American Apparel CEO Dov Charney has a reputation for being a sex hound, once he famously masturbated in front of a female reporter. "Dirty Dov" has been the subject of multiple sexual harassment lawsuits but none bigger than today's revelation.
What's the story?
A former American Apparel employee has filed a lawsuit alleging that Dov sexually harassed her at work whilst she was still 17. Then, she says, he forced her to come to his apartment to have sex with him on her 18th birthday. According to her lawsuit, Dov answered the door in his underwear and "forced her to her knees so she could pleasure him.""Then he dragged her to the bedroom, threw her on the bed, got on top of her and forced her to perform another act of fellatio, nearly suffocating her in the process," the suit alleges.She was then essentially "held prisoner" in the apartment for several hours during which time he forced her to perform additional sexual acts, according to the lawsuit filed in Brooklyn Supreme Court.The New York Post reports that the woman alleges that Dov "continued to demand sexual service and communications in exchange for her continued employment at American Apparel."Now she's suing him, as well as the company, for a quarter of a billion dollars (although the entire company is currently worth less than $80 million) saying that his actions caused her to suffer an "emotional breakdown."American Apparel has released the following statement: "We have been informed today that Irene Morales, a former employee of American Apparel who left the company without complaint and resigned with a letter of gratitude regarding her positive experience at the company, has filed a sexual harassment lawsuit in New York against the company. Upon her resignation, Ms. Morales acknowledged in writing that she had no pending claims against the company and signed a severance agreement which included a full release of claims and an agreement to submit any future claims to confidential binding arbitration. All American Apparel's employees are subject to the same confidential arbitration agreement signed by Ms. Morales in order to protect the privacy interests of employees and former employees, and to prevent predatory plaintiffs and their attorneys from attempting to use the media to extort the company. Such an arbitration process was initiated by the company against Ms. Morales several weeks ago. The company intends to file a formal complaint with the NY state bar seeking disciplinary action against Ms. Morales' lawyers who we believe are engaged in an illegal conspiracy to extort money from American Apparel. Troubled clothing chain American Apparel Inc. is at risk of becoming American history. The company said on Tuesday that ‘it might not have enough liquidity to sustain itself over the next year.’
Shares of the racy retailer – whose CEO Dov Charney has stirred controversy for his libertine lifestyle – lost 30 percent of their value yesterday after the company said it may breach a key credit agreement at the end of next month (by Sept. 30) as sales and profits continue to dwindle.
American Apparel also said that it’s working with a lender to amend the agreement, but cautioned that without a reprieve, there may be a damaging financial chain reaction that could force the company to pay both credit lines immediately.
Known as much for its racy ads and outre behavior of CEO Dov Charney as its inexpensive leggings and T-shirts, American Apparel has expanded rapidly since going public in 2007 and operates about 260 stores in 19 countries.

