A federal judge in Wisconsin declared Thursday that the US law authorizing a National Day of Prayer is unconstitutional.
US District Judge Barbara Crabb said the federal statute violates the First Amendment’s prohibition on government endorsement of religion.
She issued a 66-page decision and enjoined President Obama from issuing an executive order calling for the celebration of a National Day of Prayer.
The National Day of Prayer was first authorized by Congress in 1952. Since 1988, the date has been set as the first Thursday in May.
The judge stayed her own injunction pending the resolution of any appeals.
“I understand that many may disagree with [my] conclusion and some may even view it as critical of prayer or those who pray. That is unfortunate,” Judge Crabb wrote.

A Brazilian judge has cancelled the tender process for construction of the world's third biggest hydroelectric dam in the Amazon jungle and suspended a preliminary license issued for the site.
In his decision, handed down late Wednesday, Judge Antonio Almeida Campel upheld a request from the Federal Public Ministry in Para state seeking to have authorizations to build the Belo Monte dam on the Xingu River withdrawn.
The dam's hydroelectric production capacity of 11,000 megawatts would come at the cost of submerging some 500 square kilometers (193 square miles) of land and would "require excavations equivalent to the work needed to build the Panama Canal," according to the Public Ministry.
Campel told Brazil's Institute of the Environment not to deliver a new license for the dam and ordered the National Energy Agency to halt next Tuesday's call for tenders for the contract to build the dam or face a 570,000 dollar fine for "environmental crimes."
"The Belo Monte hydroelectric dam will exploit hydro-energy in areas occupied by indigenous people who will be directly affected by the construction and development of the project," the judge said in his decision, which is subject to appeal.
Belo Monte would be the second biggest dam in Brazil and the third biggest in the world, behind the 14,000 megawatt capacity Itaipu dam in southern Brazil and the massive Three Gorges dam in China, which has a capacity of 18,000 megawatts.

Yesterday, a Russian judge who had tried high-profile racist murder cases was shot dead in the stairwell of his home.
Eduard Chuvashov had sentenced a group of ultra-nationalists, mostly teenage skinheads, to up to 23 years in jail for the murders of migrant workers from Central Asia. Chuvashov had faced threats on several radical websites, and authorities believe his killing is most likely related to the work he did.
Three years ago, I went to Russia looking for the source of viral videos I had seen on the Internet showing neo-Nazi skinheads kicking and beating people in the streets with no apparent provocation. In the Vanguard documentary "From Russia With Hate," I reported the attacks were coming almost daily in Russian cities.
I was in Moscow on Hitler's birthday, April 20, and found foreign students confined to their dorms because nationalist fervor surrounding the anniversary was so high it wasn't safe for dark-skinned people to go outside. I filmed ultra nationalist politicians preaching hatred to crowds of disenfranchised youth in Moscow, and I interviewed a member of parliament who openly espoused using violence to terrify immigrants from former Soviet territories in the Caucuses and Central Asia.
I also visited a secret, military-style training camp, where we watched neo-Nazis crawl through fire learning to become guerilla fighters. It was there I met the creator of many of the Internet attack videos, who proudly showed me his "propaganda films" of youth gangs setting upon and bashing nonwhites to terrorize the ethnic immigrant community.

In 2006, was put on Google a video showing a boy with autism while being beaten by some of his classmates, in total disregard of the others. That video was on for two months, because nobody, in Google, controlled it.

This week, prolific Tweeter Miley Cyrus deleted her very popular Twitter account.
I know. I was sad, too.
Why, why would she do such a thing? Well, Miley's been feeling overexposed, so she decided she needed to make her personal time personal. And what better way to lessen the glare of the spotlight than to make formal proclamations about how you will no longer be detailing the minutia of your life in neat 140 character slices?
You see, Miley wasn't living in the now, savoring those moments of quality time with friends and family, because she felt overwhelmingly compelled to tweet about it. We've all been there.
But this hobby turned dark, as it seems that Twitter puts you into contact with a lot of negativity, as she said in her multi-paragraph essay addressing her twit quit on her official website. Miley really just wants her "me time" to be hers again! She just wants to have some sort of 'normal' life. She stopped living for moments, and started living for people, as she said in her YouTube rap "Goodbye Twitter."

That's right, it's time for Miley to put Miley first!
Which inspired me to put myself first in the same fashion, so here goes: Hey world! I'm not living for you anymore! I'm doing my own thing, singing my own song (which at the moment in "Party in the USA", so fuck off! Don't judge me.)
But, I won't be a twitter quitter, because it would just be too embarrassing when I'd inevitably go back. I'm not as strong as you, Miley. I NEED to see every time Diddy tweets, "LETS GOOOO!!!!!!!!!"
Cuz it's like, damn, he must mean it if he's taking up that many characters with extras "o's" and exclamation points.
I absolutely must update the world when a pigeon brushes my head with it's disgusting wing. It's kind of like keeping a weird journal you're not that embarrassed about people seeing.
I'd like to think I'll be able to look back on my tweets in my golden years and remember, "hey, yeah, I did go to Pinkberry that one time, and it was awesome."

