The transgender man whose 2007 pregnancy caused international controversy is back in the headlines, this time for a divorce dispute.
TMZ reports that an Arizona judge is questioning the validity of Thomas Beatie's marriage to his wife Nancy, deeming the couple's union to be a same-sex one, which isn't legal in the state. The couple, who tied the knot in 2003, represented themselves as a heterosexual pair at the time because Thomas reportedly had a state-authorized sex change with legal documentation prior to the wedding.
Though both his birth certificate and U.S. passport identify Beatie as a man, he has since given birth to three children and hence, the judge isn't convinced by the legal documentation and is still deliberating as to how to proceed, the New York Daily News reports.
It's an interesting -- and unfortunate -- turn of events in the ongoing legal drama between Beatie and his wife. As the Daily Mail reports, Beatie was granted temporary full custody over the couple's three children in May after he presented footage that appeared to show his wife attacking him.
"Mr. Beatie is thrilled that this Court has recognized that a transgender marriage is a valid marriage under Arizona law," Beatie's attorney David Michael Cantor said at the time, according to Pink News. "Hopefully, this case will help pave the way for other State's valid marriages to be recognized in the divorce courts of Arizona."
At the time of the separation, Beatie told People magazine, "Like all marriages, we have our ups and downs, and we're going through a rough patch right now. At the moment, we're separated." He also revealed that he had completed final female-to-male gender reassignment surgery at the time, adding, "Nancy hasn't seen the new me yet."

The "pregnant man" who gave birth to a daughter earlier this year says he is expecting a second child.
Thomas Beatie, a married man who used to be a woman, has told America's ABC News that after giving birth to Susan on June 29 he did not go back on the male hormone testosterone so he could have another baby.
"I feel good," he told ABC News' Barbara Walters. "I had my checkups ... And everything is right on track."
Beatie, who lives with his wife Nancy in Bend, Oregon, said the baby is due on June 12.
Beatie was born a woman but underwent hormone therapy before he was legally declared a man.
He had a mastectomy but kept his female reproductive organs when he underwent a sex change in the late 1990s.
He and Nancy decided they wanted to start a family and he underwent artificial insemination late last year.
Walters said on her television talkshow, "The View," that Beatie had revealed his second pregnancy to her during an interview for a documentary to air on U.S. television Friday night.
Beatie spoke to Walters about Susan's birth, which was not via Caesarean section.

Thomas Beatie, a former woman who is now a pregnant man, defended his decision today to have a baby, saying he has a "right to have a biological child."
Despite removing his breasts, growing a wispy beard and legally having his gender changed from female to male, Beatie, 34, kept his female sex organs intact because he hoped to have a child some day.
After years of struggling with his sexual identity and deciding to live as a man, he did the most womanly thing possible -- he became pregnant.
In an exclusive interview with Oprah Winfrey, Beatie said his lifelong desire to have children motivated him to use his still working female reproductive organs when he learned that Nancy, his wife of five years, was unable to conceive.
"I actually opted not to do anything to my reproductive organs because I wanted to have a child one day. I see pregnancy as a process and it doesn't define who I am," Beatie told Winfrey.

Beatie's little foray with his grass trimmer this week was a rare outing, on account of not wishing to jeopardize his lucrative contract with a picture agency by being photographed by paparazzi (which conveniently happened when he was trimming the lawn - but served to stoke up public interest in his story).
The blinds are drawn across every window of the house to stop anyone getting any sneaky dirtier pictures.
Nancy and Thomas declined to be interviewed because, Nancy told me: 'We've got a book coming out in September and we want to have stuff left to say so people buy the book.'
The couple are also contracted to People magazine and with Oprah Winfrey, though Nancy insists they are not being paid by Winfrey. (She did not give details of the deal with People magazine.)"

Meet Thomas Beatie. He was born biologically female, had sex reassignment surgery, and is now legally male. When his wife, Nancy, was unable to have children, Thomas, who still has female genitalia, decided he’d carry their baby himself. And thus became the world’s first pregnant man. A process which, unsurprisingly, hasn’t been too easy.
In this world where sci-fi becomes reality I'm not surprised to finally see a man carrying a baby. Granted it's not the traditionally the way I thought it would come about, ala Arnold in Junior, but still a wondrous feat none the less.
Some might say that this isn't anything new seeing how Thomas started out as a woman. Thomas Beatie may already be familiar to current.com users, but now for the first time the transgender she-turned-he-turned-mom-to-be is coming out of hiding to sit down with the Ms. Winfrey.

Doubts continue to surround the bizarre story, which was revealed in a gay magazine alongside photos of Beatie's growing stomach. Sceptics claim it is a hoax.
Doctors, however, have confirmed that Beatie's pregnancy is possible. Although, he legally became a man after undergoing a sex-change operation, Beatie still kept his female reproductive organs.
