State Attorney Bill Cervone released a partial judgment Friday stating the University Police officers who shot a Ghanaian graduate student in his on-campus apartment will not face any illegal action.
Cervone based his judgment on the completed Florida Department of Law Enforcement internal investigation.
The judgment gives UF the ability to complete its own internal affairs investigation, which is being independently reviewed by Margolis Healy & Associates, a campus safety organization, according to a statement released Friday by university spokeswoman Janine Sikes.
Cervone has yet to announce judgment on the student, 35-year-old Kofi Adu-Brempong, who currently faces charges of one count of second-degree aggravated assault and one count of third-degree resisting arrest with violence.
In his statement, Cervone acknowledged UPD's right to enter the residence, as the officers had a legitimate reason to believe Adu-Brempong might have hurt himself inside.
"Had that action not been taken and had he or others come to harm because of inaction," he said, "...an equal or stronger issue as to the propriety of police inaction would doubtless have been raised."
Cervone added that it is not his place to review crisis procedure, just the legality of the action. He said questions of policy were best left to community discussion.
He also found no reason to charge the officers for their use of force, citing that "No one else, civilian or otherwise, was in a position to hear anything directly relevant to those events other than Adu-Brempong," adding that the student's credibility was tarnished by his apparent unstable mental health.
Under Florida law, anyone has the right to use deadly force against someone who appears threatening. Cervone reasoned the police reports were concurrent with that law.
Cervone ended his statement with a call to put the issue to rest.
"I would like to assure those who are concerned about the time required for this process to be completed," he said, "that all involved, including Adu-Brempong's defense team, have been in frequent and productive contact."
Cervone said more information will be released as his decisions are reached. In the mean time, he said, community interaction should be continued within the proper public forum.

The University of Florida is bringing Johann Sebastian Bach back to life with the help of its College of Fine Arts.
Bach will respond to audience questions and appear in a live video webcast Oct. 29 with the help of computer animation seen in such films as “The Incredibles,” “Toy Story” and “Shrek.” A UF faculty expert off-stage will answer questions as voice signals create amplitudes that are tracked by the motion of the 3D-character’s mouth, which responds to variations in the amplitude.
The Bach interview will be part of “LiveVibeTV,” a 60-minute production being presented by two of the college’s programs, the Digital Worlds Institute and the School of Music. The Bach re-animation is an original program created by Digital Worlds Artist in Residence Arturo Sinclair and student programmer Anton Yudin. Similar technology has been used as the foundation of the computer gaming industry, as well as Hollywood blockbuster computer animation movies such as those produced by Pixar Animation Studios and DreamWorks Animation SKG. The show is also produced specifically for Internet broadcast with television-like segments.
“This is far beyond a concert with a webcam,” said College of Fine Arts spokesman Andy Howard.

No one expects a zombie apocalypse. But the University of Florida is making sure officials are ready for a night of the living dead, just in case.
The school has a plan for responding to the undead on its Web site among outlines for dealing with hurricanes and pandemics.
The exercise lays out how university officials would respond to attacks by "flesh-eating, apparently life impaired individuals." It notes that a zombie outbreak might include "documentation of lots of strange moaning."

Men who grow up thinking women should stay at home may be labelled "old-fashioned" - but could end up well ahead in the salary stakes.
A US study, published in the Journal of Applied Psychology, suggests that they will consistently out-earn more "modern-thinking" men.
On average, this meant an extra $8,500 (£4,722) a year.
One UK psychologist said men inclined to wield power in their relationships might also do this at work.
The study, carried out by researchers at the University of Florida, was conducted on a large scale, with 12,686 men and women interviewed in 1979, when they were aged between 14 and 22, and three times in the following two decades, the last time in 2005.
The researchers asked them whether they believed a woman's place was in the home, or whether the employment of women was likely to lead to higher rates of juvenile delinquency.
Predictably, more men tended to hold these views than women, although the gap has narrowed significantly over time.
However, when the men were asked about their salaries, another gap emerged, with those holding "traditional" views earning significantly more.
Conversely, women who held the opposite view did earn slightly more, on average $1,500 (£833) more than women with "traditional" views.
Dr Timothy Judge, one of the researchers, said: "More traditional people may be seeking to preserve the historical separation of work and domestic roles - our results prove that is, in fact, the case."
