A West Georgia Sheriff is defending his deputy’s decision to arrest, handcuff and jail a mentally challenged student who acted up in the classroom.
Tessie Collins, 17, was booked into the Haralson County Jail on Tuesday on charges of simple battery and obstruction of a law enforcement after a school resource officer witnessed her pinch a student and a teacher at Haralson County High School.
“The officer had to do something,” Sheriff Eddie Mixon told Channel 2’s Mike Petchenik. “In my opinion, it was handled with kid gloves. You got to stop it. That’s our job, it’s to stop the violence.”
Mixon said Collins was released from jail on her own recognizance several hours after her arrest.
“I’m furious,” said Tessie’s mother, Ann Collins.
Collins told Petchenik that her daughter has developmental delays that give her the mental capacity of an 8-year-old child. She said the school system is well aware of her daughter’s tendency to pinch people when they “invade her space.”
“She should be secluded by herself or a parent is called to come pick her up,” she said. “It’s just a misunderstanding. She doesn’t know what she’s doing and that should have been taken into consideration.”
Haralson County School Superintendent Brett Stanton wouldn’t discuss the particulars of the incident but told Petchenik he would be investigating what happened.
“I feel I have a responsibility to look into that concern and make sure that, from my standpoint, it’s been reviewed and examined,” said Stanton.
Stanton said there were 150 special education students at the high school. He said the district has procedures in place to deal with each one’s behavior. But, he said, if a student broke the law, it would be up to the school resource officer to handle the situation.
“Just because the student falls into that category of being special education or a student with disabilities, doesn’t mean they are given carte-blanche to break school rules or anything like that,” he said.

Police have arrested an elderly couple on suspicion of the manslaughter of their daughter – who had been left housebound by obsessive compulsive disorder.
Samantha Hancox, 40, was found dead in an armchair by frail parents Ken and Marion at their home in Tipton, in the Black Country.
A post-mortem revealed that the one-time law student – who had a crippling phobia of germs – died from dehydration and a skin infection.
Paramedics had been called to the house by her disabled mother Marion, 77, and father Ken, 76, who thought she was in a coma – but were told that she had died.
West Midlands officers later arrested the couple on suspicion of manslaughter. They are currently on bail while detectives continue an investigation into the death.
Former factory worker Marion said: 'How could they arrest us? We didn’t kill her, it was the OCD. She was our daughter and we loved her.
'She just gave up her fight against it, she was so terrified of germs.
'She would scrub her hands all the time and wouldn’t let anybody into the house except me and Ken.
'Ken would make all her food and drinks for her because I can hardly walk.
'It’s heartbreaking to lose a daughter like that, we loved her.'
Mr Hancox, who has bone cancer, has told of the heartbreaking moment when he realised he had lost his daughter, who had been eating less before her death.
'The night before I had given her a drink of pop and thought she was fine,' he said.
'I went in the next morning and thought she was sleeping.
'Later Marion checked on her and said she thought she was in a coma.
'We called the ambulance who looked at her, then the police came and there were about 30 of them here.
'Later we were taken to the police station and kept for seven hours while they questioned us.'
Samantha suffered from acute obsessive compulsive disorder, which gave her a crippling phobia of germs. She constantly scrubbed her hands and needed around-the-clock care from her elderly parents because she was too scared to cook.
The troubled woman would also shower for 20 hours a day and spent all her time cocooned in the front room watching TV.
She was Mr and Mrs Hancox's only child and enjoyed a normal early childhood growing up in Tipton.
But at the age of 10 she was badly affected by the death of her grandmother, Molly.
Mrs Hancox said: 'That really shook Sam up. Molly went into hospital but she never came out, she would have died anyway but Sam thought the hospital killed her.
'We lost a lot of relatives in a very short time and that is when it began.'
By the age of 14 Samantha’s condition was so serious that she had to leave school and was cared for at home by her parents.
Three years later she took her O-levels before she started studying law at Dudley College – but left before finishing her course when her phobia worsened.
'From the age of about 25 she got really bad,' added Mrs Hancox.
'She just stayed here in the house because she was too scared to go out.
'There was a fog in the house from her showering, she would be in there 20 hours a day sometimes, trying to get herself clean.'
Samantha died in May last year. She began to go downhill fast when her father went into hospital for four days in April to have an operation on his prostate.
Mr Hancox said: 'That was what made her really struggle because she thought I would bring germs home with me.
'When I went into the hospital she told me not use the lift, as she said I would get germs on my hands from the buttons. It killed me going up the stairs but I did it for her.
When I came out she had gone off her food, she used to eat lots and lots but she hardly ate anything, just a bit of pizza or quiche.'
Mr Hancox says he should have been given more help to care for his daughter by Sandwell Social Services.
'When I came out of hospital I should have been resting, I had a disabled wife and a sick daughter and no-one gave us any help,' he added.
'We couldn’t cope but no-one came to help us.'
Sandwell Council was unavailable for comment last night.
A West Midlands Police spokesman said: 'We can confirm that a 76-year-old man and a 77-year-old woman were arrested on suspicion of manslaughter and are currently on police bail, pending further inquiries.'

