The recession torpedoed the restaurant industry, forcing stalwart chains like Bennigans and Steak & Ale to file for bankruptcy and shut their doors. But maybe they would have escaped this fate if they had just put their waitresses in skimpier outfits.
As Candice Choi of the Associated Press reported, according to new data from Technomic, a food industry research firm, “the nation’s top three ‘breastaurant’ chains behind Hooters each had sales growth of 30 percent or more last year.” One of those establishments, Addison-based Twin Peaks, saw sales increase to $44 million, a 35 percent jump from the previous year.
What is a breastaurant? Choi describes it as “sports bars that feature scantily clad waitresses,” a concept made popular in the eighties by Hooters, the most famous breastaurant in the industry. Like Hooters, Twin Peaks’s waitresses wear barely-there costumes, a red-and-black plaid crop top and short khaki shorts, in keeping with the chain’s hunter’s lodge theme.
This booming success for the up-and-coming breastaurants is bad news for Hooters, which has experienced, ahem, sagging revenue—sales have fallen from their 2007 peak of $960 million. But this is not the first time the pioneering breastaurant has come under attack from a competitor. In August 2011, Coby Brooks, former Hooters CEO, jumped ship to Twin Peaks to be a “megafranchisee,” agreeing to open 35 of the restaurants in ten states over the next ten years. (Breastaurants appear to be in Brooks’s blood: his father, Bob Brooks, expanded the chain to 425 restaurants during his time as CEO.) Hooters also filed a lawsuit against the company developing Twin Peaks in September 2011, claiming Joseph Hummel, a former Hooters vice president that also left for Twin Peaks, took “sensitive business information” to the company.

The two members of the Air National Guard who appeared in the controversial photo, Terran Echegoyen-McCabe and Christina Luna have been reprimanded because the photo "violated a policy that forbids military members from using the uniform to further a cause, promote a product or imply an endorsement," the Air Force Times reported.
"The uniform was misused. That's against regulations," Captain Keith Kosik, a spokesman for the Washington National Guard, told the Air Force Times. "I want to be very, very clear about this. Our issue is not, nor has it ever been, about breastfeeding. It has to do with honoring the uniform and making sure it's not misused. I can't wear my uniform to a political rally, to try to sell you something or push an ideology. That was our point of contention." This is the picture that led the FBI to a catch prolific hacker allegedly responsible for releasing the personal information of scores of police officers throughout the United States.
Higinio O. Ochoa III has been charged with illegally hacking into at least four U.S. law enforcement websites - feats he allegedly boasted about across social networking sites.
And it was this image - snapped in Australia - of his scantily-clad girlfriend holding a message taunting U.S. authorities that caught the 30-year-old computer programmer from Galveston, Texas.
The FBI said it confirmed the identity of Ochoa, who calls himself 'w0rmer' online and is a member of 'CabinCr3w', an offshoot of hacking group Anonymous.
In February, Ochoa's alleged Twitter account, @AnonW0rmer, linked to a website where the data taken from law enforcement websites was displayed, The Sydney Morning Herald reported.
At the bottom of the website, there was the picture of the woman wearing the sign. Data taken from that picture showed it was taken by an iPhone, according to the FBI.
GPS co-ordinates embedded in the photo - as are found in all pictures taken by a smartphone - showed authorities the exact street and house in Wantirna South, Melbourne where it was taken.
Different tweets from @Anonw0rmer pointed to other sites referring to 'w0rmer', including one which had Ochoa's name with it and more pictures of his girlfriend.
Authorities then found Ochoa's Facebook page, on which he named Kylie Gardner from Australia as his girlfriend. The FBI was then satisfied she was the woman in the photo taken in South Wantirna.
Even though the breasts photo does not show the woman's face, the FBI is convinced it is the same woman. They add it is definitive proof that Ochoa is w0rmer.
After tracking him down and putting him under surveillance, authorities stormed Ochoa's house on March 20 and arrested him.
In a post allegedly written by Ochoa on Pastebin, he said 'around 8 agents from the FBI stormed my apartment'. He was taken to an FBI office in Houston where he paid a $50,000 bail.
