Supreme Court Vacates Federal Circuit Decision Allowing Biotech Co. to Patent Human DNA
As a follow up to the Supreme Court’s March 20, landmark unanimous 9-0 decision in Mayo v. Prometheus, on Monday, March 26, the Supreme Court unsurprisingly vacated the Federal Circuit Court’s decision to allow a biotech company to patent human DNA in the case AMP v. Myriad Genetics. The case has been remanded back to the federal circuit and is to be decided in accordance with the “a newly discovered law of nature is itself unpatentable and the application of that newly discovered law is also normally unpatentable if the application merely relies upon elements already known in the art,” standard that was set out in Mayo v. Prometheus.

The Supreme Court today [March 26] vacated the Federal Circuit's decision in AMP v. Myriad Genetics and has ordered the appellate court to reconsider the case in light of the recent Supreme Court decision in Mayo v. Prometheus. To be clear, the Supreme Court's move here is not a ruling on the merits but rather merely a recognition that the validity of Myriad's human gene patents may be impacted by the Mayo decision. I previously wrote that one reasoned result of the Mayo decision is that Myriad's claims directed toward isolated human DNA are now invalid.
Following Mayo, the court could logically find that the information in the DNA represents a law of nature, that the DNA itself is a natural phenomenon, that the isolation of the DNA simply employs an isolation process already well known and expected at the time of the invention, and ultimately that the isolated DNA is unpatentable because it effectively claims a law of nature or natural phenomenon. One distinguishing point is that Prometheus claimed a process while Myriad claims a composition of matter. As we have seen in recent cases, the Federal Circuit already largely rejects formalistic distinctions between process and composition claims. Here, that distinction is further minimized by the reality that the claimed DNA is functionally characterized by the already well known process of isolating human DNA.

Supreme Court: Biotech Industry Can't Patent A Newly Discovered Law of Nature and its Appliction
Biotech industry scrambles. While not a party to the case, the ruling has potentially huge implications for biotech giant, Monsanto. The case Mayo Collaborative Services v. Prometheus Laboratories, Inc. was decided Tuesday, March 20, 2012.

A unanimous (9–0) Supreme Court has held that the personalized medicine dosing process invented by Prometheus is not eligible for patent protection because the process is effectively an unpatentable law of nature. This decision reverses the Court of Appeals for the Federal Circuit's holding that the claims were patentable because they included substantial physical limitations.
The Prometheus invention identifies a “relationships between concentrations of certain metabolites in the blood and the likelihood that a dosage of a thiopurine drug will prove [either] ineffective or cause harm. Claim 1, for example, states that if the levels of 6–TG in the blood (of a patient who has taken a dose of a thiopurine drug) exceed about 400 pmol per 8x10(8) red blood cells, then the administered dose is likely to produce toxic side effects.” In addition to claiming the boundaries between over and under dosage of thiopurine based upon measuring 6–TG in the blood, some of the Prometheus claims include additional limitations such as (1) administering thiopurine to a patient and (2) determining the blood level of 6–TG.
Law of Nature: In its decision, the Supreme Court first identified the correlation between 6–TG blood levels and over/under thiopurine dosage as an unpatentable law of nature.
The relation is a consequence of the ways in which thiopurine compounds are metabolized by the body—entirely natural processes. And so a patent that simply describes that relation sets forth a natural law.
As is usual in these cases, the Court referenced the groundbreaking discoveries by Einstein and Newton and noted that neither “E=mc²” nor the “law of gravity” would have been subject matter eligible. Taking that as a premise, the court jumped to the conclusion that, therefore, the discovery that the blood level of 6–TG in a human correlates with either an overdose or underdose of thiopurine is also subject matter ineligible.
Additional Elements: The Supreme Court then considered the additional limitations and held them insufficient to transform the identified natural law into a patentable process. The opinion repeatedly and favorably cites Parker v. Flook, 437 U. S. 584 (1978) in finding that the physical and transformative elements of the invention were not “genuine applications of those laws[, but] rather .. drafting efforts designed to monopolize the correlations.” As to the claimed application of the law of nature, court here found it relevant and important that the additional steps were already known in the art.
Because methods for making such determinations were well known in the art, this step simply tells doctors to engage in well-understood, routine, conventional activity previously engaged in by scientists in the field. Such activity is normally not sufficient to transform an unpatentable law of nature into a patent-eligible application of such a law.
The conclusion here is that (1) a newly discovered law of nature is itself unpatentable and (2) the application of that newly discovered law is also normally unpatentable if the application merely relies upon elements already known in the art. To be clear, the court still maintains the law of Diehr that “an application of a law of nature or mathematical formula to a known structure or process may well be deserving of patent protection.” On the other hand, the “application” must be “significant,” not “too broadly preempt” use of the law, and include other elements that constitute an “inventive concept” that is significant and separate from the natural law itself. Of note, it is likely important that in this decision the court unfavorably cites the limitation of Flook found in Diehr that eligibility under § 101 “must be” based on claims “considered as a whole.”
Process and Presumption: In addition to the legal elements, the decision can be read to create a process for determining patent eligibility for patent claims that include a law of nature. The court wrote that the “additional features” that show an application of the law must “provide practical assurance that the [claimed] process is more than a drafting effort.” This language suggests that the burden will be on the patentee to prove that its limitations are more than patent attorney tricks.
Whither Myriad: Although no action has been taken yet, I presume that the Supreme Court will now vacate and remand the pending Myriad case with instructions to the Federal Circuit to reconsider its holding that isolated human DNA is patentable. ...

