Drug Makers to Pay Fine of $81 Million - Illegal marketing of antipsychotic drug

WASHINGTON (AP) — The Justice Department announced Thursday that two subsidiaries of the pharmaceutical giant Johnson & Johnson had agreed to pay more than $81 million in a case accusing them of illegally promoting the epilepsy drug Topamax for psychiatric uses.

Federal drug regulators approved Topamax for epilepsy and for preventing migraine headaches.

It was the second settlement this week involving a pharmaceutical manufacturer accused of misconduct involving promotion of unapproved uses for a drug.

On Tuesday, Attorney General Eric H. Holder Jr. and Kathleen Sebelius, the secretary of health and human services, announced a $520 million settlement with AstraZeneca, resolving allegations of illegal marketing of the company’s antipsychotic drug Seroquel.

In the case involving Topamax, the government says Johnson & Johnson’s Ortho-McNeil-Janssen Pharmaceuticals unit will pay more than $75 million. That unit’s subsidiary, Ortho-McNeil Pharmaceutical, has agreed to plead guilty to one misdemeanor violation of the Food, Drug and Cosmetic Act and to pay a $6.1 million criminal fine.

The government says that Ortho-McNeil Pharmaceutical promoted Topamax sales for unapproved psychiatric uses under a program called Doctor-for-a-Day. The program hired outside physicians who joined sales representatives in visits to health care providers and to speak at meetings and dinners about prescribing Topamax for unapproved uses.

Topamax had been a blockbuster for Johnson & Johnson, with sales topping $2 billion a year by 2006 and peaking at $2.7 billion in 2008. Topamax was approved for preventing migraine headaches about five years ago. The drug got generic competition in March 2009, and sales for the year plunged to $148 million.

Ortho-McNeil-Janssen said it had cooperated with the government since its inquiry began in 2003.

The settlement resolves two lawsuits brought under the False Claims Act. More than $9 million of it will go to the private citizens who brought the suits.

A West Hollywood psychiatrist charged with running a "pill mill" in which thousands of prescriptions for addictive drugs were allegedly written in exchange for cash is expected to ask a federal judge in Los Angeles today to consider releasing him on bail.

Dr. Nathan Kuemmerle, 37, of Hollywood, was arrested April 13 at his home by Drug Enforcement Administration agents and Redondo Beach police, according to Thom Mrozek of the U.S. Attorney's Office.

Kuemmerle's office manager, Antonie "Tony" Phillips, 28, of Koreatown, was arrested the same day at the doctor's clinic on Santa Monica Boulevard, Mrozek said.

Both men were charged in a criminal complaint filed April 9 in U.S. District Court that accuses them of conspiracy to distribute controlled substances -- a charge that carries a penalty of up to 20 years in federal prison, according to the U.S. Attorney's Office.

A federal magistrate last Wednesday ordered Kuemmerle detained pending arraignment May 3, according to Mrozek. A hearing is set today before U.S. District Judge Stephen V. Wilson in which Kuemmerle is expected to ask to have the detention order reconsidered.
Phillips was released last week on a $50,000 bond, with arraignment set for May 10, Mrozek said.

The investigation into Kuemmerle began last August, when Redondo Beach police arrested an individual who allegedly offered Adderall for sale on the Craigslist Web site, Mrozek said.

That person fingered Kuemmerle as the alleged source of the Adderall, claiming the psychiatrist wrote prescriptions on numerous occasions without any medical examination, and that he would write prescriptions for various names during a single visit, according to Mrozek.

After analyzing Kuemmerle's prescribing history and reviewing secret tapes made at the clinic, San Diego-based psychiatrist Dr. Steven Ornish concluded that "there is overwhelming evidence that Dr. Kuemmerle is running a quintessential `pill mill,"' according to an affidavit filed in support of the criminal complaint, Mrozek said.

The affidavit in which Ornish's report is summarized states that during 2009 Kuemmerle wrote more prescriptions for the largest available dosage of amphetamine salts -- the generic name for Adderall -- than any other doctor in California, and that he wrote 3 1/2 times more amphetamine salts prescriptions than the No. 2 two prescriber of the drug.

According to the affidavit, an analysis of records from 2006 through November 2009 showed that Kuemmerle was the state's second-largest prescriber of all Schedule II drugs, which include the highly addictive substances amphetamine salts (Adderall), oxycodone (OxyContin), hydrocodone (Vicodin and Norco) and alprazolam (Xanax).

On March 31, 2010, the SEIU filed their LM-2 forms required by Federal law. In the quest to provide transparency of what the SEIU is doing, some startling revelations have been made since the documents have come to light.

Specifically, recent information disclosed in the LM-2 forms filed begs to question about the President of that organization’s status as a lobbyist. Is Andy Stern a lobbyist, and if not, what is he then?

According to the dictionary of Merriam-Webster, a lobbyist is a person that conducts “activities aimed at influencing public officials and especially members of a legislative body on legislation.” One would argue that Andy Stern, who has been the most frequent visitor of the White House, is indeed acting as a lobbyist does.

Of course, more important is how lobbying is defined by the Lobbying Disclosure Act:

“The term ‘lobbyist’ means any individual who is employed or retained by a client for financial or other compensation for services that include more than one lobbying contact, other than an individual whose lobbying activities constitute less than 20 percent of the time engaged in the services provided by such individual to that client over a six month period.”

In its 2009 LM-2 filing, the SEIU claims outright that Andy Stern has spent 32 percent of his time performing political and lobbying activities. As cited above by the Lobbying Disclosure Act, a lobbyist must file if they spend 20 percent of their time lobbying. Clearly Andy Stern does. But, he has failed to file.

Which gave Americans for Worker Freedom and Americans for Tax Reform reason to call Stern out last week. They have formally requested that U.S. Attorney Channing Phillips investigate Stern for “potentially illegal lobbying activities” last November.

Cleta Mitchell, a leading election and financial disclosure requirement law expert and author of the Lobbying Compliance Handbook, had this to say about Andy Stern’s lack of filing as a lobbyist, “On face value, it appears that Andy Stern is in violation of the Federal Lobbying, Registration and Disclosure requirements.”

It’s possible that whomever prepared the LM-2 made an error. But, it is far more likely that Stern failed to file the proper paperwork to lobby in Washington, D.C. The truth must be known.

As Barack Obama promised in 2008: “I don’t take a dime of their [lobbyist] money, and when I am president, they won't find a job in my White House.” But in 2010, Stern finds himself the recipient of an appointment to serve on Obama’s Debt commission.

Hopefully, when we get to the bottom of this matter, justice will be provided. Either way, someone is in trouble. It will either come down that the LM-2 was improperly filed or that Stern failed to file his lobbyist registration paperwork. If the latter is the case, we can only hope that justice will be provided as effectively as it was against Jack Abramoff.