Ochoa appeared in court on April 10 before a magistrate, where the photograph evidence above was revealed in the FBI's affidavit.
It comes a month after former Lulzsec leader and Anonymous member Sabu was revealed as an FBI informant. But in the Pastebin post, Ochoa claimed he was not guilty of the same betrayal.
He wrote: 'I did tell FBI that I would participate in the capture of my fellow crew mates, a play which undoubtfully both satisfied and confused the FBI.
'Those however who know me best would vouch for me undoutfully that doing so would put this movement at risk.
'ALL information provided to the FBI merely made MY case weaker and caused internal confusion showing the inherent weakness in the system.'
Ochoa allegedly hacked the County of Houston's website in Alabama and 'created fake events on their online, posted images representing Anonymous and CabinCr3w, deleted all the administrator accounts except the one created by the attacker'.
CabinCr3w was also responsible for leaking email address and confidential information from Goldman Sachs executives in September 2011, Gizmodo reported.
In February, the group infiltrated the Los Angeles County Police Canine Association database, and leaked names, addresses and phone numbers of more than 100 police officers.

When a retired fisherman called to report that about 1,500 dolphins had washed up dead on Peru’s northern coast, veterinarian Carlos Yaipén’s first reaction was, “That’s impossible.” But when Yaipén traveled up the coast last week, he counted 615 dead dolphins along a 135-kilometer stretch of coastline. Now, the death toll could be as high as 2,800, based on volunteers’ counts. Peru's massive dolphin die-off is among the largest ever reported worldwide. The strandings, which began in January, are a marine mystery that may never be unraveled. The causes could be acoustic impact from testing for oil or perhaps an unknown disease. A recently published study by the Wildlife Conservation Society and others reveals that humpback whales on both sides of the southern Indian Ocean are singing different tunes, unusual since humpbacks in the same ocean basin usually all sing very similar songs.
The results of the study—conducted by researchers from WCS, Columbia University, and Australia —contradict previous humpback whale song comparisons. Generally, when song from populations in the same ocean basins are compared, researchers find that the songs contain similar parts or "themes." The differences in song between the Indian Ocean humpback populations most likely indicate a limited exchange between the two regions and may shed new light on how whale culture spreads.
The paper appears in the January edition of Marine Mammal Science and is available on the journal's website. The authors of the study include: Anita Murray, formerly of the Wildlife Conservation Society and Columbia University; Salvatore Cerchio, Yvette Razafindrakoto, and Howard Rosenbaum of the Wildlife Conservation Society; Robert McCauley of Curtin University, Perth, Australia; Curt S. Jenner of the Centre for Whale Research, Fremantle, Australia; Douglas Coughran of the Department of Environment and Conservation, Perth, Australia; and Shannon McKay of the School of Life and Environmental Science, Warrnambool, Australia.

"In the Northern Hemisphere, within an ocean basin whales sing songs that are composed of the same themes. However, whales in the southern Indian Ocean are singing almost completely different songs. Songs from Madagascar and Western Australia only shared one similar theme, the rest of the themes were completely different," said lead author Anita Murray, who conducted the research while a graduate student at Columbia University and the Wildlife Conservation Society and is currently pursuing her doctorate at the University of Queensland in Australia. "The reason for this anomaly remains a mystery. It could be the influence of singing whales from other ocean basins, such as the South Pacific or Atlantic, indicating an exchange of individuals between oceans which is unique to the Southern Hemisphere."
The songs of humpback whales are generally sung by male individuals on a population's winter breeding grounds, migratory routes, and summer feeding grounds. The songs themselves are complex arrangements of parts or "themes," consisting of ascending and descending wails, moans, and shrieks that are repeated in cycles lasting up to 30 minutes. The transmission of songs between individuals from different populations is likely to occur on feeding grounds or during migration when whales from different populations mix. Or, transmission of song may occur when individual male "troubadours" travel to different breeding grounds between breeding seasons or possibly during the same breeding season.