Denialgate - Internal Heartland Documents Expose Climate Denial Funding Network
The Heartland Institute has confirmed in a prepared statement that it mistakenly emailed its board materials to an anonymous third party - confirming the source of the documents released here on the DeSmogBlog yesterday.
Heartland then goes on allege that one of the documents (the Climate Strategy) is a fake.
The DeSmogBlog has reviewed that Strategy document and compared its content to other material we have in hand. It addresses five elements:
The Increased Climate Project Fundraising material is reproduced in and confirmed by Heartland's own budget.
The "Global Warming Curriculum for K-12 Classrooms" is also a Heartland budget item and has been confirmed independently by the author, Dr. David Wojick.
The Funding for Parallel Organizations; Funding for Selected Individuals Outside Heartland are both reproduced and confirmed in the Heartland budget. And Anthony Watts has confirmed independently the payments in Expanded Climate Communications.
The DeSmogBlog has received no direct communications from the Heartland Institute identifying any misstatement of fact in the "Climate Strategy" document and is therefore leaving the material available to those who may judge their content and veracity based on these and other sources.

Heartland Insider Exposes Institute's Budget and Strategy
An anonymous donor calling him (or her)self "Heartland Insider" has released the Heartland Institute's budget, fundraising plan, its Climate Strategy for 2012 and sundry other documents (all attached) that prove all of the worst allegations that have been levelled against the organization.
It is clear from the documents that Heartland advocates against responsible climate mitigation and then uses that advocacy to raise money from oil companies and "other corporations whose interests are threatened by climate policies." Heartland particularly celebrates the funding that it receives from the fossil fuel fortune being the Charles G. Koch Foundation.
Heartland also continues to collect money from Philip Morris parent company Altria as well as from the tobacco giant Reynolds American, while maintaining ongoing advocacy against policies related to smoking and health.
Heartland's policy positions, strategies and budget distinguish it clear as a lobby firm that is misrepresenting itself as a "think tank" - it budgets $4.1 million of its $6.4 million in projected expenditures for Editorial, Government Relations, Communications, Fundraising, and Publications, and the only activity it plans that could vaguely be considered policy development is the writing of a curriculum package for use in confusing high schoolers about climate change.
There will be more comment and analysis to follow on DeSmogBlog and elsewhere, but we wanted to make this information available so that others can also scrutinize the documents and bring their expertise to the task.

