Says country is a perfect place to test out a blanket file-sharing tax scheme.
Music fans and record labels have long fought over the rights and wrongs of file-sharing, but now an island tax haven in the Irish Sea says it has come up with a way to keep the peace.
The Isle of Man's e-business adviser Ron Berry said Tuesday that the self-governing territory between England and Ireland is considering charging its residents, who all have broadband connections, about a euro (dollar) a month to legalize file-sharing for personal use. Although industry groups expressed skepticism, Berry said the plan was a way of replacing piracy with principle.
"Anybody can go on to the Internet and access anything," he said. "What we're trying to do is legalize it and monetize it. Why would you bother to pirate anything if you could do it with the blessing of the rights holders?"
Tim Craine, the Isle of Man's e-commerce minister, says the plan would be voluntary.
"There is an opt-out for people who don't want a compulsory charge. We would envisage an opt-out - there would be a public reaction against it," he explained. "But you have to compete with free."
"You have to create an entry level that tempts people off illegal downloads or this just isn't going to work. We've got to be aware of how we sell this, and what the public reaction is going to be. We've got to convince the public this is a positive move."
But securing the blessing of those rights-holders — major record labels, many of whom are still fighting file-sharers in court — could be difficult.
"A blanket file-sharing deal akin to a broadband tax imposed by government, as has been suggested, is not something we'd welcome — and is some way wide of the mark," the BPI — Britain's main record industry lobbying group — said in a statement Tuesday.
Berry argued that the Isle of Man, with a population of 78,000, was the ideal place for an experiment that could calm some of the industry's doubts.
The 221 square mile (572 square kilometer) territory is dependent on the British crown but is not technically part of the United Kingdom and has its own parliament. Its rock-bottom taxes have turned it into an important financial center, but the island also is trying to market itself as an e-commerce hub.
As to how the money would be distributed to rights-holders, Berry said that has yet to be negotiated with the record industry. But the experiment could go ahead even without a negotiated deal, Berry said, explaining that the money could be held in escrow.
The IFPI, which represents the record industry worldwide, said that in principle it supported deals to provide unlimited music through Internet service or cell phone providers.
The IFPI said that while "an experiment in a small territory such as the Isle of Man might be quite interesting from an academic point of view," it did not believe the model could be applied elsewhere.Says country is a perfect place to test out a blanket file-sharing tax scheme.... more

The UK's second largest ISP, Virgin Media, will next year begin network monitoring technology with the aim of specifically targeting and restricting BitTorrent traffic.
The move will represent a major policy shift for the cable monopoly and is likely to anger advocates of "net neutrality", who say all internet traffic should be treated equally. Virgin Media currently temporarily throttles the bandwidth of its heaviest downloaders across all applications at peak times, rather than targeting and "shaping" specific types of traffic.

Sure, the US government has been in favor of expanding access to free "broadband" service to the masses. But the current administration is opposed to mandates, and there's still enough time to make that opposition stick.
In an open letter to US Federal Communications Commission Chairman Kevin Martin yesterday, Commerce Secretary Carlos Gutierrez repeated the current administration's opposition to the idea of mandating that a portion of the Advanced Wireless Services AWS-3 spectrum being auctioned off next year, be exclusively set aside for businesses that wish to operate no-fee nationwide broadband services.
"This mandate would likely lead to congested and inefficiently used broadband, and it would be inconsistent with the Administration's view that spectrum should be allocated by markets rather than governments," the Secretary wrote. "The history of FCC spectrum auctions has shown that the potential for problems increases in instances where licensing is overly prescriptive or designed around unproven business models. In contrast, open and highly competitive auction processes have supported both greatly expanded broadband services and the taxpayers' interests in spectrum license allocation. Moreover, a government-mandated free nationwide network is not the most effective or efficient way to assist underserved areas."
One of those proponents was Michael Calabrese, the director of the Wireless Future Program for the New America Foundation, a public policy advocacy group. Communications Daily quoted Calabrese at the time as having gone so far as to advocate a second phase of the DTV transition, which amounted to no less than a dissolution of broadcast television altogether.
"Take TV off the air," Calabrese suggested, in words that were repeated on the Foundation's own Web site. In a proper world, he added, the entire broadcast spectrum should be opened up to wireless broadband, with television relegated to cable, satellite, and the Internet.
Calabrese's remarks may have actually served to guarantee opposition to the free wireless broadband plan, by effectively lumping M2Z's proposals in with virtually unworkable, and arguably ludicrous, plans to rid the airwaves of broadcasting.
In a weekly radio address earlier this month, President-Elect Obama voiced his support for the notion of free broadband service, listing it as among one of the public works projects that he believes could help restore the American economy.
"It is unacceptable," Mr. Obama said, "that the United States ranks fifteenth in the world in broadband adoption. Here, in the country that invented the Internet, every child should have the chance to get online, and they'll get that chance when I'm President -- because that's how we'll strengthen America's competitiveness in the world."

11:10 am EST December 12, 2008 - Reuters is reporting this morning that Sen. Jay Rockefeller (D. - W.V.), who is perceived as most likely to head the Senate Commerce Committee in the new Congress come January, may ask the FCC to delay its vote on the AWS-3 auction rules -- as well as any rulemaking concerning spectrum -- until after the DTV transition on February 17.
If the free broadband debate has to wait for that discussion to conclude, the best-laid plans of M2Z Networks may have to be tabled for yet another year. Do you know what your broadband speed is? Me neither, but I know it's too slow, and if you're in the UK, the chances are, you'll think that too - and you'd be right.
A new study has shown that figures on average broadband speeds of around 4.6MB/sec in the UK have long been skewed due to a few people forking out for ultra fast 24MB/sec speeds, whereas the rest of us actually hover around something like 2MB or less.

An international team of researchers from Australia, Canada and the United States have developed a chip that can provide unlimited bandwidth while using a million times less energy than current designs.
The photonic chip is based on an improved version of the glass in optical fibre cables.
"We know that Photonic Integrated Circuits, or PICs, have the potential to revolutionise our world in increasing the speed of the Internet. We've now gone one step further by developing an environmentally friendly all-optical PIC with low energy consumption," says Dr Moss who works with the University of Sydney.
The new design of the glass circuits allow computer operations to be performed faster and with a million times less power than previously PIC based technology.