The research team made recordings of humpback whale songs in two locations in coastal Madagascar and three locations along Western Australia during the 2006 breeding season. Research teams in both regions used hydrophones to record the songs of 19 individual whales. Overall, the authors captured more than 20 hours of whole and partial songs for visual and audio analysis. The comparison revealed few similarities between songs; of the eleven themes recorded in both regions, only one theme was shared by both populations.
Due to the limited duration of the study (only one breeding season), researchers point out that continued analysis of songs in Madagascar and Australia are needed to examine the reasons for the limited similarity in repertoire.
Dr. Howard Rosenbaum, Director of WCS's Ocean Giants Program said: "These song comparisons complement our findings based on other methods, such as those from genetic analysis, to understand how whale populations interact with one another."
WCS conservationist Salvatore Cerchio added: "We have glimpsed here a snapshot of differences in repertoire between humpback whale populations of the Indian Ocean during a single season. Continued monitoring of these songs can provide us with valuable information on how whale songs are exchanged and how those channels of cultural transmission can be protected in the future."

On 28 September 2011, the scientist at the centre of the global row over glyphosate/Roundup herbicide and birth defects met with representatives of the German government to present his scientific findings that Roundup herbicide and the chemical on which it is based, glyphosate, cause birth defects in laboratory animals.[1]
Prof Andres Carrasco, MD, is head of the Molecular Embryology Laboratory at University of Buenos Aires (UBA) and chief scientist at the National Council for Science and Technology (CONICET), Argentina. Carrasco’s findings gave scientific credibility to reports of people in Argentina who claimed escalating rates of birth defects and cancers after the introduction of genetically modified soy, which is engineered to tolerate being sprayed with huge amounts of glyphosate.
Accompanying Dr Carrasco at the meeting were representatives of the sustainability nonprofit organisation Earth Open Source. The delegation met with representatives from BMELV, BVL, UBA, and BfR. The current approval of glyphosate dates from 2002.
The current approval (in common with all approvals of pesticide and genetically modified crops) is based on studies performed by the very same pesticide companies that stand to profit from an approval of the substance.
Originally glyphosate was due to be reviewed in 2012 but the Commission delayed the review until 2015. Germany has a special responsibility in the Roundup controversy because it is the rapporteur member state for glyphosate, responsible for liaising between the pesticide industry, the EU Commission and the EU member states on the EU approval of glyphosate. Germany will remain as the rapporteur member state for the 2015 review of the substance.
In June 2011, Earth Open Source published a report by a group of international scientists, Roundup and birth defects: Is the public being kept in the dark?[2] which examined the original approval documents for glyphosate and found that industry’s own studies from as long ago as the 1980s-1990s (including some commissioned by Monsanto) showed that glyphosate causes birth defects in laboratory animals, specifically rabbits and rats.
Birth defects were found in these industry studies not only at high, maternally toxic doses, but also at lower doses. As the industry studies were supposed to be on pure glyphosate, they show that it is not only the toxic added ingredients in Roundup (called adjuvants or co-formulants) that cause problems, but also glyphosate itself. Earth Open Source disagrees with Germany’s interpretation of these industry studies as laid out in its report to the EU Commission in 1998.
In this report, which formed the basis of the EU Commission’s current approval of glyphosate, Germany incorrectly classified malformations as "rather a developmental variation than a malformation" and dismissed findings of malformations at lower doses.[2]
Earth Open Source believes that as a result of such data being ignored, a potentially unsafe "acceptable daily intake" limit for glyphosate was set by Germany and accepted by the Commission in its 2002 approval. Earth Open Source says that the industry study findings are confirmed by Carrasco’s research, which found birth defects from both Roundup and pure glyphosate.
Carrasco commented that the malformations found in the industry studies were consistent with those found in his own study, as both types of malformations depend on a mechanism called the retinoic acid pathway. Carrasco's findings were not welcomed by some sectors of society in Argentina.
The Argentine government is heavily dependent on the soy economy because it has levied taxes of 35% on soy exports. Earth Open Source believes that the Argentine situation is highly relevant to Europe. Much the soy grown in Argentina is imported into Europe to feed our livestock and it is unclear that these glyphosate-sprayed soy imports are tested for residues.