Heartland Institute Exposed: Internal Documents Unmask Heart of Climate Denial Machine
Internal Heartland Institute strategy and funding documents obtained by DeSmogBlog expose the heart of the climate denial machine – its current plans, many of its funders, and details that confirm what DeSmogBlog and others have reported for years. The heart of the climate denial machine relies on huge corporate and foundation funding from U.S. businesses including Microsoft, Koch Industries, Altria (parent company of Philip Morris) RJR Tobacco and more.
We are releasing the entire trove of documents now to allow crowd-sourcing of the material. Here are a few quick highlights, stay tuned for much more. -Confirmation that Charles G. Koch Foundation is again funding Heartland Institute’s global warming disinformation campaign. Greenpeace’s Koch reports show the last time Heartland received Koch funding was in 1999.
The January 2012 Confidential Memo: 2012 Heartland Climate Strategy states:
“We will also pursue additional support from the Charles G. Koch Foundation. They returned as a Heartland donor in 2011 with a contribution of $200,000. We expect to push up their level of support in 2012 and gain access to their network of philanthropists, if our focus continues to align with their interests. Other contributions will be pursued for this work, especially from corporations whose interests are threatened by climate policies.”
-Heartland Institute’s global warming denial machine is chiefly – and perhaps entirely – funded by one Anonymous donor:
“Our climate work is attractive to funders, especially our key Anonymous Donor (whose contribution dropped from $1,664,150 in 2010 to $979,000 in 2011 - about 20% of our total 2011 revenue). He has promised an increase in 2012…”
-Confirmation of exact amounts flowing to certain key climate contrarians.
“funding for high-profile individuals who regularly and publicly counter the alarmist AGW message. At the moment, this funding goes primarily to Craig Idso ($11,600 per month), Fred Singer ($5,000 per month, plus expenses), Robert Carter ($1,667 per month), and a number of other individuals, but we will consider expanding it, if funding can be found.”
-As Brad Johnson reported today at ThinkProgress, confirmation that Heartland is working with David Wojick, a U.S. Energy Department contract worker and coal industry consultant, to develop a ‘Global Warming Curriculum for K-12 Schools.’
-Forbes and other business press are favored outlets for Heartland’s dissemination of climate denial messages, and the group is worried about maintaining that exclusive space. They note in particular the work of Dr. Peter Gleick:
“Efforts at places such as Forbes are especially important now that they have begun to allow high-profile climate scientists (such as Gleick) to post warmist science essays that counter our own. This influential audience has usually been reliably anti-climate and it is important to keep opposing voices out.” (emphasis added)
Note the irony here that Heartland Institute – one of the major mouthpieces behind the debunked ‘Climategate’ email theft who harped about the suppression of denier voices in peer-reviewed literature – now defending its turf in the unscientific business magazine realm.
-Interesting mentions of Andrew Revkin as a potential ally worth “cultivating,” along with Judith Curry.
“Efforts might also include cultivating more neutral voices with big audiences (such as Revkin at DotEarth/NYTimes, who has a well-known antipathy for some of the more extreme AGW communicators such as Romm, Trenberth, and Hansen) or Curry (who has become popular with our supporters).”
-Confirmation that skeptic blogger Anthony Watts is part of Heartland’s funded network of misinformation communicators.
“We have also pledged to help raise around $90,000 in 2012 for Anthony Watts to help him create a new website to track temperature station data.”

