Uganda's new laws: Anti-gay and FGM

What is happening in Uganda this week? Lots of news-making legislation apparently. The big news all week has been the Parliament's consideration of an anti-homosexuality law that up until Wednesday would have made "aggravated homosexuality" a capital offense. Now before we cheer the Ugandan Parliament for removing the threat of death from the bill, let's consider that Uganda is still talking about making being gay illegal. Controversy has swirled through headlines throughout the week and then today Uganda was back in the news: banning female genital mutilation (or female circumcision).

Let's go back to the anti-gay bill first. It's been big news here in the States because many see connections to conservative Christians here who have allied themselves with Uganda. Evangelical pastor Rick Warren has been a strong supporter of the Uganda, calling it a "purpose-driven nation". The country's lawmakers seem to be inspired by the efforts of US Christians who believe that homosexuality can be cured and gays can become "ex-gays".

Warren this week finally distanced himself from the anti-gay bill, condemning it in a statement Thursday. But despite Warren's rejection of it and the reported removal of the death penalty, human rights activists still fear Uganda will pass the bill soon. So the timing is strange then that gender rights activists now have something to celebrate in the passage of the bill banning female genital mutilation (FGM). An effort to try to distract the international human rights community with some good news to mask all this week's bad press? Whatever their reasons - the ban is welcomed. This video will give you a sense of the struggle against FGM in Africa.

Obama remembers the gays

In a year that the fight against same-sex marriage has made gay rights activists seem more and more embattled, America has a new Democratic President with a Democratic majority in the House and Senate. Yet some in the gay community have felt a little left-out as Obama has seemingly tackled every single other issue but gay rights. But maybe that's about to change?

On the eve of the National Equality March expected to draw thousands to the nation's capital this weekend, President Obama is scheduled to deliver the keynote speech at the biggest black-tie, seen-and-be-seen dinner of the Human Rights Campaign, the country's largest gay organization.
Congress to extend hate crime law to cover gays posted by current89:
Assaulting people because of their sexual orientation would become a U.S. hate crime in legislation the House is set to vote on Thursday. The bill would significantly expand the hate crimes law enacted in the days after the assassination of civil rights leader Martin Luther King Jr. in 1968. With the expected House passage and eventual approval by the Senate, federal prosecutors will for the first time be able to intervene in cases of violence perpetrated against gays based on their sexual orientation.
Obama to name openly gay ambassador also posted by current89:
President Barack Obama plans to nominate an openly gay lawyer as the United States' ambassador to New Zealand and Samoa, an administration official said Wednesday.

David Huebner was the lawyer who would be announced for the post, said an official who would speak only on condition of anonymity ahead of an announcement.

If confirmed by the Senate, Huebner would the administration's first openly gay ambassador. Presidents Bill Clinton and George W. Bush both had openly gay ambassadors during their terms.

The Damage of Don’t Ask, Don’t Tell

Sixteen years after passage of the “don’t ask, don’t tell” law, there is reason to hope that the military is edging away from its destructive opposition to allowing gay men and lesbians to serve openly. At the very least, a prize-winning essay in a prominent military journal suggests that the issue is open to debate and even dissent.

The essay, which won this year’s Secretary of Defense essay contest and was reviewed in advance of publication by the office of Adm. Mike Mullen, the chairman of the Joint Chiefs of Staff, was published in Joint Force Quarterly. It was written by an Air Force colonel who researched the impact of “don’t ask, don’t tell.” The law was enacted in 1993 after President Bill Clinton tried to lift an existing policy against homosexuals serving in the military and met strong resistance from military and Congressional leaders.

By cementing homophobic military policy into law, Congress made a bad situation worse. It reached a so-called compromise by which homosexuals could serve — but only if they did not acknowledge their orientation or act on it. If they did, they could be discharged. About 12,500 service members have been forced out, including many with distinguished records or invaluable language and intelligence skills.

The author of the essay, Col. Om Prakash, effectively demolishes the primary, wrongheaded rationale for the law: that unit cohesion would be harmed if homosexuals served openly. Several other countries, including Australia, Canada, Israel and Britain, have lifted bans on homosexuals serving openly with no adverse effects on military performance or readiness.

Colonel Prakash argues that the law has undermined unit cohesion, in part by compromising the integrity of homosexuals who have to dissemble and by posing a moral quandary for commanders — look the other way or risk discharging a valuable service member. He judged the policy a “costly failure” because of the lost manpower and the administrative costs of recruiting and separating homosexuals. He urged the Obama administration to examine how to repeal the ban.

We agree strongly with Colonel Prakash, and urge the Pentagon to press ahead with changes in its regulations to make implementing the “don’t ask” law more humane. Ultimately, Congress must repeal the 1993 statute. We are not confident that the Senate has enough enlightened members to overcome a filibuster. But if the military can show an open mind, surely lawmakers can summon the courage to end this sad chapter in history.Sixteen years after passage of the “don’t ask, don’t tell”... more
