Journalist Chris Hedges sues Obama over National Defense Authorization Act

Less than a month after the National Defense Authorization Act was signed into law, President Barack Obama faces a lawsuit because of its highly controversial provisions regarding the detention of suspected terrorists.

Attorneys Carl J. Mayer and Bruce I. Afran filed a complaint against Obama and Secretary of Defense Leon Panetta Friday in the Southern U.S. District Court in New York City on behalf of journalist Chris Hedges. The complaint states that the law violates the First and Fifth Amendments.

The $662 billion defense spending bill contained a controversial section that required terrorism suspects to be detained by the military without trial, regardless of where they were captured.

Despite language in the law that states it does not affect existing authorities relating to the detention of U.S. citizens or others captured within the U.S., Hedges claims that it still allows the government to detain Americans indefinitely without trial.

“I spent many years in countries where the military had the power to arrest and detain citizens without charge,” Hedges explained at TruthDig. “I have been in some of these jails. I have friends and colleagues who have ‘disappeared’ into military gulags. I know the consequences of granting sweeping and unrestricted policing power to the armed forces of any nation. And while my battle may be quixotic, it is one that has to be fought if we are to have any hope of pulling this country back from corporate fascism.”

While signing the bill, Obama issued a signing statement in which he pledged that the new laws would not violate Americans’ constitutional rights. But human rights advocates said that did not prevent future administrations from abusing the law.

The complaint alleges that Hedges could fall within the scope of the law. As part of his job as a journalist, he has direct communications with persons who are likely to be deemed engaged in hostilities with the United States. The detention provisions cover anyone who has “substantially supported” or “directly supported” “al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners.”

Hedges said at TruthDig that the controversial bill passed “because the corporations, seeing the unrest in the streets, knowing that things are about to get much worse, worrying that the Occupy movement will expand, do not trust the police to protect them. They want to be able to call in the Army. And now they can.

How Anonymous emerged to Occupy Wall Street

Mocked at first by some, Occupy Wall Street is showing the potential of online 'hacktivism' allied with street protest

Defying harsh critiques from Stephen Colbert and slews of bloggers who scoffed last week at the "leaderless", "directionless", Frisbee-throwing hipsters camping out on cardboard at a random New York City park in the financial district, Occupy Wall Street appears to be gaining ground. From the modest 200 occupiers last week, numbers of protesters rose to an estimated peak of approximately 3,000 to 5,000 at the weekend's march. Media attention has grown exponentially.

After taking their inspiration from the Egyptian "one demand" model, Occupy Wall Street have now released their list of "one" demands, bringing much-needed clarity to their objectives. The movement has moved to reach out to a broader base, including labor unions. Last week's execution of Troy Davis also contributed to the growth of Occupy Wall Street as crowds of protesters in Zucotti Park, renamed Liberty Plaza, swelled to approximately 1,500 last Thursday night demanding an end to capital punishment.

Violence caught on camera over the weekend of police arresting approximately 80 protesters and, in one now-notorious case, apparently spraying mace into the faces of female protesters has generated an outcry over the NYPD's "cowardly" use of force on peaceful protesters. Thanks to these two incidents, says one protester, Danny Garza, "Occupy Wall Street has gotten bigger than we ever thought it could be."

But the protest's profile cannot be measured purely in numbers of street protesters: on the periphery of Liberty Plaza is a parallel internet-based activism buttressing the movement. Under the banner of the virtual collective Anonymous, these "hacktivists" are now engaged in the physical action of street protest. "Groundfags" in Liberty Park communicate back and forth with online activists. The new dynamics of combined street and online activism have significantly underpinned Occupy Wall Street as a distinctive new movement.

"We can physically be at a protest one day and the next day show up online," according to an Anonymous activist who goes by the name of "MotorMouth". The most concrete example of this symbiotic relationship is the rapid online identification by Anonymous activists of an NYPD officer they claim to have been the perpetrator in the pepper-spray incident.

Naming an individual police officer may be a controversial tactic, but Occupy Wall Street has used social networking media as a positive organisational tool. When it emerged that a handful of activists were prepared to incite rioting and provoke the police days before Occupy Wall Street was to begin, Anonymous developed a Twitter application called URGE, launching an online campaign designed to quell potential violence. Anonymous "culture-jammed" Twitter with messages to keep protests peaceful, using top Twitter trends from around the world.

The involvement of Anonymous activists has also helped the movement make new connections. When activists expressed outrage at Troy Davis's execution on Wednesday night, Anonymous linked the death penalty with the protests. One Anonymous figure, by the name of "Jackal", says:

"This is a new way to protest. Many of us have done our fair share of street protesting. But they drag us into the streets, and they mace us. Now we have brought our protests into the online social media space. We do it all at once – the street protesting along with our distributed denial of service [DDoS] attacks. We are a bit of an online flash mob."