Bill Gates Exposed for Funding Geo-Engineering, Chemtrails
(NaturalNews) The latest scam to enter the debate about so-called "global warming" involves spending billions of dollars to spray the atmosphere with tiny particulate matter for the alleged purpose of reflecting sunlight back into space, and thus cooling the planet. But research into this controversial practice of "chemtrailing," which has actually already been going on for quite some time now, is largely funded directly by Mr. Vaccine himself, the infamous Bill Gates.
The U.K.'s Guardian paper reports that Gates, who is a huge advocate of global intervention programs that forcibly affect large people groups whether they like it or not, has been spending untold millions of dollars from his own personal fortune to fund research into geo-engineering programs. These funds are being used to study things like how much it will cost every year to blast the skies with tiny particles of sulfur dioxide, a toxic industrial byproduct linked to serious respiratory illnesses like asthma (http://www.epa.gov/air/sulfurdioxide/).
Gates and his small cadre of allies, which include co-founder of Skype Niklas Zennstrom and owner of the Virgin Group Sir Richard Branson, reportedly spend exorbitant amounts of cash every year trying to push geo-engineering initiative across the globe. They claim that if nations like the U.S. will not cut greenhouse gas emissions by tremendous amounts, the spraying of toxic poisons into the atmosphere will be necessary to thwart impending disaster.
The entire concept of geo-engineering to save the planet is utter hogwash, of course. This is true not only because "global warming" itself has proven to be a man-made scam, but also because literally blocking sunlight for the stated purpose of reflecting the warmth of its rays back into space makes no logical or scientific sense.
Geo-engineering does, however, give unprecedented control over the world's weather patterns to a select few, allowing them to manipulate the environment for their own gain in the name of saving the planet. And blocking the sun's rays with tiny particles also serves much more sinister purposes like preventing humans from absorbing much-needed ultraviolet B (UVB) rays from the sun, which are responsible for producing vitamin D in the body (http://www.vitamindcouncil.org/).
But while chemtrail advocates like Bill Gates act as though these poison plumes are a potential future intervention, evidence already points to the fact that chemtrails have already been in use for many years now. Bill Gates backs climate scientists lobbying for large-scale geoengineering
A small group of leading climate scientists, financially supported by billionaires including Bill Gates, are lobbying governments and international bodies to back experiments into manipulating the climate on a global scale to avoid catastrophic climate change.
The scientists, who advocate geoengineering methods such as spraying millions of tonnes of reflective particles of sulphur dioxide 30 miles above earth, argue that a "plan B" for climate change will be needed if the UN and politicians cannot agree to making the necessary cuts in greenhouse gases, and say the US government and others should pay for a major programme of international research.
Solar geoengineering techniques are highly controversial: while some climate scientists believe they may prove a quick and relatively cheap way to slow global warming, others fear that when conducted in the upper atmosphere, they could irrevocably alter rainfall patterns and interfere with the earth's climate.
Geoengineering is opposed by many environmentalists, who say the technology could undermine efforts to reduce emissions, and by developing countries who fear it could be used as a weapon or by rich countries to their advantage. In 2010, the UN Convention on Biological Diversity declared a moratorium on experiments in the sea and space, except for small-scale scientific studies.
Concern is now growing that the small but influential group of scientists, and their backers, may have a disproportionate effect on major decisions about geoengineering research and policy.
"We will need to protect ourselves from vested interests [and] be sure that choices are not influenced by parties who might make significant amounts of money through a choice to modify climate, especially using proprietary intellectual property," said Jane Long, director at large for the Lawrence Livermore National Laboratory in the US, in a paper delivered to a recent geoengineering conference on ethics.
"The stakes are very high and scientists are not the best people to deal with the social, ethical or political issues that geoengineering raises," said Doug Parr, chief scientist at Greenpeace. "The idea that a self-selected group should have so much influence is bizarre."
Pressure to find a quick technological fix to climate change is growing as politicians fail to reach an agreement to significantly reduce emissions. In 2009-2010, the US government received requests for over $2bn(£1.2bn) of grants for geoengineering research, but spent around $100m.
As well as Gates, other wealthy individuals including Sir Richard Branson, tar sands magnate Murray Edwards and the co-founder of Skype, Niklas Zennström, have funded a series of official reports into future use of the technology. Branson, who has frequently called for geoengineering to combat climate change, helped fund the Royal Society's inquiry into solar radiation management last year through his Carbon War Room charity. It is not known how much he contributed.
Professors David Keith, of Harvard University, and Ken Caldeira of Stanford, are the world's two leading advocates of major research into geoengineering the upper atmosphere to provide earth with a reflective shield. They have so far received over $4.6m from Gates to run the Fund for Innovative Climate and Energy Research (Ficer). Nearly half Ficer's money, which comes directly from Gates's personal funds, has so far been used for their own research, but the rest is disbursed by them to fund the work of other advocates of large-scale interventions.
According to statements of financial interests, Keith receives an undisclosed sum from Bill Gates each year, and is the president and majority owner of the geoengineering company Carbon Engineering, in which both Gates and Edwards have major stakes – believed to be together worth over $10m.
Another Edwards company, Canadian Natural Resources, has plans to spend $25bn to turn the bitumen-bearing sand found in northern Alberta into barrels of crude oil. Caldeira says he receives $375,000 a year from Gates, holds a carbon capture patent and works for Intellectual Ventures, a private geoegineering research company part-owned by Gates and run by Nathan Myhrvold, former head of technology at Microsoft.
According to the latest Ficer accounts, the two scientists have so far given $300,000 of Gates money to part-fund three prominent reviews and assessments of geoengineering – the UK Royal Society report on Solar Radiation Management, the US Taskforce on Geoengineering and a 2009 report by Novin a science thinktank based in Santa Barbara, California. Keith and Caldeira either sat on the panels that produced the reports or contributed evidence. All three reports strongly recommended more research into solar radiation management.
The fund also gave $600,000 to Phil Rasch, chief climate scientist for the Pacific Northwest national laboratory, one of 10 research institutions funded by the US energy department.

