Justice Department Pushes Warrantless GPS Surveillance | PCWorld

Analysis: A Supreme Court case is considering whether cops need a warrant before attaching a GPS device to a suspect's vehicle to covertly track its movement.

In a court of law, the word "reasonable" is all important, what a reasonable person would do, or feel, or expect, or how a reasonable person would react to a situation. If it's not reasonable, then expect to lose. Is it reasonable to expect law enforcement, with no warrant, to shoot a GPS tracking dart at your vehicle to better monitor your movements?

The Obama administration has asked the Supreme Court to resolve a conflict among federal appellate courts over the need for a warrant before attaching a GPS device to a suspect's vehicle to covertly track a person. In fact, the Justice Department said that a person traveling on public roads has "no reasonable expectation of privacy" in his movements, even if 'scientific enhancements' are used to help law enforcement with the tracking.

Last year, the U.S. Court of Appeals for the D.C. Circuit reversed the conviction of a drug dealer, Antoine Jones, since the government had violated Jones' privacy by covertly tracking his movements by GPS, and then using that data for search warrants of those locations to find drugs. The Justice Department said that the government surveillance by GPS in the Jones' case "raises no concerns about mass, suspicionless GPS monitoring."

Also in the 121-page DOJ petition (PDF), one of the arguments the Justice Department used was cost, as in the cost to install a GPS device being insignificant because "the Los Angeles Police Department can now affix a GPS device to a passing car simply by launching a GPS-enabled dart." The sources of this information included this statement, "The darts consist of a miniaturized GPS receiver, radio transmitter, and battery embedded in a sticky compound material. When fired at a vehicle, the compound adheres to the target, and thereafter permits remote real- time tracking of the target from police headquarters."

Let's hold it right there, on those two different thoughts of raising no concerns about suspicionless GPS tracking and the ability for authorities to "just tag the suspect vehicle, then fall back and wait." In 2006, the LAPD got excited about GPS-enabled darts by StarChase. In a 2010 article, StarChase claimed that law enforcement using their product could target the adjustable laser dot from the aimer, launch the dart to the suspect vehicle, and immediately get GPS data. Furthermore, quoting the Arizona Highway Patrol, "The crooks haven't been aware they've been tagged. Even if they do discover it, it takes some real effort to remove the projectile."

If people can be tagged with a GPS-enabled dart in about a blink, and have no idea their movements on public streets are being tracked, then it seems reasonable that the warrantless surveillance violates the Fourth Amendment. Infectious diseases remain major causes of illnesses and fatalities worldwide. Although many are known, new infections are increasingly entering the human population often spreading from geographically isolated areas due in part to ecological changes, a globally driven market for goods and services, and air travel. These emerging threats to human health include, but are not limited to, HIV/AIDS, SARS (Severe Acute Respiratory Syndrome), Nipah, and pandemic influenza.

In this interview Dr. Morse emphasizes that it is essential to have early warning and surveillance systems in place if we wish to prevent existing infectious diseases from increasing their range and to avoid the next pandemic. As many emerging infections, or their close relatives, already exist in other species, the "One Health" approach is invaluable in helping to identify and track these pathogens in nature, and to target surveillance efforts.

Also discussed in this interview is the U.S. Agency for International Development's (USAID) "Emerging Pandemic Threats" (EPT) program (.pdf of program overview), which includes PREDICT, a project to build global capacity for surveillance and prediction of novel infections that have pandemic potential. EPT/PREDICT uses the "One Health" approach to target and integrate surveillance in wildlife, livestock, and humans, and develop a framework for risk assessment. Where the money is: Private Investors Acquire SRA International for $1.9 Billion

Just two months after announcing it had retained investment bankers to consider a possible sale to another firm, SRA International Inc. said it is being acquired in an all-cash deal worth nearly $1.9 billion.

SRA counts the Pentagon and Department of Homeland Security as major clients and itself has a history of growth through strategic acquisitions that in recent years have increased its business for cyber security and air-traffic control.

Providence Equity Partners, a private investment group, said that after the purchase it intends to retain SRA’s senior managers and the company’s headquarters in Fairfax, Va. Analysts said they also expect the sale to generate few layoffs among SRA’s roughly 7,300 employees.

They noted the SRA deal occurs at a time of increasing merger and acquisition activity among federal contractors, particularly information technology (IT) providers. However, the structure of this deal is much different, observers said.

Indeed, in contrast to an industry consolidation, SRA did not sell to another federal contractor looking to enter new markets while cutting overhead for employees and research activities.
In acquiring SRA, the investment firm will receive enormous cash flow, analysts said. SRA recently reported it has a $5.0 billion pipeline of orders, including more than $1 billion in funded contracts.

For instance, SRA won a Global Battlestaff and Program Support contract in May 2010 from the United States Special Operations Command at MacDill Air Force Base, Fla. The award is worth an estimated $1.5 billion over five years if all options are exercised.

The following month, the company became one of six major IT players to land a portion of a Defense Intelligence Agency multi-award contract with a total value of $6.6 billion.

Founded in 1978, SRA has a market cap valued at about $1.78 billion and has grown aggressively in recent years through acquisitions, making three in 2010 alone. Besides the Pentagon and Homeland Security, the firm also serves the intelligence communities with a wide range of offerings, including cyber security.

Meanwhile, SRA has in recent years moved aggressively into air traffic safety, a market analysts say is worth several billion dollars. That’s because the Federal Aviation Administration is replacing radar technology that dates to World War II with an advanced digital system.

In July 2008, the company paid $125.5 million to acquire Era Systems Corporation. Little known until recently, the Era subsidiary features sophisticated, proprietary surveillance technology originally developed in Czechoslovakia.

As a result, the company has landed contracts at nearly two dozen airports in the U.S., several of them among the nation’s busiest. These include Boston Logan, Houston, JFK and La Guardia in New York and Las Vegas