^Judge Kevin Fine of Houston claims that the practice of the death penalty in Texas are illegal. His reasoning is that it violates the clients right to due process of law "since hundreds of innocent people around the country have been convicted and sent to death row and later exonerated."
He is under hott criticism especially from Gov. Rick Perry. One question... what the fuck has Perry done for us Texans? Unlike Fine, Perry would rather send someone to the "chair" then actually looking into their case and giving them a second chance to prove themselves.That's a reason why innocent poor people are being executed. They don't have money for proper lawyers leaving them shit out of luck once the first ruling rolls around.

Some of the soldiers go crazy when they return home after witnessing such atrocities. We don't fight in the name of PEACE. We don't fight in the name of FREEDOM. We fight in the name of HALLIBURTON, RAYTHEON, KELLOGG, PFIZER and the rest.
How dare we claim the high moral ground when the wars we are in are for profit and lies and have nothing to do with freedom or saving anyone? Did you know that an 'insurgent' is someone who doesn't like having a foreign military stomping around on their backyards? I'd be willing to bet most of you would be insurgents if the roles were reversed. An estimated 90% of the foreigners killed in the Iraq and Afghanistan wars have been civilians...innocent. We call them collateral damage. They call them brother, sister, father and mother.
Take a good look at this video and hear the testimonies. Then, think about all of your complaints, fears, demands, petty arguments that you take for granted every day. Think about everyone asking for money, jobs, cutting back on carbon emissions. Now, answer this. How dare we complain about what we lack when we've taken so much from so many? How dare we complain about carbon emissions when our death machine is creating the majority of it? How dare we argue between Democrat and Republican when so many in our own streets are fighting for a meal? How dare we judge anyone for hating us when we've destroyed their lives, their land, their water and their future?
There will never be peace anywhere on this planet until we learn that the 'Justice' that we preach must be the 'Justice' we deliver.

A federal judge says the Food and Drug Administration overstepped its authority in efforts to regulate electronic cigarettes. Regulators began halting shipments of electronic cigarettes last year. The F.D.A. said it found cancer-causing ingredients in the products, despite manufacturers’ claims that they are safer than tobacco cigarettes. The agency argued that electronic cigarettes, which use a battery-operated vaporizer to produce a nicotine mist, are a combination drug-device, and therefore subject to stricter safety standards than cigarettes. But Judge Richard Leon of Federal District Court agreed with manufacturers that electronic cigarettes are “the functional equivalent of traditional cigarettes.”

A New Jersey man on trial for growing 17 marijuana plants on his property was found not guilty yesterday of the most serious charge against him, that of operating a drug production facility, which carries a potential 20-year sentence. But multiple sclerosis-sufferer John Wilson, 37, still faces the possibility of five to 10 years in prison, because the jury found him guilty of second-degree manufacturing and third-degree drug possession. It's possible that Wilson avoided conviction on the most serious charge because he cast doubt on the credibility of state troopers who arrested him in August 2008—with a little help from the National Guard.
Wilson maintains that he was growing the marijuana because it helps alleviate his MS symptoms, but Superior Court Judge Robert Reed had ruled that the validity of medical marijuana was a matter for the Legislature and inadmissible in court. Nevertheless, Wilson was able to make one mention of his condition during his testimony on Wednesday, when he contradicted the state troopers who swore they did not discuss why he was growing the drug. "I told them I was not a drug dealer and I was using the marijuana to treat my M.S.," Wilson said.
Juror Mark Imbriani, who is actually a criminal defense lawyer in Somerville and a former assistant prosecutor in Union County, tells the Star-Ledger that some jurors "didn’t feel as though (the detectives) were being candid when they responded to those questions." The trial prompted sick marijuana users to protest outside the courthouse, and two state senators who sponsored a medical marijuana bill have been seeking a pardon for Wilson. "This case has been a horrible waste of taxpayers’ dollars and just a cruel and inhumane use of prosecutorial powers, which is one of the things pardons are designed to overcome," New Jersey State Senator Ray Lesniak said.
Speaking of wasting taxpayer dollars, it also emerged during the trial that the military helped bust the sickly pot grower. Deputy Attorney General Russell Curley told the jury during closing arguments that the plants were spotted by a National Guard helicopter because they were 6 feet tall: "These weren’t plants. These were trees." Florida's judges and lawyers should no longer "friend" each other on Facebook, the popular social networking site, according to a ruling from the state's Judicial Ethics Advisory Committee.
At least one South Florida judge warned her pals with a Facebook status update that they could be "unfriended," and the ruling has prompted others to do the same. The committee ruled Nov. 17 that online "friendships" could create the impression that lawyers are in a special position to influence their judge friends.
The committee did conclude that a judge can post comments on another judge's site and that during judicial elections, a judge's campaign can have "fans" that include lawyers. And the ruling doesn't single out Facebook.
"Although Facebook has been used as an example in this opinion, the holding of the opinion would apply to any social networking site which requires the member of the site to approve the listing of a 'friend' or contact on the member's site," the opinion said.
A few on the committee dissented, saying judges should be allowed to have Facebook friends because those relationships are more like "a contact or acquaintance."
Although only the Florida Supreme Court can actually mandate what judges can do, most will likely follow the ruling out of an abundance of caution, said Craig Waters, spokesman for the Florida Supreme Court.