Bill Gates once again shilling for Monsanto using climate change as his excuse
Bill Gates is one very confused billionaire philanthropist.
He understands global warming is a big problem — indeed, his 2012 Foundation Letter even frets about the grave threat it poses to food security. But he just doesn’t want to do very much now to stop it from happening (see Pro-geoengineering Bill Gates disses efficiency, “cute” solar, deployment — still doesn’t know how he got rich).
He love technofixes like geoengineering and, as we’ll see, genetically modified food. Rather than investing in cost-effective emissions reduction strategies today or in renewable energy technologies that are rapidly moving down the cost curve, he explains that the reason invests so much in nuclear R&D is “The good news about nuclear is that there has hardly been any innovation.” Seriously!
His Letter includes the ominous chart at the top, and he warns of the dire consequences of climate change:
Meanwhile, the threat of climate change is becoming clearer. Preliminary studies show that the rise in global temperature alone could reduce the productivity of the main crops by over 25 percent. Climate change will also increase the number of droughts and floods that can wipe out an entire season of crops. More and more people are raising familiar alarms about whether the world will be able to support itself in the future, as the population heads toward a projected 9.3 billion by 2050.
Strong stuff.
And yet, as the AP reported this week, the wealthiest of all Americans gets very prickly if you don’t wholeheartedly endorse his techno-fix adaptation-centric approach to dealing with this oncoming disaster:
Bill Gates has a terse response to criticism that the high-tech solutions he advocates for world hunger are too expensive or bad for the environment: Countries can embrace modern seed technology and genetic modification or their citizens will starve….
The Bill & Melinda Gates Foundation has spent about $2 billion in the past five years to fight poverty and hunger in Africa and Asia, and much of that money has gone toward improving agricultural productivity.Gates doesn’t apologize for his endorsement of modern agriculture or sidestep criticism of genetic modification. He told The Associated Press that he finds it ironic that most people who oppose genetic engineering in plant breeding live in rich nations that he believes are responsible for global climate change that will lead to more starvation and malnutrition for the poor.
Resistance to new technology is “again hurting the people who had nothing to do with climate change happening,” Gates said.
The real irony is that most people who diss efficiency and renewables and aggressive greenhouse gas mitigation, like Gates, live in rich nations that are responsible for global climate change that will lead to more starvation and malnutrition for the poor.
Where is the story that says, “countries to embrace existing technology to reduce emissions or their citizens will starve” or resistance to aggressive low carbon technology deployment is “again hurting the people who had nothing to do with climate change happening”?
This is not a blog on genetic modification, so I’ll just quote the AP story:
Bill Freese, a science policy analyst for the Washington-based Center for Food Safety, said everyone wants to see things get better for hungry people, but genetically modified plants are more likely to make their developers rich than feed the poor. The seed is too expensive and has a high failure rate, he said. Better ways to increase yields would be increasing the fertility of soil by adding organic matter or combining plants growing in the same field to combat pests, he said.
The biggest problem with those alternatives, Freese said, is the same one that Gates cited in high-tech research: A lack of money for development.

Monsanto Investor Bill Gates Says GMO Crops Needed to Fight Starvation
Bill Gates, the heavy Monsanto investor who purchased 500,000 shares of the biotech giant in 2010, has been toting Monsanto’s genetically modified creations as a tool that is necessary to prevent starvation in poor nations. The same poor nations where thousands of farmers routinely commit suicide after being completely bankrupt by Monsanto’s overpriced and ineffective GM seeds. The same company that we recently exposed to be running ‘slave-like’ working conditions, forcing poor workers to operate the corn fields for 14 hours per day while withholding pay.
According to Gates, this is the company whose GMO crops are going to save the world from starvation. A prominent review of 19 studies examining the safety of these crops found that consumption of GMO corn or soybeans can lead to significant organ disruptions in rats and mice – particularly in the liver and kidneys....

I find it fascinating that Hallmark, a greeting card company that usually churns out feel-good blessings and warm fuzzy limericks is now openly advocating chemicals that kill babies.

