Accused child rapist wants deportation

ALBUQUERQUE, NM (KRQE) - Three small children said he raped them, but that man may never face charges for any of it. News 13 has learned the illegal immigrant may be incompetent to stand trial. Juan Gonzalez’s lawyer said his client should get a get out of jail free card, so he can go live in Mexico.

Gonzalez was 13 when he told investigators he raped a little boy and a little girl. Then last year the 20-year-old admitted to raping another child inside a popular Albuquerque gym. A terrified 6-year-old girl attacked inside the playroom at the Midtown Sports and Wellness.

“He held hand over his mouth so she couldn't scream,” Albuquerque Police Deputy Chief Beth Paiz said in May when Gonzalez was arrested. ”He could hear the child say stop, stop, stop.”

Gonzalez's criminal case for rape is at a standstill.

“The issue of competency was raised so that basically stops the case,” District Attorney Kari Brandenburg said.

Gonzalez is being sent to Las Vegas, to the state's mental hospital for criminals.

“If he can't be treated to competency he can't stand trial, that would be unconstitutional,” said Brandenburg.

Gonzalez's attorney wouldn't speak on camera but said he's pushing for Gonzalez to be deported with the promise he won't come back. His attorney said his family wants to take him back to Mexico.

The D.A.'s office says releasing Gonzalez could put more children at risk.

“That's not a solution, shipping him back to Mexico, losing track of him and then having him cross the border at some unknown time,” said Brandenburg.

Gonzalez never stood trial for the previous rape cases as a juvenile because he was deemed incompetent and released to his parents. The D.A.'s office said if Gonzalez isn't competent, it will push for the court to criminally commit him. That would mean he'd stay in the mental facility in Las Vegas for the same amount of time he would have served if he were convicted of the rape charge. That could be up to 18 years.

Idaho Rejects Rape Exception In Abortion Bill Because "The Hand Of The Almighty’ Was At Work"

Marching in step with the GOP’s nationwide war on a woman’s right to choose, the Idaho legislature gave final approval to a bill that would outlaw abortions after 20 weeks. Modeled after Nebraska’s first-in-the-nation measure, the bill — like the one passed in Kansas last week — is based on highly disputed medical research alleging that a fetus can feel pain at 20 weeks. Idaho’s bill, however, also fails to include exceptions for rape, incest, severe fetal abnormality or the mental or psychological health of the mother. “Only when the pregnancy threatens the mother’s life or physical health could a post-20-week abortion be performed.”

In 1990, Idaho’s anti-abortion Gov. Cecil Andrus (D) vetoed a similar bill expressly because it failed to provide a rape or incest exception. “The bill is drawn so narrowly that it would punitively and without compassion further harm an Idaho woman who may find herself in the horrible, unthinkable position of confronting a pregnancy that resulted from rape or incest,” he said.

But this year during Sexual Assault Awareness Month, state Republican lawmakers found plenty of reasons to advocate for it. State Rep. Shannon McMillan (R) argued that women who were impregnated under “violent circumstances” should have no choice because it’s not the fetus’s fault. State Rep. Brent Crane, the bill’s sponsor, took it a step further. Believing that “tragic, horrific” acts of rape or incest are the “hand of the Almighty,” Crane said women should trust God to turn the consequences of their sexual assault into “wonderful examples”:

“Is not the child of that rape or incest also a victim?” asked Rep. Shannon McMillan, R-Silverton. “It didn’t ask to be here. It was here under violent circumstances perhaps, but that was through no fault of its own.”[...]

The Idaho bill’s House sponsor, state Rep. Brent Crane, R-Nampa, told legislators that the “hand of the Almighty” was at work. “His ways are higher than our ways,” Crane said. “He has the ability to take difficult, tragic, horrific circumstances and then turn them into wonderful examples.”

Crane’s belief that good can come from such horrific circumstances may be one shared or embraced by a sexual assault victim. However, that interpretation, that belief, that choice should be made by the woman — not forced upon her by law. The right to choose is not about the “innocence” or “guilt” of the fetus – or of the woman for that matter. It is about a woman being able to decide whether she is willing and able to carry a pregnancy to term.

The bill does more than compel sexual assault victims to carry pregnancies to term, it makes it a felony to perform such an abortion and allows spouses and relatives to file legal injunctions against physicians who break the ban. The bill also sets up a fund that can accept donations to defend the bill — a needed provision since the Idaho attorney general has issued two legal opinions declaring the bill unconstitutional for violating the Roe v. Wade decision’s viability standard.

