Ok, so we all know that the record companies won yesterday, and Jammie Thomas was fined over $200,000 for sharing and downloading music on Kazaa. That sucks and is scary, or is fair and finally just, depending on your perspective.
But the craziest part of all of this is what one of the Sony attorneys argued during the trial. Jennifer Pariser argued that buying a cd, and then pulling the songs into your iTunes library so that you can listen to the tunes you just bought on your iPod makes you a thief. Apparently, if you want the songs you own on cds on your portable devices, you're supposed to buy the song again. Right.
Reports have also come out that the record labels are losing money with all these lawsuits against downloaders because the settlements at a few thousand dollars a pop don't cover the expense of filing all these cases. Jammie Thomas, a 30-year-old single mother of 2 is accused of offering about 1700 songs for free over the internet on Kazaa. The Recording Industry Association of America is only suing Thomas over 25 songs, but at about $150,000 a pop, that still adds up to a hefty $1.2 million sum. The group has said they are not going after each song because they are more concerned with ending the practice rather than receiving large rewards if they win.An amateur musician was among the jurors selected for the trial, which could work for Thomas (many new artists offer their songs for free online to increase exposure and build a fan base), or against her (if he empathizes with the musicians represented by the mega-labels). Army Spc. Jorge G. Sandoval, the first of 3 soldiers in the "baiting" trial, was acquitted of murder, but found guilty of planting evidence to justify the shootings.
The LA Times article provides a disturbing description of one of the events in question - disturbing both in how the Iraqi was treated, and as far as the effects that the events have had on the soldier who was testifying about them. From the LA Times article, it seems to me that Staff Sgt. Michael A. Hensley clearly deserves some serious punishment, and that Sgt. Evan Vela was simply following orders that he should have ignored.

The Washington Post looks at a classified program of "baiting" used by Army snipers in Iraq: apparently, soldiers would put out suspicious items like detonation cords, ammunition and plastic explosives. Anytime someone would pick the item up, the snipers saw that as intent to use the weapon against the U.S. and would shoot and kill the person. The Army, of course, does not acknowledge baiting as an official policy.
Now, three snipers have been charged with murder for allegedly planting items on Iraqis after killing them to make shootings seem legitimate.
But perhaps the most worrisome to me was this line: "Two soldiers who had not been officially informed about the program came forward with allegations of wrongdoing after they learned they were going to be punished for falling asleep on a sniper mission, according to the documents." A large turnout is expected for a rally in support of Mychal Bell, the only one of the Jena Six to have been jailed and tried, on the day he was supposed to be sentenced.An appeals court overturned his conviction last Friday, ruling that the 17 year old should not have been tried as an adult. Noun Chea, also known as Brother Number 2 or "Pol Pot's shadow", was arrested in Cambodia today. Chea, now in his 80s and in declining health, was in charge of security under the regime. After the deaths of Pol Pot, the leader of the regime, in 1998 and Ta Mok, the military commander, in 2006, Chea is considered the most senior surviving leader. He will be the second member of the violent Khmer Rouge regime to stand trial - Duch, who ran an infamous torture center, has already been charged, and named Chea as directly responsible for much of the killing during the 4 year regime (1975-1979). Chea has denied this and says that he does not fear a trial. He has been living freely in Cambodia since the regime ended.The Khmer Rouge was a communist party that enforced a very strict agrarian society where everyone worked in either a collective farm or a forced labor camp. Over the four years they were in power, estimates of the number of people killed range from 850,000 to 3 million. Most of those were either by execution, starvation, or overwork. 72-year-old James Ford Seale will die in prison. Seale was convicted in June on federal charges of kidnapping and conspiracy in the deaths of Charles Moore and Henry Hezekiah Dee, two 19-year-olds who disappeared from Franklin County on May 2, 1964. The prosecution's star witness against Seale was Charles Marcus Edwards, a confessed Klansman, who received immunity from prosecution for his admitted role in the abductions and his testimony. 19 year old Heather Johnston apologized in tears for her part in the robbery of a Georgia Bank of America in February. The former stripper is now holding down a job as a customer service representative and says she is trying to get her life back on track.Sun-glasses sporting Heather and (former?) pal Ashley Miller (a stripper at the same club) were laughing and chatting as they passed a note to a teller, and they made of with almost $11,000. About 2 dozen gas station owners filed suit in federal court in San Francisco yesterday alleging that the execs of Shell, Chevron and Saudi Refining Inc. met monthly since early 1996 to fix prices for 23,000 franchise owners nationwide (and of course destroyed all documents from those meetings). The U.S. Supreme Court threw out a similar case last year that was filed in 2004. The difference this time around is that the plaintiffs are saying the oil companies violated a "rule of reason" governing antitrust matters.The plaintiffs have requested class-action status, so that if the court does decide in their favor, all franchie owners would benefit, not just those named in the court filings now. 15 of Saddam's old pals are on trial for crushing a Shi'ite uprising in 1991 in a U.S. backed court. You'd think these trials would help bolster goodwill toward the U.S., justice being done at last, right? Wrong. The trial seems to be dredging up some not so buried resentments and bitterness toward the U.S. for not stepping in when all of this was going down after kicking Iraqi troops out of Kuwait.