But of course, we know the real agenda of pushing vaccines to new moms in Arizona. I lived in Tucson for many years and I've seen the local politics at work. Arizona is a state that's overrun by the financial costs of providing medical care to so-called "illegals" -- undocumented residents who pay little or no taxes but often burden the state's coffers for hospital expenditures.
What I see in this Hallmark vaccine shot propaganda card is an effort to promote widespread infertility across the Latino population of Arizona. Calif. schools turn away unvaccinated students
SAN FRANCISCO (AP) - Some California schools are turning away middle and high school students who have not received a required whooping cough vaccine while others are defying a law passed last year after a historic spike in cases of the potentially fatal disease.
The law approved last September initially required all students entering grades seven through 12 to get vaccinated by the start of the 2011-2012 school year. Lawmakers passed a 30-day extension this summer as districts worried many students wouldn't meet the deadline.
Under California law, students also can still attend if their parents file a form saying they oppose vaccines.
No statewide estimates of the number of students turned away is available because districts are not required to report their final vaccination tally until December, state education and public health officials said.
But anecdotal reports from individual districts indicate the percentage of students meeting the requirement varied widely, from about half of students to nearly all.
"We've done a tremendous amount of outreach with the schools trying to let them know," said Linda Davis-Alldritt, the school nurse consultant for the education department.
On Thursday, San Francisco Unified School District began sending home students who arrived without proof of vaccination or a parental personal belief exemption.
District spokeswoman Heidi Anderson said the district estimates about 2,000 students, or 10 percent of the student body, are still unvaccinated. The district held a free vaccination clinic at its offices Thursday and was providing shots at individual schools Friday.
District officials were optimistic that most students would be able to return to class soon.
"We're getting down to it," Anderson said.
The Folsom Cordova Unified School District hit the extended deadline Friday for having all students immunized. Mary Ann Delleney, director of health programs for the district, said about 2,250 students who have yet to get vaccinated won't be turned away.
"We will not withhold education for students, but we will make every effort that we possibly can to be in compliance with state law," she said. The district had 70 whooping cough cases last year, she said.
In the Natomas Unified School District in Sacramento, about 1,100 students hadn't received their immunization shots by Thursday night, said Janet Handley, the assistant supervisor of education services. The district's 30-day extended deadline ended Friday.
Students who show up Monday without proof of their immunization will be sent to the school's gymnasium for study hall, Handley said. The students who are sequestered into the gym will not count toward the district's attendance-based funding for those students on those days, she said. Schools in California lose money for each absence.
"We're trying to balance how to get the message out that they need to get the shot, and we also need them at school," Handley said.
Natomas High School hosted a free clinic after school Friday, where a line of students curled around the gym where nurses were administering shots. Many said they hadn't heard of the immunization requirement until this week, despite what health and education officials described as a barrage of information sent to parents, students and schools.
Jake Terry, a 12-year-old at NP3, a charter middle school in Sacramento, said he first heard about the shot requirement on the news.
"I'm scared about the needle's size," he said.
State education officials said allowing unvaccinated students on school premises at all broke state law, but that the education department had no power to sanction defiant districts.
Allowing unvaccinated students to come to school also puts the students themselves and others exempted from the vaccine for medical or personal reasons at greater risk, said John Talarico, chief of immunization for the California Department of Public Health.
"If one of them gets it and they're all together, you now have a whole pool of susceptible people," Talarico said.
San Diego Republican Assemblyman Nathan Fletcher, a co-author of the law, said students who haven't been vaccinated shouldn't be at school at all, regardless of the funding or instruction children might miss.
"This is not an academic or philosophical discussion. Children have died as a result of this. We took very seriously our obligation to protect children so I think school districts need to take seriously the obligations to comply with it," he said.
The vaccination mandate covers about 3 million public and private school students who public health officials say have lost much of their immunity since receiving their original immunization against whooping cough before entering kindergarten.
California saw more than 9,000 whooping cough cases diagnosed in 2010, the highest number in the state since 1947. Ten infants too young to receive the vaccine died from the illness. About 2,400 cases have been diagnosed so far in 2011, but the state has seen no fatalities.
The highest percentage of California students entered kindergarten last year in more than 30 years under a California law that allows parents to exempt their children from vaccines for philosophical or religious reasons, according to state health records. About 3 percent of incoming kindergartners received either a personal belief or medical exemption from state vaccine requirements.
Health officials said there was no firm link between lower vaccination rates and the rise in whooping cough cases. The vaccine's effectiveness also wears off over time and doesn't work for all people, Talarico said.

Gates Foundation Partner in Malawi Vaccinates 131 Children At Gunpoint
The Gates Foundation has long been in an aggressive effort to vaccinate the world and often targets poor Africans. The Gates’ web site showcases Melinda Gates applauding Malawi for enforcing vaccine programs with its helpful “health surveillance assistants.”
She calls Malawi one of the few countries “on track to reach the UN Millennium Development Goal.” And who are those assistants meeting the goal? Hyper-vigilant medics with help from police.

131 Children Vaccinated At Gunpoint in Nsanje
About 131 children from Nsanje who fled into neighboring Mozambique during the anti measles vaccine a few months ago were vaccinated this week at gunpoint.
The children, belonging to Zion and Atumwi Churches were takein into Mozambique by their parents to hide them from officials fearing they might get vaccinated.
According to Dr Medison Matchaya District Health Officer for Nsanje, medics went to vaccine the children in Nsanje under police escort.
"We were alerted that some children who were hiding in Mozambique were back in the country and we asked police to escort the health officials in order to vaccinate them and we have managed to vaccinate about 131 children," said Machaya.
