferocity, I just hope none of the haters have any kids or pets. If they do, then we can only guess at the respective state they’d be in. Jeez.
In fact… and I’m just putting this out there for general discussion… there should really be a concerted effort to strictly prohibit any of the haters from reproducing. The offer of a free Xbox should easily tempt them. Not only will it be doing society in general a huge favor, but it’ll also lighten the future welfare burden for the country to boot… rid the world of their potential garbage… and overall make the world a safer place — but I digress…
Moving forwards, and with the trial running for at least another few weeks, be sure to post below to let everyone know how YOU are planning to celebrate on Verdict day.
You see, we are in a NO LOSE position here. Seriously. The M1/DP verdict (as craved by the Taliban retards) has never realistically been on the table from the get go – so we can forget that BS. That ultimately means that WE will be the only ones celebrating – hence my question.
We’ll have to wait and see how the finer points of Bobble-head Judge Pickles final instructions to the jury play out… but IF — (and it’s a really big if) — the jury are not instructed on m2 or manslaughter, then Jodi will be acquitted – just like Casey.
If that turns out not to be the case, then that’s cool too. Why? Because Team Jodi have a truly outstanding chance of blitzing an alternate verdict via the Appellate courts… aided to a massive degree by the countless mistrial motions duly filed in lieu of Martinez’ & Co’s ongoing & very far reaching acts of well documented prosecutorial misconduct, deception & stupidity.

Alyce LaViolette had enough of prosecutor Juan Martinez snide remarks and finally told him he should "take a time" during hearings in Jodi Arias trial on Tuesday.
The comment sent the gaggle of hate-mongers at HLN into a rage. HLN has been doing everything they can to insure Jodi Arias is sent to her death for killing Travis Alexander.
HLN is no more a news organization than Fox News is a news organization. Both are as subtle as a train wreck with their bias.

HLN's Dr. Drew had a member of the Mormon Church on his program to talk about what he told JODI ARIAS about the "law of chastity" in the Mormon religion, but typical of Dr. Drew and HLN the same Mormon elder is never questioned about what TRAVIS ALEXANDER, also an elder in the Mormon faith, knew about the "law of chastity" and this would have been before TRAVIS ALEXANDER was murdered.
HLN and their hosts like Dr. Drew continue to mislead their audience by failing to accurately report the whole story in their rush to judgement and desire to see Jodi Arias put to death.
HLN has become the legal equivalent of FOX NEWS who have a reputation for twisting facts and not telling the whole truth, or twisting facts to fit their own agenda.

There has been a lot speculation as to why one of the jurors in the Jodi Arias trial was dismissed.
We do know that the Travis Alexander family members were in tears when Juror #5 was booted, and Jodi Arias and her two attorneys were all smiles.
This is an exclusive video of juror #5 interviewed outside her home. Apparently the dismissal had something to do with a tweet on Twitter.

The Jodi Arias trial ended the week on a bizarre note as the prosecution went into a lenghty and sometimes incoherrent story about "Snow White" which left spectators in the gallery laughing out loud.
Also, the press went into ambush mode in an attempt to corner a juror who had been dismissed from the jury and yet ended up seated in the court during Thursday's trial.

I could hardly wait to see how HLN would spin the Snow White analogy, and they didn't fail, especially "our favorite" Nancy Grace.
SHE IS SO DUMB.
They spent an hour today reading from texts Travis Alexander had sent to Jodi calling her everything from a 3-hole wonder to somebody who could give lessons on how to give a BJ.
Then Grace says the words were Jodi's words and apparently doesn't even know they were reading in court from text messages sent by Alexander. You could see on the screen they were text messages and not something Jodi made up.
Then Grace made a joke of Alexander having sex with every girl he met. Again these were from text messages from the women Alexander had sex with. Grace made a joke of it and said he was 30 years old and what would you expect him to be doing. What about all that Mormon chastity BS that we have heard so much about? Again, Grace totally overlooks that aspect and makes a joke out of a 30 year old guy having sex. Her exact words were; "Hello, what else is new? A 30 year old "handsome" single guy having sex with every girl he met." She ended her rant by saying; "I'm shocked. Shocked, shocked." Nancy Grace totally misses the point that he is telling everyone he is a virgin because he is a Mormon.

HAS JUDGE SHERRY K. STEPHENS, presiding Judge in the JODI ARIAS murder trial, lost control of the trial? Kirk Nurmi, JODI ARIAS attorney, told Judge Stephens that he saw an HLN cameraman taking pictures of the jury as the filed into court. Juror #5, who was booted off the jury, is back in the court today and watching the trial.
Jodi Arias wants a new trial because she says juror misconduct has made her current trial unconstitutional. Arias is on trial for killing her ex-boyfriend Travis Alexander on June 4, 2008. Arias’ attorneys base their motion for a mistrial on information about Juror 5’s behavior that was discovered in a sealed hearing last Thursday.
“Ms. Arias takes the position that the statements Juror 5 made in front of her fellow jurors amounts to misconduct,” Arias attorneys wrote. “Given the evidence that came forward on March 28, 2013, it is beyond legitimate dispute that Juror 5 is not fair and impartial making her unfit to continue as a juror.”
Juror 5 is a married, white female in her 30s. Court observers have said she is the most visible juror from the gallery because she has a “unique hair style.”
Judge Sherry Stephens held the sealed hearing last Thursday to discuss with the jurors whether any of them had witnessed prosecutor Juan Martinez posing for pictures with fans outside the courthouse.
Arias’ attorneys want Juror 5 kicked off the jury if the judge doesn’t grant a mistrial. Removing Juror 5 may be a remedy, because there are 18 jurors right now. Judge Sherry Stephens, who is presiding over the Jodi Arias murder trial, must decide if a reporter who approached a juror violated court rules. Most observers feel the reporter was from HLN which has been pulling out all the stops to see to it Arias is found guilty and sentenced to death.