What will become of Occupy Wall Street is uncertain: protesters now face eviction from Zucotti Park; yet the movement has sparked similar activism in Chicago, Boston, Denver and other cities throughout the United States. We have begun the election march of the trolls. They have crawled out of the sewers of public relations firms, polling organizations, the commercial media, the two corporate political parties and elected office to fill the airwaves with inanities and absurdities until the final inanity—the 2012 presidential election. Journalists, whose role has been reduced to purveyors of court gossip, whether on Fox or MSNBC, descend in swarms to report pseudo-events such as the Ames straw poll, where it costs $30 to cast a ballot. And then, almost immediately, they blithely inform us that the Iowa poll is meaningless now that Rick Perry has entered the race. The liberal trolls, as they do in every election cycle, are beating their little chests about the perfidiousness of the Democratic Party and Barack Obama. It is a gesture performed not to effect change but to burnish their credentials as moralists. They know, as do we, that they will trot obediently into the voting booth in 2012 to do as they are told. And everywhere the pulse of the nation is being assiduously monitored through polls and focus groups, not because our opinions matter, but because our troll candidates understand that by parroting back to us our own viewpoints they can continue to spend their days lapping up corporate money with other trolls in the two houses of Congress, the White House, the Supreme Court and television studios where they chat with troll celebrity journalists.

The only commodity the troll state offers is fear. The corporate trolls, such as the Koch brothers, terrify the birthers, creationists, militia lovers, tea party militants, right-to-life advocates, Christian fascists and God-fearing red-white-and-blue patriots by proclaiming that unless they vote for Perry or Mitt Romney or Michele Bachmann or some other product of the lunatic fringe of our political establishment, the American family will be destroyed, our children will be corrupted and the country will turn socialist. Barack Obama, who they whisper is a closet Muslim, will take away their guns, raise their taxes and bring homosexual couples into kindergartens.

For those, usually liberals, still rooted in a reality-based world, one that believes in evolutionary science, the corporate trolls offer a more refined, fear-based message of impending doom: If you abandon the Democrats we will be governed by Bible-thumping idiots who will make us chant the Pledge of Allegiance in mass rallies and teach the account of Genesis as historical and biological fact in our nation’s schools.

And underneath it all runs the mantra chanted in unison by all the trolls—terror, terror, terror. The troll establishment spins us like windup dolls and laughs all the way to the bank. What idiots, they think. And every election cycle we prove them right.

“The only people who grasp the distinction between reality and appearance, who grasp the laws of conduct and society, are the ruling groups and those who do their bidding; scientific, technical elites who elucidate the laws of behavior and the functions of society so that people might be more effectively, albeit unconsciously, governed,” wrote James W. Carey in “Communication as Culture.”

The trolls dominate or have neutralized every major institution in the country on behalf of their corporate paymasters. The press, education, Wall Street, labor and our political parties are managed by trolls or have been destroyed by them. Sometimes these trolls speak like liberals. Sometimes they speak like conservatives. Sometimes they are secular. Sometimes they are Christians. But the language they use is a cover for the relentless march toward a totalitarian capitalism and a kingdom where the trolls, if not the rest of us, live happily ever after. Rick Perry and John Boehner overtly make war on Social Security. Barack Obama and Nancy Pelosi say they would like to save Social Security but are sadly powerless before the decisions of a congressional super committee they helped form. The result, of course, is the same. We get to choose the rhetoric and manner in which we are deceived and disempowered. Nothing more. Ralph Nader: ‘The Left Has Nowhere to Go’

Ralph Nader in a CNN poll a few days before the 2008 presidential election had an estimated 3 percent of the electorate, or about 4 million people, behind his candidacy. But once the votes were counted, his support dwindled to a little over 700,000. Nader believes that many of his supporters entered the polling booth and could not bring themselves to challenge the Democrats and Barack Obama. I suspect Nader is right. And this retreat is another example of the lack of nerve we must overcome if we are going to battle back against the corporate state. A vote for Nader or Green Party candidate Cynthia McKinney in 2008 was an act of defiance. A vote for Obama and the Democrats was an act of submission. We cannot afford to be submissive anymore.

“The more outrageous the Republicans become, the weaker the left becomes,” Nader said when I reached him at his home in Connecticut on Sunday. “The more outrageous they become, the more the left has to accept the slightly less outrageous corporate Democrats.”