Despite the lack of constitutionality or compassion, the bill passed 54 to 14 with only one Republican joining all 13 Democrats in opposition. The bill now heads to Gov. Butch Otter (R) “who is expected to sign it.”

VIDEO: Indiana GOP Rep Says Women Will Pretend To Be Raped To Get Free Abortions

Yesterday morning, the Indiana House considered an anti-abortion bill that “would put some of the tightest abortion restrictions in the nation into Indiana law.” Introduced by state Rep. Eric Turner (R), HB 1210 would make most abortions illegal after 20 weeks. Current law restricts abortions after the fetus is viable, generally around 24 weeks.

In an attempt to soften the blow this bill would land on Hoosier women, state Rep. Gail Riecken (D) introduced an amendment to exempt “women who became pregnant due to rape or incest, or women for whom pregnancy threatens their life or could cause serious and irreversible physical harm” from being forced to carry to term. Fearing this bill would “push women to the back alleys” for illegal abortions, Riecken pleaded with lawmakers to allow women to make the choice in these cases.

Turner then stepped to the podium and insisted that Riecken’s amendment would create a “giant loophole” for women. That loophole? Women “could simply say they’ve been raped”:

TURNER: With all do respect to Rep. Riecken, I understand what she’s trying to do. But as you know that when the federal health care bill was going through Congress there was a lot of discussion whether this would allow for abortion coverage and of course we were all told it would not. And the bill, my house bill 1210, would prevent that for any insurance company to provide abortion coverage under federal health care bill. This [amendment] would open that window and I would ask you to oppose this amendment.

I just want you to think about this, in my view, giant loophole that could be created where someone who could — now i want to be careful, I don’t want to disparage in any way someone who has gone through the experience of a rape or incest — but someone who is desirous of an abortion could simply say that they’ve been raped or there’s incest.

Outraged by Turner’s allegation, state Rep. Linda Lawson (D) — who spent six years as a sex crimes investigator for the Indiana police — delivered an emotional rebuke. Describing her experience with both elderly and young children who had been raped, she forcefully informed Turner that “they don’t make it up.” “Women don’t make this up! My Goodness!” she exclaimed. “This is the state of Indiana!”

The House voted down Riecken’s amendment 42 to 54. The bill “now is eligible for a final vote in the House later this week. It then would move to the Senate, which earlier passed similar legislation aimed at abortion.”

Libyan Woman Claiming Rape by Gadhafi's Soldiers, Is Dragged Away (AP)

TRIPOLI, Libya (AP) — A distraught Libyan woman stormed into a Tripoli hotel Saturday to tell foreign reporters that government troops raped her, setting off a brawl when hotel staff and government minders tried to detained her.
Iman al-Obeidi was tackled by waitresses and government minders as she sat telling her story to journalists after she rushed into the restaurant at the Rixos hotel where a number of foreign journalists were eating breakfast.
She claimed loudly that troops had detained her a checkpoint, tied her up, abused her, then led her away to be gang raped.
Her story could not be independently verified, but the dramatic scene provided a rare firsthand glimpse of the brutal crackdown on public dissent by Moammar Gadhafi's regime as the Libyan leader fights a rebellion against his rule that began last month.
The regime has been keeping up a drumbeat of propaganda in the Tripoli-centered west of the country under its control even as it faces a weeklong international air campaign against the Libyan military.
At a hastily arranged press conference after the incident, government spokesman Moussa Ibrahim said investigators had told him the woman was drunk and possibly mentally challenged.
Before she was dragged out of the hotel, al-Obeidi managed to tell journalists that she was detained by a number of troops at a Tripoli checkpoint on Wednesday. She said they were drinking whiskey and handcuffed her. She said 15 men later raped her.
"They tied me up ... they even defecated and urinated on me," she said, her face streaming with tears. "The Gadhafi militiamen violated my honor."
The woman, who appeared in her 30's, wore a black robe and a floral scarf around her neck and identified herself. She had scratches on her face and she pulled up her black robe to reveal a bloodied thigh. She said neighbors in the area where she was detained helped her escape.
The Associated Press only identifies rape victims who volunteer their names.
As al-Obeidi spoke, a hotel waitress brandished a butter knife, a government minder reached for his handgun and another waitress pulled a jacket tightly over her head.
Al-Obeidi said she was targeted by the troops because she's from the eastern city of Benghazi, a rebel stronghold.
The waiters called her a traitor and told her to shut up. She retorted: "Easterners — we're all Libyan brothers, we are supposed to be treated the same, but this is what the Gadhafi militiamen did to me, they violated my honor."
It soon turned into a scene of chaos with journalists attempting to protect the woman from government minders who physically attacked and intimidated her.
Journalists who tried to intervene were pushed out of the way by the minders. A British television reporter was punched, and CNN's camera was smashed on the ground and ripped to pieces by the government minders.
Eventually the minders overpowered the woman and led her outside, shoving her into a car that sped away. Al-Obeidi kept crying that she was certain she would be thrown in jail. She begged photographers to take her picture, raising her robe to show them her bruised body. A minder tried to cover her mouth with his hand to keep her from talking.
"Look at what happens — Gadhafi's militiamen kidnap women at gunpoint, and rape them ... they rape them," al-Obeidi screamed.
She said she wanted to be taken to see the leader himself.
"I want to see Moammar Gadhafi. Didn't he say that every victim will have justice? I want my rights," she said.
The government spokesman said the woman was under investigation.
"The investigators did phone me and told me the lady is drunk and that she seems to be suffering mentally," Ibrahim said. "They are checking on her health condition, her mental condition, whether she was really abused or if these were fantasies."
Gadhafi's crackdown has been the region's most violent against the wave of anti-government protests sweeping the Middle East. Tensions have been rising between foreign reporters in the Libyan capital and the government minders who have sought to tightly control what they see and whom they talk to. Most of the international press corps is being housed at the Rixos hotel.

