Judge rules BP's blemished safety record off limits in trial

Plaintiffs in the lawsuit against BP over damages from the Gulf of Mexico oil spill won't be allowed to bring up the oil giant's spotty past safety record, including a major accident in Texas City, Texas, nor will they be allowed to use the contents of a series of reports on the causes of the Deepwater Horizon disaster, U.S. District Judge Carl Barbier ruled Thursday.

Barbier based his rulings largely on the length of time that would be added to the trial by either assuring information on which the reports were based followed federal evidence rules, or allowing BP and other defendants to contest the materials.

The rulings, requested by BP and other defendants in the lawsuit, cover materials that members of the Plaintiff Steering Committee and the federal government wanted to be considered during the first phase of the trial, which is scheduled to begin Feb. 27. The first chapter of what's expected to be a three-part court battle, called the "incident" phase, deals with the events leading up to the explosion of the Deepwater Horizon rig.

Excluded will be the comprehensive reports on the causes of the accident written by the National Commission on the BP Deepwater Horizon Oil Spill and Offshore Drilling in January 2011, by the commission's chief counsel in February 2011, and a marine casualty investigation report released in August 2011 by the Republic of the Marshall Islands maritime administrator. The Deepwater Horizon rig operated under the Marshall Islands flag.

Also excluded will be:

•A report by the U.S. Chemical Safety and Hazard Investigation Board on a 2005 explosion at BP's Texas City refinery that killed 15 people and injured 180 others;

•A 2007 deferred prosecution agreement between BP and the Department of Justice concerning an alleged conspiracy by BP to manipulate the market to increase the price of propane gas in February 2004.

•A fact sheet produced by the federal Occupational Safety and Health Administration describing BP's alleged failure to comply with a settlement agreement after the Texas City accident, and citations involving alleged safety violations during a 2009 inspection of that plant.

Why are we having to CONVINCE our president to do the right thing? I made the call, but I told it like it is, please feel free to follow my script if you choose to. I believe that we have done enough pussyfooting around with those who are supposed to represent us in the White House.

There are hundreds of thousands of families who are still living in the homes that have been foreclosed on, hoping and praying that some justice will be done , that right action will take place on their behalf. If you, Mr. President, give a settlement to the banks which have created this poverty economy, the banks will have a field day with an unprecedented LAND GRAB...Make no mistake, for the Millions who have already been ousted, duped into thinking there was nothing they could do to save their homes, to those who have yet to be put out in the streets if you betray them/us even further, you will see such a swell of Occupiers on the White House lawn as will be inconceivable.

Will such a cowardly and treasonous act cause a civil war? Probably... Is this what you want? Is this your goal for your country, to have your foot upon the necks of Americans? Are you too, OWNED by the banks? I would not have thought so, but if you condone the fraudulent and criminal actions of the banks and investment firms that have brought this suffering upon the American People, you will have shown yourself to be without moral conscience, without patriotic affiliation to the people you have sworn to serve and that you are without the backbone to stand up to the corruption that is the downfall of our civilization in this moment, at this time. Mr. President, Do the right thing, REFUSE any kind of settlement until a complete investigation can be carried out and criminal charges brought to bear on those whose greed and corruption have injured not only our own countries economy, but have crossed oceans and touched the lives of many other countries in the world. Become the leader you were meant to be, that you promised you would be. Stand up and act with purpose and solidarity with your people, not with big money, big banks or big corporations.

The Weaker Sex and Army of One

When Deloris Gillespie walked into an elevator, she was unaware that a man was waiting for her. With white gloves and a dust mask, he started to spray the 73-year-old woman with gasoline. As Deloris turned around and crouched, in an attempt to protect herself, the man continued to methodically douse her. He then pulled-out a lighter, ignited a rag in a bottle, and while backing out of the elevator, tossed the flaming bottle on Deloris who was huddled on the floor. Deloris was burned to death.

During a demonstration in Cairo, Egypt, military police charged towards fleeing protesters as the army surrounded and then stormed into Tahrir Square. One woman, wearing an Islamic headscarf, was grabbed and hauled down a street. The heavily armed uniformed band of men viciously clubbed and repeatedly beat and kicked her. At one point, they stopped and started to stomp on her semi-naked chest. As the men continued to yank her body along the asphalt, they beat her in the face with sticks.

After his pre-emptive war failed to find weapons of mass destruction, then-President George W. Bush promised equality and freedom to the people of Iraq. President Barack Obama has just hailed the U.S.-Iraqi War, and its lengthy and bloody occupation, a "great achievement" and "success." But for women, they remain victims of violence, trafficking and kidnappings, in some cases working slaves. Before the war, women in Iraq enjoyed strong protection and opportunities. Now, there are more than one million widows.

