WASHINGTON -- Democratic lawmakers on Thursday called for a federal investigation into Supreme Court Justice Clarence Thomas' failure to report hundreds of thousands of dollars on annual financial disclosure forms.
Led by House Rules Committee ranking member Rep. Louise Slaughter (D-N.Y.), 20 House Democrats sent a letter to the Judicial Conference of the United States -- the entity that frames guidelines for the administration of federal courts -- requesting that the conference refer the matter of Thomas' non-compliance with the Ethics in Government Act of 1978 to the Department of Justice.
The letter outlines how, throughout his 20-year tenure on the Supreme Court, Thomas routinely checked a box titled "none" on his annual financial disclosure forms, indicating that his wife had received no income. But in reality, the letter states, she earned nearly $700,000 from the Heritage Foundation from 2003 to 2007 alone.
Slaughter called it "absurd" to suggest that Thomas may not have known how to fill out the forms.

The NFIB is asking the high court not only to weigh in on the law’s mandate, but also whether the entire law should fall if that provision is deemed unconstitutional. The 11th Circuit ruled against the plaintiffs on that issue and agreed with the Obama administration that the mandate is severable from the rest of the law.

By Andrew Kreig,OpEdNews – The featured guest today, Sept. 22, on my MTL Washington Update radio show will be author and retired federal judge Lillian McEwen. She will amplify on her powerful memoir of overcoming an abusive childhood in the nation’s capital to find happiness, including a tempestuous romance from the early to mid-1980s with future Supreme Court Associate Justice Clarence Thomas.
By coincidence, she served as counsel during her affair to Senate Judiciary Committee Chairman Joseph Biden (D-Del.), the future Vice President who in 1991 presided over the controversial Thomas confirmation hearings. By intention, Democratic and Republican senators alike arranged the schedule to leave Anita Hill’sz sexual harassment testimony largely unsupported on camera. This paved the way for Senate 52-48 approval of the nation’s second black justice — by the narrowest vote in a century.
Several important features of this interview persuade me to preview it for OpEd News in exclusive post aside from a longer one here on my Justice Integrity Project site.
First, she is a rare, if not unique position, to make news. And that’s potential trouble, big trouble, for some who might otherwise seem above the fray after all these years. That includes Justice Thomas.
Second, this is an unusual opportunity for the thoughtful OpEd News readership to get involved in judicial affairs in a way that could actually make a difference. For some, that might mean asking McEwen a pointed question live on the show. Her segment begins at 12:17 (Eastern Time), and can be heard then also on archive. For others, it might be helping ensure that her perspectives, and those like it, are part of the court of public opinion that is the last bulwark of freedom against Supreme Court and other governmental abuse.
Here’s a prediction, based on pre-show interviews and reading a half dozen books, including her memoir and those by Thomas (200&) and Hill (1997), and attending the confirmation hearings myself in 1991:
If the McEwen perspective proved credible to a wide audience Clarence Thomasz and his backers would face more trouble than they could ever have believed possible after they thwarted Anita Hill’s testimony in 1991 and then trashed her in a long-running smear campaign. Read more…

This American life of ours has long been pro-violence and anti-sex, unless the two can be merged so that violence is the dominant theme. The U.S. Supreme Court reaffirmed that historical record on Monday in declaring California’s ban on the sale of violent video games to minors unconstitutional while continuing to deny constitutional protection to purely prurient sexual material for either minors or adults.

In an exclusive interview with ThinkProgress, Rep. Chris Murphy (D-CT) — the lead sponsor of a bill which would strip Supreme Court justices of their immunity from a code of ethical conduct that applies to other federal judges — suggests that an investigation may be necessary to determine whether Justice Clarence Thomas’ many ethics scandals rise to the level where Thomas is no longer fit to serve on the nation’s highest Court:
QUESTION: Do you think what Thomas has done is as serious as what forced [disgraced former Supreme Court Justice Abe] Fortas off the bench?
MURPHY: I think our problem is we don’t know the full extent of Justice Thomas’ connections to [leading GOP donor] Harlan Crow, or, frankly, to a further network of right-wing funders. What he’s done is incredibly serious. I think, at the very least, his actions should disqualify him from sitting on any cases in which Crow-affiliated organizations are parties to or have attempted to influence [the Court]. But this is starting to rise to the level where there should start to be some real investigations as to whether Clarence Thomas can continue to serve as a justice on the Supreme Court. The group Protect Our Elections is looking to get Supreme Court Justice Clarence Thomas disbarred in Missouri. He would still be on the court, but face a possible investigation by the justice department.
POE attorney Kevin Zeese says Thomas committed multiple violations of the Missouri Rules of Professional Conduct. (See full complaint here.) Zeese asks the Office of Chief Disciplinary Counsel to take immediate action against Thomas, including disbarment.
The accusation is that Thomas willfully failed to report income.
The complaint alleges that Thomas breached his duty and violated the Rules of Professional Conduct by knowingly and willfully failing for 20 years to state truthfully his wife’s income. The complaint also alleges that Thomas also labored under a financial conflict of interest by failing to disclose $100,000 in support of his nomination by the Citizens United Foundation when he heard the now-infamous Citizens United case. Finally, the complaint alleges, Justice Thomas made ruling that his wife benefited from financially and professionally and that, by extension, benefited him.
A bill targeting Thomas that would require Supreme Court justices to reveal more information about potential conflicts with cases before them has been introduced by Democratic congressmen Anthony Weiner (NY) and Chris Murphy (CT).
“Every week it seems, we have a new reason for this Congress, both Republicans and Democrats, to take seriously the growing problem of potential conflicts of interest on that court, especially as it seeks to take on some of the most important legislative acts passed by this Congress,” said Murphy.
He was also referring to reports about Justice Antonin Scalia’s outside activities.
