A mediation hearing aimed at averting a costly lawsuit against the King County Sheriff's Office and the Washington Department of Corrections failed to produce a settlement, according to attorneys who participated. The case involves a 2012 incident where 28-year-old Dustin Theoharis was shot 16 times while in bed. Theoharis had not committed a crime--police entered his room to search for weapons after arresting someone else at the Auburn home.
"Unfortunately, no settlement was reached," said Theoharis's attorneys, Erik Heipt and Ed Budge of Seattle, following a lengthy mediation Monday. "Although Dustin had sincerely hoped to avoid the need to file a lawsuit, he may be left with no choice." they said in a written statement.
The Feb. 11, 2012, incident is currently being reviewed by an outside investigator. But official determinations that the officers involved acted appropriately is posing a test for King County's newly elected sheriff and his promise to reform the department's use of force procedures and to increase accountability across the ranks.
It started when team of sheriff's deputies and a Washington Department of Corrections officer entered an Auburn house to arrest a convicted felon who had violated the terms of his parole.
After the team arrested the man they were after, two officers proceeded to search the rest of the home for firearms. They were told that another man -- Dustin Theoharis -- was also in the house in the room he rented.
The officers -- DOC's Kris Rongen and Deputy Aaron Thompson -- fired nearly 20 times after entering Theoharis' room, hitting him 16 times. Miraculously, he survived, but was left with a shattered jaw and shoulder, a fractured spin, and damage to his limbs and organs.
The officers said they fired because they believed Theoharis was reaching for a firearm.
"He looked back and forth at Kris and I and Kris asked him if he had any weapons. And he said yes," Thompson said in a recorded statement describing the shooting.
"Both of us were shouting at him, 'Put your hands up! Put your hands up! Put your hands up!'" Thompson continued. "And he stopped and looked at us and then he jammed his hand like he was reaching. I thought he was probably reaching between the mattress and box spring to get something and that's when we started shooting."
Theoharis did not have any firearms. He may have been reaching for a flashlight, investigators later determined.
Then-Sheriff Steve Strachan defended the shooting. "He [Theoharis] made reference to having three guns, and the deputy and the officer felt threatened."

When I heard what Ted Nugent called the victims of gun violence who had been invited as guests to the SOUA on Tuesday February 12th, I thought, What A Piece of Shit, this man is. There seems to be no compassion, no empathy and no common sense coming from the NRA these days. NONE! I have heard that many members belonging to this club of crackers are claiming they would like to see some changes made to avert the murderous rampages of violent gun owners in order to bring sanity back and protect our children and law abiding citizens. But if these people really do believe there needs to be some changes made, why do they remain members? NRA's Wayne LaPierre: Be afraid, be very afraid

Way back in 1993, there was an episode of "The Simpsons," in which Grandpa Simpson wrote a letter to the White House. Apropos of nothing, ol' Abe wanted the president to eliminate three states from the union because there are "too many states nowadays."
Grandpa added in his letter, "I am not a crackpot."
I thought of this while reading the latest missive from the National Rifle Association's Wayne LaPierre, who had a lengthy opinion piece in the Daily Caller yesterday, explaining why Americans should be terrified enough to want to buy lots and lots of firearms.
During the second Obama term, however, additional threats are growing. Latin American drug gangs have invaded every city of significant size in the United States. Phoenix is already one of the kidnapping capitals of the world, and though the states on the U.S./Mexico border may be the first places in the nation to suffer from cartel violence, by no means are they the last.
The president flagrantly defies the 2006 federal law ordering the construction of a secure border fence along the entire Mexican border. So the border today remains porous not only to people seeking jobs in the U.S., but to criminals whose jobs are murder, rape, robbery and kidnapping. Ominously, the border also remains open to agents of al Qaeda and other terrorist organizations.
Wait, it gets worse. LaPierre also envisions mass looting, debt riots, and the collapse of law-enforcement agencies. It's the kind of news you don't hear from President Obama -- who, of course, wants to disarm you for his own nefarious purposes -- and his "'mainstream' media enablers."
And then there's LaPierre's kicker: "These are perils we are sure to face -- not just maybe. It's not paranoia to buy a gun."
"Paranoia"? Who said anything about "paranoia"? This is simply a piece from a powerful right-wing lobbyist warning of Latin-American gangs, terrorists, and rioters, each of which are coming to attack you -- "not just maybe." Why would anyone think this sounds like "paranoia"?
Perhaps for the same reason Abe Simpson understood he might sound like a "crackpot"?

Hearing a knock on his door at 1:30 am, a perplexed Florida man answered the door to see what kind of unannounced visitors were outside. Holding a gun for security, 26-year old Andrew Scott was instantly shot dead by police after he opened the door.
It took the Lake County Police Department an hour and a half to realize they had killed an innocent man.
“There’s things I would have done differently, but you never know when you wake up out of a sleep and somebody’s knocking on your door,” a neighbor told Fox 35 News. “You don’t know what’s going on.”
The police had been searching for Jonathan Brown and an accomplice, who had attacked a man in the street and attempted to smash a cinder block on his head before being stopped by a passerby. Being pursued by deputies, the attempted murderer escaped, and Florida police began their search.
Seeing Brown’s motorcycle parked outside of Scott’s building, they quietly approached, refraining from announcing themselves outside of the wrongly suspected attacker’s door to avoid scaring him off. Upon seeing the man’s gun, the police opened fire, leaving multiple bullet holes in his door as they killed the innocent man. Neighbors awoke to the sound of gunfire and screams from the victim’s girlfriend.
“I was in bed and heard about seven or eight gunshots. Got up, looked outside the window, by that time you heard a woman screaming,” a neighbor told Fox 35 News.
After realizing their mistake, police found 31-year old Brown in the building next door and arrested him.
Neighbors said Scott was a nice guy, and find the mix-up a sad mistake. The police department says it would not have opened fire if the man had not been holding a gun, but neighbors want to know why the authorities didn’t identify themselves at the door.
But Scott was just one of many victims of police pursuits each year. In the U.S., innocent bystanders account for a third of those killed in police chases, according to USA TODAY. Each year, 360 people are killed in high-speed chases. While Scott was killed in another manner, his death shows the level of carelessness sometimes found in police departments while pursuing a suspect.

“Nullification” dates back to 1798, when James Madison and Thomas Jefferson drafted the Virginia and Kentucky Resolutions, respectively. There we read that the states, which created the federal government in the first place, by the very logic of what they had done must possess some kind of defense mechanism should their creation break free of the restraints they had imposed on it. Residents of a West Bank village with no electricity have been helped out of the darkness by unlikely benefactors – a group of Israelis who installed solar panels and wind turbines to illuminate the Palestinians' makeshift homes. On September 17, 2011, Occupy Wall Street (OWS), a diffuse group of mostly white middle class young people began a loosely organized protest in New York’s financial district. The group planned to camp out for some extended period in Zuccotti Park, a privately owned park in Lower Manhattan open to the public. The six Freedom Riders chose to board a bus that serves Jewish-only settlements in the West Bank on it's way to Occupied East Jerusalem, wearing kuffiyehs (Palestinian scarfs) and t-shirts reading 'Justice', 'Freedom', and 'We Shall Overcome'. They took this bold action to expose the racism and policies of segregation that pervade every aspect of life in occupied Palestine. To send the message to the world that separate is not equal. David Maisel ... Library of Dust depicts individual copper canisters, each containing the cremated remains of patient from a state-run psychiatric hospital. The patients died at the hospital between 1883 (the year the facility opened, when it was called the Oregon State Insane Asylum) and the 1970’s; their bodies have remained unclaimed by their families.