In addition, there are several applications in the EU approvals pipeline for the cultivation of GM herbicide-tolerant crops, which, if cultivated in Europe, will result in an escalation of glyphosate exposure. Claire Robinson, spokesperson for Earth Open Source, said, "We requested this meeting to bring attention to the inadequacies of the current approvals process for pesticides and other risky substances.
"We asked the German government to conduct a rigorous and transparent review of glyphosate for the 2015 review – taking into account the full range of independent scientific findings as well as the industry studies.
"On the EU level, we are asking the Commission to cease allowing industry to conduct its own studies on risky substances like pesticides, chemicals, genetically modified foods, and food additives. "Instead, industry should pay money into a central fund administered by the EU government and the government should commission independent scientists to do the studies.
The scientists doing the testing could be blinded to the identity of the substance and its manufacturer to ensure impartiality.
"We thank the German government representatives for their willingness to listen to our concerns and hope that together we can move the approvals process in the direction of stronger science and better protection of human health and the environment."

People for the Ethical Treatment of Animals, no stranger to attention-grabbing campaigns featuring nude women, plans to launch a pornography website in the name of animal rights.
The nonprofit organization, whose controversial campaigns draw criticism from women's rights groups, said it hopes to raise awareness of veganism through a mix of pornography and graphic footage of animal suffering.
"We're hoping to reach a whole new audience of people, some of whom will be shocked by graphic images that maybe they didn't anticipate seeing when they went to the PETA triple-X site," said Lindsay Rajt, PETA's associate director of campaigns.
PETA has been accused of campaigning for animal rights at the cost of exploiting women. A Facebook group, Real Women Against PETA, was launched after the organization paid for a billboard showing an obese woman with the message: "Save the Whales. Lose the Blubber. Go Vegetarian."
Another critical Facebook group is called, "Vegans (and Vegetarians) Against PETA."
"PETA is extremely disingenuous," said Jennifer Pozner, executive director of the New York-based advocacy group Women In Media & News. "They have consistently used active sexism as their marketing strategy to garner attention. Their use of sexism has gotten more extreme and more degrading.
"This may be in their minds the only thing left at their disposal to lower the bar," she said.
PETA has filed paperwork to launch its pornography site when the controversial new .xxx domain becomes active in early December. While many nonprofits and corporations are scrambling to protect their website names from being hijacked by a pornographer slapping on a .xxx domain, PETA is embracing the new domain as just another way to conduct business.
"We try to use every outlet that we can to speak up for animals," Rajt said. "We anticipated that this new triple-X domain name would be a hot topic and we immediately decided to use it and take advantage of it to try to promote the animal rights message."
Jill Dolan, director of the program in gender and sexuality studies at Princeton University, was critical of the PETA campaigns.
"Exploiting porn to get people's juices going seems lame; exploiting pornographic images only of women to make their point is retrograde and misogynist," Dolan said in an email. "Come on, PETA. Don't be Neanderthals."
Rajt denied that PETA has been insensitive to women.
"Our demonstrators, the models, all chose to participate in our campaigns... It's not a very feminist thing to do to turn to women and tell them whether or not they can use their voices, their bodies to express their voice."
Visitors to the X-rated site will initially be presented with pornographic content as well as images from PETA's salacious ads and campaigns, Rajt said. Those images will be followed by pictures and video shot undercover of the mistreatment of animals. The site will also include links to vegetarian and vegan -- using no animal products -- starter kits as well as recipes.
PETA's ad campaigns have featured adult film stars Sasha Grey, Ron Jeremy and Jenna Jameson. In 2008, the organization's YouTube account was temporarily shut down after showing racy videos of celebrities and others posing nude.
"When people first visit the site, it will be very enticing and once they go just a little bit deeper, that's when they'll be confronted with images that we hope will make them stop and think and get them talking and hopefully encourage them to make a lifestyle change to a plant-based diet," Rajt said.