Vice President Joe Biden Mentions Rape In Criticizing Republicans

Vice President Joe Biden, speaking at a fundraiser in Philadelphia Friday, compared Republicans in Congress to people who excuse rapists by blaming their victims.  

The vice president, known for speaking his mind and at times putting his foot in his mouth, said that Republicans who want to cut spending while at the same time cutting taxes for the wealthy are similar to rape apologists.

In setting up his comparison, the vice president explained to the audience that before the Violence Against Women Act that he championed was passed into law, “there was this attitude in our society of blaming the victim," according to a press pool account of the event.
  “When a woman got raped, blame her because she was wearing a skirt too short, she looked the wrong way or she wasn't home in time to make the dinner,” Biden said.

“We've gotten by that,” he said. “But it's amazing how these Republicans, the right wing of this party – whose philosophy threw us into this God-awful hole we’re in, gave us the tremendous deficit we’ve inherited – that they’re now using, now attempting to use, the very economic condition they have created to blame the victim – whether it’s organized labor or ordinary middle-class working men and women. It's bizarre. It's bizarre.”  

After Biden's appearance at the fundraiser, his office tried to focus on the economic message.

"The vice president was obviously making the point that on any issue, we shouldn't blame the victim," Biden spokeswoman Elizabeth Alexander said. "Blaming workers or union members for states' fiscal crises – an argument made by some Republican governors – isn't the answer."

President Obama has tapped Biden to be his lead negotiator with congressional Republicans on the budget.

Republicans quickly seized on Biden's comments with the party's House campaign arm calling them "tasteless and offensive."

"As much as Vice President Biden should retract this specific statement, he should apologize for comparing our country’s dismal economic situation to such horrid acts as violence against women,” said Joanna Burgos, spokeswoman for the National Republican Campaign Committee (NRCC).

The Democratic Congressional Campaign Committee (DCCC) raised about $400,000 from the fundraiser in Philadelphia. The DCCC raised more money than its Republican counterpart in February and January.

Parents upset that fourth-graders school showed film depicting rape and suicide.

Angry parents met with the school Board in the Winnetka District 36 Tuesday night, to discuss an inappropriate movie that was shown to their fourth-grade children.

The HBO film, The Middle Passage, was shown to the children by a substitute teacher upon direction of a full time teacher that was not present in the class that day, reports Winnetka-Talk. The graphic film comes with the following warning, "NOT RATED: Adult Content, Nudity, Violence."

The film depicts the life of slaves as they cross the Atlantic from Africa and includes images of nudity, rape and suicide. In one scene, slaves are thrown overboard so that the sharks could eat them.

One parent told Winnetka-Talk, "Now I have to explain rape to my child," said Anita Livaditis. "There are more conscionable ways to teach about slavery."

The movie was reportedly shown in two classrooms by two different subsittute teachers and was started in a third classroom and was stopped once the teacher realized how graphic the film was.

School officials immediately adopted a plan to help prevent incidents like the one that happened on February 16. Basically, any movie not rated G must be pre-approved by the school principal and a handful of teachers to determine whether it is appropriate to show to the children.

Another parent is upset that the movie showed men shackled while their wives and children were being raped on the deck below. "The concepts of rape, suicide and depression were introduced to my child, by a substitute teacher whom I have yet to meet, at the instruction of a tenured teacher who should know better," said parent Patrick Livney, parent ot one of the students.
