Body of former Pentagon official found in landfill

Delaware authorities are investigating the circumstances surrounding the recent discovery of the body of a former Pentagon official in a landfill, according to a statement released Monday by the Newark, Delaware, Police Department.
The Delaware medical examiner's office has ruled the death of 66-year-old John P. Wheeler a homicide.
Wheeler was discovered at Wilmington's Cherry Island Landfill on December 31.
Wheeler, who lived in New Castle, worked under three Republican presidents -- Ronald Reagan, George H.W. Bush, and George W. Bush. He served as a special assistant to the Air Force secretary from 2005 to 2008.
Among other things, he also served as head of the Vietnam Veterans Memorial Fund and was the first chairman of Mothers Against Drunk Driving.
A staff officer in Vietnam, Wheeler was a graduate of West Point, as well as Harvard Business School and Yale Law School.
"We are asking for the public's assistance" in the case, Newark police spokesman Lt. Mark Farrall told CNN. "We don't know where the crime scene occurred. The body was dumped within our jurisdiction." Newark is about 12 miles southwest of Wilmington.
Farrall noted that Wheeler's body was seen jutting out of a garbage truck at the landfill by a spotter whose job it is to ensure that hazardous material is not dumped there.
Police believe Wheeler's body was most likely picked up by the truck at one of the first of ten specially designated dumpster pick-up spots before heading to the landfill.
Farrall said police do not know when Wheeler was last seen. He noted that Wheeler had been scheduled to take a train from Washington to Wilmington near the time of the death, though he dismissed reports that Wheeler had actually been seen on a train.
Farrall said an apparent dispute between Wheeler and a neighbor was "one facet of the investigation."
Wheeler's attorney, Bayard Marin, told CNN that his client had been involved in a lengthy legal fight with a couple building a new home across the street in a historic district of New Castle. Wheeler had adamantly opposed the new construction.
The dispute may have become contentious, but "I can't recall a confrontation," Marin said. "Everything seemed to be kept within normal bounds."
Veterans advocates offered statements of praise for the former official, who served in Vietnam.
"It is only fitting that we pause now and remember Jack Wheeler, who served his country honorably, then dedicated himself to ensuring that our nation's service members are always given the respect they deserve," said Jan Scruggs, president of the Vietnam Veterans Memorial Fund.
What Wheeler "cared about was civic values and civic virtue," wrote James Fallows, national correspondent for The Atlantic.
"He was a complicated man of very intense (and sometimes changeable) friendships, passions, and causes. ... Massey CEO Donald Blankenship Committed Negligent Homicide — Throw Him in Jail « SpeakEasy

There are criminal sanctions available for negligent corporate officers, but this looks like a straight up case of negligent homicide:

Mine Workers (UMWA) President Cecil Roberts says that Massey Energy Co.’s continued inaction on safety violations at its Upper Big Branch Mine, where 29 West Virginia coal miners died in an April 5 explosion, should send Massey CEO Donald Blankenship to jail.

In a speech at the Pennsylvania AFL-CIO convention yesterday, Roberts said, “If there is any justice in America,”

U.S. Marshals should go to where he lives, get him, handcuff him, put him in chains, take him to jail, set his fine at $40 million.

He told the delegates the Mine Safety and Health Administration (MSHA) inspectors had “shut this mine down over and over and over again.”

They brought the men outside, they brought them to a safe place. But as soon as they left the same thing happened again and again. They didn’t correct the violations.

In 2009, MSHA proposed nearly $1 million in fines for more than 450 safety violations at the nonunion mine. Just last month, MSHA cited the mine for 57 safety violations that included repeatedly failing to develop and follow the ventilation plan. Ventilation is vital to prevent the build-up of highly explosive methane gas, which is most likely the cause of the April blast.

Roberts said the Massey mine was cited several times for “failure to abate.”

What does that mean? They were told to do something by the United States government. They said here’s a violation you are being cited for. I’ll be back in five days and this better be corrected. This inspector came back over and over again and they didn’t correct the violations.

Some people, Roberts said, say mining is inherently dangerous and these things will happen and “there’s nothing we can do about it.”

They are damn sure wrong. We need good laws, we need those laws to be obeyed and we need those laws to be enforced and those who fail to obey those laws should be punished.

One of the miners killed, 25-year-old Josh Napper, was concerned about safety, especially ventilation problems at the Upper Big Branch Mine, his mother told CNN reporters after the blast. Roberts said he left a letter for his family before he went to the mine April 5. Napper “left it with his mother and fiancé and his baby fearing he was not going to survive working in this coal mine.”