Australian police are using Taser guns against people with mental illness in a disproportionately high number of cases, a five-year study says.
Specialist forces in Victoria used Tasers in 83 incidents - 85% of cases involved a person with a mental illness and 28% of those targeted were unarmed.
The Federation of Community Legal Centres, which commissioned the study, said it showed "systemic problems".
The use of Tasers by police in Australia provoked public anger earlier this month when a video was released of a man being receiving 13 Taser shocks from police in Western Australia.

Jack Dykinga was the first Chicago Sun-Times photographer ever to win the Pulitzer Prize, honored for a somber series of stark photographs taken in 1970 at state schools for the mentally retarded in Illinois. After the photographs were published, there was a large public outcry of outrage. In response, Illinois government officials canceled their plans to reduce funding supporting the State Department of Mental Health.

After decades of studies by various task forces, followed by experiments by local governments, a consensus has emerged that the most effective way to help chronically homeless people is to stabilize them in housing first and then offer treatment. In New ACIP Guidelines: Guidance for Vaccine Recommendations in Pregnant and Breastfeeding Women updated version (May 5, 2008), CDC refers to the live attenuated influenza vaccine LAIV), commonly called “live vaccine,” reporting:
1. “If a live-virus vaccine is inadvertently given to a pregnant woman, or if a woman becomes pregnant within 4 weeks after vaccination, she should be counseled about the potential effects on the fetus.”
2. “Live vaccines pose a theoretical risk to the fetus.”

Conservative media figures are blasting Democrats for trying to draw political gain from the death of Senator Ted Kennedy. But on Thursday, it was one of their own -- former Arkansas Gov. Mike Huckabee -- who went there.
The 2008 Republican presidential candidate suggested during his radio show, "The Huckabee Report," on Thursday that, under President Obama's health care plan, Kennedy would have been told to "go home to take pain pills and die" during his last year of life.
"[I]t was President Obama himself who suggested that seniors who don't have as long to live might want to consider just taking a pain pill instead of getting an expensive operation to cure them," said Huckabee. "Yet when Sen. Kennedy was diagnosed with terminal brain cancer at 77, did he give up on life and go home to take pain pills and die? Of course not. He freely did what most of us would do. He choose an expensive operation and painful follow up treatments. He saw his work as vitally important and so he fought for every minute he could stay on this earth doing it. We have all watched in amazement as the defaced photos of President Obama as Hitler held by wild eye'd crazy people screaming loudly with no more of a purpose than to disrupt and to stop the Democratic process. These loud mouth antagonists following their seemingly well distrubuted scripts of Anarchy 101. These people who now claim, to be Blue Dog Democrats or, independents etc.. All also claim to be only wanting a different type of health-care reform? When the truth is self evident by any person that would quickly choose a sign of Hitler and swastikas' to taunt as if these evil signs and symbols had something remotely to do with health care. By their own professed actions they show more to be the apostles of the extremist far right locked in "goose-step" with others like them across the country... following the lead of organizations like: NEWSMAX and Christopher Ruddy, Rush Limbaugh's along with the other hate screaming Neocons and Fascists. It seems rather amazing as after eight years at the helm with Bush, leaving the country on it's knees ruined. Now these over-caffeinated and angry losers, who only want democracy- Only if "they win", are at it again!
We need not forget ~ That some of our goose-stepping colleagues have been assigned to be here.

I have heard it to many times. Jail and prisons are the new mental health hospitals. I spent 9 1/2 months in jail for having a blackout on my medications. I woke in the the night, drove through a stand of trees, took out 8 mailboxes, 2 stop signs and a telephone pole before being stopped by a parked car. When I woke up in a jail cell I FREAKED..... I have my toxicology report. NO alcohol, NO anything, other than 2 of the psych meds I was prescibed in "therapeutic" levels.. The DA told me he needed to go after me harder because I knew I was on drugs and shouldn't have been driving... So there I sat... Riding out an 11-29 (11 mo. 29 days) broke, no license and no way to get to and from probation office or pay fines..I have heard it to many times. This is an compelling story similar to my own in a way. I had my first attempt in the 4th grade. I didn't know why I wanted to die, I just did. After writing the note good bye, lacing a piece of cake with strychnine and spraying it with ant killer for extra measure, I laid down. My mother found my note when she got home from work, carried me to the hospital and it was explained away as an accident. I was the "popular kid" in school but always felt the pain of anxiety and depression at my doorstep.
Behind the acts of violence and rage of both the Virginia Tech and Columbine shootings is a larger issue of mental illness in teens that is rarely addressed. For instance:
* The rate of teenage suicide has tripled over the last 60 years –28 teenagers a week now die by suicide.
* Depression and anxiety in adolescents often go unrecognized or untreated for years, and the results can be fatal – over 90 percent of adolescents who die by suicide have a diagnosable mental illness at the time of their death.
While school shootings are rare, signs of mental illness in the perpetrators of these crimes are not. School shooters often have a history of suicide attempts, suicidal thoughts or depression – which makes identifying those conditions through mental health screening critically important.
Cry for Help takes an intimate look at the efforts of two high schools to identify adolescents at risk. Hamilton High School in Ohio and Clarkstown North High School in New York have both been affected by teen suicide and have launched powerful new programs to prevent future tragedies.