Anthropologists have found that early humans, who were hunters and gatherers, lived in small-scale social groups. These kin-based units included collective or common ownership of land and resources, reciprocity in the distribution of food, and political power sharing. Some agree too that both women and men participated in foraging and hunting for food. Such cooperation and collective values produced little division of labour between the sexes, including the absence of male supremacy over women.

Early human sites and settlements also reveal that it was natural for men to worship female fertility gods and pray to them. On the island of Crete, the Minoans worshiped a great Mother Earth Goddess who ruled over the other gods. Artwork depicts women as priestesses and in charge of shrines, aided by male assistants. There is evidence that the Minoans were peaceful and nurturing, since there were no signs of fortifications. Other Asian and Indus cultures worshipped mother goddesses and their life-giving principles.

Under such hunting and gathering or small societies, the need to carry children on the daily round of gathering and on the periodic moves of the whole camp had led to very low birth-rates. Women could not afford to have more than one child who required carrying at a time, so births were spaced every three or four years. But as the Neolithic Revolution supplanted the Palaeolithic Age, children, born of women, represented the future labour and military supply of the village as a whole.

War, virtually unknown in simple societies, became a more prominent feature as city-states evolved into nations and empires. The premium for military conquest and agricultural output was large families. Did this limit women, since they appear to be more vulnerable during child-bearing and the birthing process? By the time of Homer's Iliad and the Book of Genesis, a violent, warlike, patriarchal society had emerged. Whereas the Trojan War is defined by Helen, Eve tempted Adam and they were expelled from the Garden of Eden.

Western-based writings by males also tended to extol the virtue of violence on and off the battlefield and in war. Instead of hunting and gathering for the good of the family, a "warrior" and "killer" instinct developed, one that was extremely self-centered. The worship of aggressive and violent warrior kings, even the worship of war-like and genocidal gods, replaced mother goddesses and fertility. Adherence to death and destruction, along with violent sacrifice, overtook life and creation and peaceful nurture.

Do male Armies of One, individual or collective, that beat and kill women and produce widows, whether in New York, Egypt or Iraq, have a cruel and twisted primordial urge? Maybe they violently resent that women are primarily responsible for the continuance of humankind and its political and economical livelihood or that women are of immeasurable worth and hold a kind of divine status and knowledge. The psychologically and emotionally weak resort to war and bloodshed. Seldom is this observed among women.

Until the weaker sex, or men, give birth too, it would be wise to heed this ancient truth: "Where women, verily, are honoured, there the gods rejoice; where, however, they are not honoured, there all sacred rights prove fruitless."

Why I fight injustice.

I am 64 years old, the child of parents who lived through the Great Depression, fought in Europe and on the home front in World War II, fought for union rights in the post war years, had high school educations and managed to have 7 children all get higher education.

I am old enough to remember when this was a fairer nation.
I am old enough to remember when what is normal behavior on Capitol Hill and Wall Street today was a crime.
I am old enough to remember when education was a right, not a commodity.
I am old enough to remember what shared sacrifice really meant.
I am old enough to remember when the Republican Party put Country ahead of Party.
I am old enough to remember when the Democratic Party represented working people.
I am old enough to remember what I was taught in elementary school, secondary school and college and to use it to help make my community a better place to live rather than taking advantage of it as a resource to exploit.
I am old enough to remember when tuition was free at the state colleges in Pennsylvania.
I am old enough to remember when people were encouraged to vote rather than legally denied their right.
I am old enough to remember a time when America had declared a War on Poverty and was actually winning it until another war took precedence.
I am old enough to remember what that war was like for those who fought in it, as well as those who fought against it since I did both.
I am old enough to remember the Governor of Pennsylvania stopping by to visit my dad whenever he was in town, simply because the two of them served in the same air crew in WWII.
I am old enough to remember when America was truly a kinder and gentler nation, long before the birth of compassionate conservatism.
I'm old enough to remember where I was when Dr. King had a dream, when 4 little girls were killed in Birmingham, when a President was shot in Dallas, when man landed on the moon, when a President resigned (was there for that one), and to see a black man elected President (helped out in that one).
I'm old enough and I hope wise enough to appreciate the history I've witnessed and to use that wisdom to help following generations use it to better mankind.
I'm old enough to be cynical, yet I'm still an idealist.
I'm old enough to not care about the consequences of my action enough to do what I believe is necessary (non-violently) to help assure my grandchildren a life of dignity.