There is something wrong with this picture. When young men go off to war, they write these kinds of letters, saying how much we love our mothers, our fathers, our wives and our kids. The Mysterious Death of Bush's Cyber-Guru

Shortly before six o’clock on the evening of December 19, 2008, a man standing outside his home in Lake Township, Ohio heard the whine of an engine in the sky above him.

Moments later two red lights broke through the low clouds, heading almost directly toward the ground. It was a light aircraft, and for a second, as it descended below the tree line, the man thought it would climb back up. Instead, there was a terrible thud, and the sky turned orange. When the fire crews arrived, they found the burning wreckage of a Piper Saratoga strewn across a vacant lot. The plane had narrowly missed a house, but the explosion was so intense that the home’s plastic siding was on fire. So was the grass. The pilot had been thrown from the plane and died instantly. Body parts and pieces of twisted metal were scattered everywhere. A prayer book lay open on the ground, its pages on fire.
The crash would have remained a private tragedy confined to the pages of the local press and the hearts of the pilot’s widow and four children, but within days the blogosphere was abuzz with rumors and conspiracy theories: The plane, it was said, had been sabotaged and the pilot murdered to cover up the GOP’s alleged theft of the Ohio vote in the 2004 presidential election. At the center of this plot was the Saratoga’s pilot, a prodigiously gifted IT expert named Michael Connell, whose altar boy charm and technical brilliance had made him the computer whiz of choice for the Republican Party. Left-wing Web sites openly referred to Connell as “Bush’s vote rigger” and claimed that his fingerprints were on all the most controversial elections in recent history. There were dark whispers of electronic pulses or sniper fire being used to bring down the plane—a black ops attack designed to keep him from testifying against his former cronies. Right-wing bloggers and talk show hosts derided such claims as the twisted delusions of liberal nut jobs and tinfoil hatters. The mainstream press sat on its hands.

But while the rumors, innuendos, and allegations continue to swirl through the ether, evidence has recently emerged that suggests the Ohio vote may have been hacked, and that Connell was involved.

Here is what came out in the paper the day after my colleague, friend, and inspiration Albert Cobarrubias was unexpectedly killed in a random act of gun violence. Word for word it read:

“San Jose police are looking for a suspect in the fatal shooting Saturday night of a 30-year-old man, the city's first homicide of the year. At 10:57 p.m., officers responded to a report of shots fired at a home in the 2700 block of Chopin Avenue near Puccini Avenue, in a neighborhood south of Eastridge Mall. Near the garage they found a man with a gunshot wound, San Jose police spokesman Ronnie Lopez said. The man was transported to a local hospital, where he was pronounced dead, Lopez said. Police have not released the victim's name. Police are interviewing people who were gathered at the home and are seeking more witnesses, Lopez said. They have made no arrests.”

Albert was playing pool with friends at a family home, when a strange car stopped in front of the house. Someone got out, walked up the driveway and started shooting. The neighborhood has had a history of senseless, unprovoked, violence.

The newspaper story had a note of who to call at the police department if anyone had information, and in the online version, there was a button to click for an interactive map on crimes in San Jose.
It was a total of 155 words.

I don’t blame the paper for leaving out the remarkable life of Albert in their report; they just didn’t know. What was newsworthy, as indicated by the title, was Albert’s numerical value – the first homicide of the year in San Jose. It is an annual reporting tradition for city papers, like finding out the name of the first baby of the new year.

After being notified that Albert was a graduate of San Jose State University, headed to law school, a former Marine, and a community leader, the media did start to take more notice of his passing, and have been helpful in letting readers know of the person behind the anonymous statistic. But never has it hit me how much is missed in such a common, even routine, marker as "First Homicide of the Year." All across the country this month there were identical headlines as the one we had in San Jose about Albert. Just Google the phrase, and the morbid pattern pops up, showing an understated fraternity of loss that can only grow consistently, every year.

Invariably, in their follow-up interviews they would ask me, ”What was lost with Albert’s death?” I don’t know how to answer that. I am used to writing letters of recommendations for Albert for scholarships, grants, college applications. I am used to describing Albert in anticipation of the great man he would become, rather than reflecting on the great man he was. It should never be that the same words from a scholarship application, the hopeful language of what can possibly be, can also be used in an obituary of what could have been.
