Regular readers may know by now that my contempt for the assorted jurisprudential mediocrities occupying the US Supreme Court, at present, is virtually boundless. And it is NOT always limited to the Opus Deists–Kennedy, Thomas, Alito, Roberts and Scalia–either:Regular readers may know by now that my contempt for the assorted jurisprudential... more

ONLY NATIONAL REFERENDUMS WILL SAVE THE PEOPLE WITHOUT ARMED VIOLENCE !
The crux of the matter is: The people's welfare is in direct opposition to corporate interests. While it is all the people's money, it is all going to the corporations, with no benefits and no jobs in return. Only complete campaign finance reform, and an end to corporate personhood, will eliminate corporate control of our Congress. Congress has evidenced that they have no intention of eliminating corporate influence from government, the last instance being when Democrats refused to do so when they controlled both Houses! How do we end corporate personhood when the "Roberts Court" has blessed it?
Only by national referendum can we sidestep influence money addicted legislators, and institute campaign finance reform, thereby restoring all Congressional allegiance to the voters.
Only by national referendum can we vote to recuse Scalia and Thomas, while forcing a revote on Citizen's United, which would curtail corporate personhood and influence.
Only by national referendum, in short, can we avoid an all out armed revolution; if we are ever to regain liberty, independence, equality, justice, our money and control of our government and destiny!
Switzerland has had nearly 400 national referendum votes. A referendum vote united all of Italy's independent states into a single country. The United States is one of only five major democracies which has never had a national referendum vote. Why?
A national referendum vote could put too much control of the country in the hands of the people, so professional corporate legislators have always opposed and blocked the vote from ever occurring. But, if anyone is ever serious about reforming our government, for the long term benefit of all of it's citizens, then we need to cure our biggest and roadblocking ills with a national referendum vote! Do not think that even this will easily come to us, however, because the corporations will continue to fight us tooth and nail to continue their domination of government and to keep their blood sucking fangs in our collective veins

Rep. Christopher Murphy (D-Conn.) said Wednesday he would introduce legislation after next week's break that would require Supreme Court justices to publicly disclose why they have recused themselves from cases. Murphy said the bill would also require the Supreme Court to develop a process that would allow parties to a case to "request the court to decide whether a particular justice has a conflict of interest."
Murphy said his bill is needed in light of reports he said suggest Justices Antonin Scalia and Clarence Thomas might have had a conflict of interest in the Citizens United case. Republicans have said this decision rightly ended a government ban on independent political spending by companies and unions and prevents the government from deciding which entities can "speak" through spending in the political process.

Justice Thomas, who regularly hears complex legal cases, claims near $700,000 paid to his wife was “inadvertently omitted due to a misunderstanding of the filing instructions.” This fortune was paid to her by the Heritage Foundation, a conservative policy group. This along with admitting his own paid appearance at a private political retreat organized by Charles Koch, a prominent conservative financier.
"Justices Thomas and Antonin Scalia said in a statement released by the court on Thursday that they had each spoken at dinners at the Koch retreat and that their expenses were paid by the Federalist Society, a conservative legal group." -NYT

Supporters of the Equal Rights Amendment should give U.S. Supreme Court Justice Antonin Scalia a standing ovation right about now.
In widely quoted comments in the current issue of California Lawyer, Scalia said the equal protection clause of the 14th Amendment to the Constitution does not protect against discrimination on the basis of gender.
That boils down to the idea that women are not part of the Constitution.
Bravo! That's just what supporters of the Equal Rights Amendment, known as E.R.A., have been saying for years.
The E.R.A. is rather simple. It would guarantee the equality of rights under the law not be denied or abridged by the United States or by any state on account of sex. It gives Congress the power of enforcement.
Those who follow Scalia's decisions barely raised an eyebrow at his latest comments. He showed his view on sex discrimination in 1996 when he cast the sole vote in favor of the Virginia Military Institute's ability to discriminate against female applicants. Overall, his statements are less alarming than the media have trumpeted.
The 14th Amendment was ratified in 1868 as part of the Reconstruction Amendments and was the basis for the 1954 Brown v. Board of Education decision, leading to the dismantling of segregation laws in the South.

Scalia is apparently against the natural progress of societies...
"Right to abortion?'' he asked. "Come on. Nobody thought it violated anything in the Constitution for 200 years. It was criminal.''
The same, said Scalia, is true of homosexual sodomy. Yet the nation's high court has struck down state laws banning both.Scalia is apparently against the natural progress of societies...

Justice Antonin Scalia believes government should favor religion, and is apparently willing to abandon the separation of church and state. Scalia told the Jewish daily newspaper Hamodia, the “Daily Newspaper of Torah Jewry”, it was never U.S. constitutional, social or legal tradition to exclude religion from the public sphere. He noted that the Supreme Court recently allowed the Ten Commandments on the grounds of the Texas State Legislature.Justice Antonin Scalia believes government should favor religion, and is apparently... more

The GOP has either allied themselves with the bigot-based 'tea bagger' movement or it is the instigator of it. Just when I had come to believe that the GOP could not possibly sink lower, it is now clear to me that this endemically bigoted party is positioned to exceed all previous lies, idiocy and hate talk spewed on that party's behalf by Rush Limbaugh, Glenn Beck, Bill O'Reilly and a legion of venom filled wannabes. Indeed, the GOP --apres Bush --is a deluge, a jack-booted army of right wing hate mongers. The GOP has either allied themselves with the bigot-based 'tea bagger'... more

We may have to live with their decision, but we will 'NEVER GET OVER IT'! FOR AS LONG AS I LIVE, I WILL NEVER 'GET OVER IT', THEIR DECISION HAS HURT AMERICA TOO DEEPLY TO 'GET OVER IT'! Dick Cheney socialized with Justice Scalia, I think it is clouding his judgment.
This Sunday, CBS’s 60 Minutes will air an interview with Supreme Court Justice Antonin Scalia, who discards his usual disdain for the press to hawks his new book, “Making Your Case: The Art of Persuading Judges.” When reporter Leslie Stahl asks about the infamous Bush v. Gore decision, Scalia lashes out, “Get over it. It’s so old by now.” Watch it:

If his decision wasn't politically motivated---what else is there? It certainly wasn't based on the law to let the votes get counted. Is he suggesting somebody paid him?