Nader fears a repeat of the left’s cowardice in the next election, a cowardice that has further empowered the lunatic fringe of the Republican Party, maintained the role of the Democratic Party as a lackey for corporations, and accelerated the reconfiguration of the country into a neo-feudalist state. Either we begin to practice a fierce moral autonomy and rise up in multiple acts of physical defiance that have no discernable short-term benefit, or we accept the inevitability of corporate slavery. The choice is that grim. The age of the practical is over. It is the impractical, those who stand fast around core moral imperatives, figures like Nader or groups such as Veterans for Peace, which organized the recent anti-war rally in Lafayette Park in Washington, which give us hope. If you were one of the millions who backed down in the voting booth in 2008, don’t do it again. If you were one of those who thought about joining the Washington protests against the war where 131 of us were arrested and did not, don’t fail us next time. The closure of the mechanisms within the power system that once made democratic reform possible means we stand together as the last thin line of defense between a civil society and its disintegration. If we do not engage in open acts of defiance, we will empower a radical right-wing opposition that will replicate the violence and paranoia of the state. To refuse to defy in every way possible the corporate state is to be complicit in our strangulation.

“The left has nowhere to go,” Nader said. “Obama knows it. The corporate Democrats know it. There will be criticism by the left of Obama this year and then next year they will all close ranks and say ‘Do you want Mitt Romney? Do you want Sarah Palin? Do you want Newt Gingrich?’ It’s very predictable. There will be a year of criticism and then it will all be muted. They don’t understand that even if they do not have any place to go, they ought to fake it. They should fake going somewhere else or staying home to increase the receptivity to their demands. But because they do not make any demands, they are complicit with corporate power.

“Corporate power makes demands all the time,” Nader went on. “It pulls on the Democrats and the Republicans in one direction. By having this nowhere-to-go mentality and without insisting on demands as the price of your vote, or energy to get out the vote, they have reduced themselves to a cipher. They vote. The vote totals up. But it means nothing.”...

America's military and economic empire could collapse at any time, but predicting the precise day, week or month of its potential demise is unattainable, according to a former New York Times war correspondent who spoke with Raw Story. "The when and how is very dangerous to predict because there's always some factor that blindsides you that you didn't expect," Pulitzer-winning journalist Chris Hedges said in an exclusive interview. "It doesn't look good. But exactly how it plays out and when it plays out, having covered disintegrating societies, it's impossible to tell." He explained that he learned this lesson as events unfolded around him in the fall of 1989. Then, members of the opposition to the Soviet Empire told him that they predicted travel across the Berlin Wall separating East from West Germany would open within the year. "Within a few hours, the wall didn't exist," he said. Hedges was one of the 131 activists were arrested in an act of civil disobedience outside the White House yesterday, even as Obama was unveiling a new report citing progress in the Afghanistan war. Speaking to Raw Story on Wednesday night, he said the signs of US collapse are plain to see and compared the country's course through Afghanistan to Soviet Russia's. "We're losing [the war in Afghanistan] in the same way the Red Army lost it," he said. "It's exactly the same configuration where we sort of control the urban centers where 20 percent of the population lives. The rest of the country where 80 percent of the Afghans live is either in the hands of the Taliban or disputed." "Foreigners will not walk the streets of Kabul because of kidnapping, and journalists regularly meet Taliban officials in Kabul because the whole apparatus is so porous and corrupt," he said. One day after this interview was conducted, reports hit the global media noting the CIA's warning to President Obama, that the Pakistan-supported Taliban could still regain control of the country. Hedges predicted that President Obama's war report released Thursday would "contradict not only [US] intelligence reports but everything else that is coming out of Afghanistan." His prediction came startlingly true: the CIA's own assessment was said to stand in striking contrast with President Obama's report. Defense Secretary Robert Gates, however, insisted that the US controlled more territory in Afghanistan than it did a year ago. 'A corporate coup d'état in slow motion' Hedges said he attended the protest and planned to get arrested because he is against the corporate powers that have enveloped the nation. "We've undergone a corporate coup d'état in slow motion," he said. "Our public education system has been gutted. Our infrastructure is corroding and collapsing. Unless we begin to physically resist, they are going to solidify neo-feudalism in this country." "If we think that Obama is bad, watch the next two years because these corporate forces have turned their back on him," Hedges warned. Hedges, author of "Death of the Liberal Class," said that his vision of America is one with a functioning social democracy, which stands in stark contrast to the nihilism of the corporate state. "American workers, as they are repeatedly told, will have to become competitive with prison labor in China," he said. "That's where we're headed, and all the pillars of the liberal establishment are complicit in this." "At least if you get sick in the UK, you don't go bankrupt or die," he added. Hedges said that another pressure point is the US dollar, which he pointed out had been dropped by Russia and China in favor of modified ruble/renminbi exchanges. "A few more deals like that, and our currency becomes junk," he said. Hedges continued, "As long as we have relative stability, these lunatic fringe movements can be held at bay, but if we don't undertake serious structural reform, which we're not doing, then it is inevitable that we will come to a tremendous crisis - economic and political as well as environmental."