Things have gone from bad to worse for the pants-optional C.E.O. and his t-shirt company. To put it nicely, it's highly probable that the retailer will go bankrupt — and soon. Bluntly: American Apparel is probably fucked. Here's why.
To get a sense of just how fucked, allow me to explain how relative levels of fucked-ness are calculated, in retail. "Same-store" sales or "comparable store" sales are sales figures retailers report from stores open 12 months or longer, and these results are considered a key indicator of retail health for two reasons. Firstly, just measuring a brand's overall sales without distinguishing between sales at newly opened stores and sales at existing stores camouflages the huge start-up costs incurred by store openings. Secondly, if it's the case that a retailer has over-saturated its market, if it then persists in opening new stores, those new stores can actually cannibalize sales from its older outlets. Just measuring "sales" is misleading if you had 223 stores in 2009 and 190 in 2008, because 223 stores will move a lot more product than 190 stores, almost no matter what; while overall sales growth is important, you also need to measure how those same 190 stores fared year-on-year.
American Apparel, as it turns out, has experienced declining year-on-year same-store sales in every month for which the company has made records available since February, 2009. In that month, comps fell by 9%. In March, they were down 11%. April's same-store sales fell 7%; the following month the decline was 10%; the month after that, 13%; the month after that, same-store sales fell 13% again. Then, in August, same-store sales fell 20%. The month after that, they were down 15%. The next month, they fell 6%; the month after that, the decline was 11%; American Apparel wrapped up its horror year with a decline in same-store sales of 6% during the month of December.
As for 2010's numbers, official results aren't even yet available for the first three months of this year, because American Apparel wasn't ready to file by the Securities and Exchange Commission's deadline. The SEC gave Charney's company until August 16 to tell investors how it did in the months of January, February, and March of this year. (As one financial writer quipped, "I guess we'll get Q2 around Christmas.") American Apparel's preliminary first-quarter report showed a decline in same-store sales of 10%, and an operations loss of $17.6 million during the period. (Comparatively, the $3.6 million it lost in the first quarter of 2009 seems small.) There's no reason to believe the company has experienced any miraculous reversal of fortune in the intervening months. 2009 was a bad year for retail, and American Apparel wasn't the only company to experience months of successive year-on-year declining comps — Abercrombie & Fitch was also left reeling for a long spell — but Charney's baby did perform a lot worse than almost all of its competitors. (Even Abercrombie eventually made a hesitant reversal.)
Meanwhile, the company is struggling to manage the mountain of debt it took on during the boom years, when it signed dozens of leases at the height of the real-estate bubble and more than occasionally hired 17-year-old high school drop-outs Charney took a shine to to "manage" the new stores. The company was forced to admit that it would default on its $80 million revolving credit if it didn't renegotiate with the lender, Lion Capital. For now, American Apparel is apparently worth more to its creditors as a going concern than as a bankruptcy, so Lion decided to work with the the company. But American Apparel's interest rate did rise from 15% to 17% when it restructured its loans. And that still leaves open the question of what will happen should its creditors — supermarket billionaire Ron Burkle is now among them — ever change their minds about American Apparel's salvagability.
Yesterday, its auditing firm, Deloitte & Touche, announced it would no longer be working with the retailer because, according to an SEC filing, "Deloitte identified material weaknesses in [American Apparel's] internal control over financial reporting...and advised that the Company has not maintained effective internal control over financial reporting," and because information had come to Deloitte's attention that "may materially impact the reliability of either its previously issued audit report or the underlying consolidated financial statements." Deloitte said more investigation would be needed "before the Company and Deloitte can reach any conclusions as to the reliability" of its financial reports for 2009.
This news sent the stock price tumbling to near-52-week lows.

People love going to the Apple Store on Fifth Avenue in Manhattan. It's in a perfect location for tourists visiting Central Park. It also seems like the perfect 'on-location' shoot for online video producers. (Maybe it's because they have all the equipment ready to use in the store.)

According to Gawker.com, breathtakingly handsome American Apparel CEO, Dov Charney (pictured), only wants good-looking people working for him and "is demanding the firing of employees he deems unattractive and thus detrimental to the 'AA aesthetic,'" as he allegedly blames them for falling sales.
In an email they received from an anonymous tipster who claims to be an American Apparel shop manager, it's claimed that Charney asked global store managers to send him pictures of their staff "so that he could personally judge people based on looks. He is tightening the AA 'aesthetic,' and anyone that he deems not good-looking enough to work there, is encouraged to be fired. This is blatant discrimination based on looks."

Perhaps it's not as iconic a still life as the cop-shattered storefront window with the big Huey Newton poster in it. But the image of an American Apparel shop's plate glass, smashed because it displayed a pro-gay marriage T-shirt, should give us pause. The incident happened this week at a suburban Washington, D.C. store in Silver Springs, MD, and was followed by death threats phoned to employees of the Georgetown American Apparel store. At the center of the storm is a company-made T-shirt whose lettering proclaims, "Legalize Gay . . . Repeal Prop 8 Now!" -- a reference to last November's successful ballot measure that overturned the right of same-sex couples to marry in California. American Apparel was recently attacked in Maryland because of their legalize gay display. They are standing up to this attack by offering free "Legalize Gay" t-shirts to equality supporters in the DC area. They also are offering free shirts to any group in Washington DC fighting for gay rights and offer their support any protest or rally for the cause.
