SEIU siphons 'dues' from Mich. Medicaid payments

If you're a parent who accepts Medicaid payments from the State of Michigan to help support your mentally-disabled adult children, you qualify as a state employee for the purposes of the Service Employees International Union (SEIU). They can now claim and receive a portion of your Medicaid in the form of union dues.

Robert and Patricia Haynes live in Michigan with their two adult children, who have cerebral palsy. The state government provides the family with insurance through Medicaid, but also treats them as caregivers. For the SEIU, this makes them public employees and thus members of the union, which receives $30 out of the family's monthly Medicaid subsidy. The Michigan Quality Community Care Council (MQC3) deducts union dues on behalf of SEIU.

Michigan Department of Community Health Director Olga Dazzo explained the process in to her members of her staff. "MQC3 basically runs the program for SEIU and passes the union dues from the state to the union," she wrote in an email obtained by the Mackinac Center. Initiated in 2006 under then-Gov. Jennifer Granholm, D-Mich., the plan reportedly provides the SEIU with $6 million annually in union dues deducted from those Medicaid subsidies.

“We're not even home health care workers. We're just parents taking care of our kids,” Robert Haynes, a retired Detroit police officer, told the Mackinac Center for Public Policy. “Our daughter is 34 and our son is 30. They have cerebral palsy. They are basically like 6-month-olds in adult bodies. They need to be fed and they wear diapers. We could sure use that $30 a month that's being sent to the union.”

According to the Mackinac Center, the theoretical public employer for whom the Haynes' work is the Michigan Quality Community Care Council (MQC3), an entity within the DCH that continues to operate, even though the state legislature has defunded it. Even the MQC3 calls the families hiring in-home health care providers "employers of providers," but these health care providers are also treated as employers of MQC3 when it comes time each month to take dues out of their Medicaid payment and send it to the SEIU.

Mr. and Mrs. Haynes, of course, are both the parents (the employer) and the health care providers for their children, but they still lose money to the SEIU every month, despite having no interest in joining the union. They have been arbitrarily classified as state employees so that the union can take money from them.

Gov. Rick Snyder, R-Mich., already ended a similar scheme to provide unions with new "public employees" in the area of child care. His predecessor, Gov. Jennifer Granholm, D-Mich., had classified in-home daycare providers as public employees -- a designation that forced them to pay union dues but conferred no other benefits upon them. Snyder's director of the Department of Human Services ended that program. "[We] will stop all funding and, because these providers are not state employees, will also cease collecting union dues,” DHS director Maura Corrigan said at the time.

Michigan's state House has already passed a bill to prevent this sort of rent-seeking by public-sector unions, but it has stalled in the state Senate.If you're a parent who accepts Medicaid payments from the State of Michigan to... more

On March 31, 2010, the SEIU filed their LM-2 forms required by Federal law. In the quest to provide transparency of what the SEIU is doing, some startling revelations have been made since the documents have come to light.

Specifically, recent information disclosed in the LM-2 forms filed begs to question about the President of that organization’s status as a lobbyist. Is Andy Stern a lobbyist, and if not, what is he then?

According to the dictionary of Merriam-Webster, a lobbyist is a person that conducts “activities aimed at influencing public officials and especially members of a legislative body on legislation.” One would argue that Andy Stern, who has been the most frequent visitor of the White House, is indeed acting as a lobbyist does.

Of course, more important is how lobbying is defined by the Lobbying Disclosure Act:

“The term ‘lobbyist’ means any individual who is employed or retained by a client for financial or other compensation for services that include more than one lobbying contact, other than an individual whose lobbying activities constitute less than 20 percent of the time engaged in the services provided by such individual to that client over a six month period.”

In its 2009 LM-2 filing, the SEIU claims outright that Andy Stern has spent 32 percent of his time performing political and lobbying activities. As cited above by the Lobbying Disclosure Act, a lobbyist must file if they spend 20 percent of their time lobbying. Clearly Andy Stern does. But, he has failed to file.

Which gave Americans for Worker Freedom and Americans for Tax Reform reason to call Stern out last week. They have formally requested that U.S. Attorney Channing Phillips investigate Stern for “potentially illegal lobbying activities” last November.

Cleta Mitchell, a leading election and financial disclosure requirement law expert and author of the Lobbying Compliance Handbook, had this to say about Andy Stern’s lack of filing as a lobbyist, “On face value, it appears that Andy Stern is in violation of the Federal Lobbying, Registration and Disclosure requirements.”

It’s possible that whomever prepared the LM-2 made an error. But, it is far more likely that Stern failed to file the proper paperwork to lobby in Washington, D.C. The truth must be known.

As Barack Obama promised in 2008: “I don’t take a dime of their [lobbyist] money, and when I am president, they won't find a job in my White House.” But in 2010, Stern finds himself the recipient of an appointment to serve on Obama’s Debt commission.

Hopefully, when we get to the bottom of this matter, justice will be provided. Either way, someone is in trouble. It will either come down that the LM-2 was improperly filed or that Stern failed to file his lobbyist registration paperwork. If the latter is the case, we can only hope that justice will be provided as effectively as it was against Jack Abramoff.

Weekly Pulse: "Racist" Tanning Tax and Other Absurd Objections to Health Care Reform

While President Obama signed the final piece of the health care reform bill into law on Tuesday, opponents are not taking the defeat lying down. This week’s prize for the most bizarre objection to health care reform goes to Glenn Beck’s guest host Doc Thompson who alleged that a tax on tanning salons is racist. Andy Kroll of Mother Jones explains:

Filling in for Glenn Beck on his radio show, conservative radio host Doc Thompson recently made the stunningly outrageous claim that a tax on indoor tanning salons, as included in the health care reform bill, is racist. Such a tax, Thompson claimed, discriminates against “all light-skinned Americans” because only white-skinned Americans use tanning salons. Never mind the deadly effect tanning beds and the like have on your skin and health, nor the fact that the tax would generate $2.7 billion over ten years to help pay for health care. No, that couldn’t have anything to do with why the tax was included in the health care bill.

Governors vs. AGs

Christina Bellantoni of TPM Election Central reports that various Republican state attorneys general are clashing with their Democratic governors over plans to challenge health care reform in court. When Michigan Attorney General Mike Cox (R) joined an anti-reform lawsuit, Gov. Jennifer Granholm (D) reminded everyone that “no one in the executive branch has authorized [Cox] to take this position.” The lawsuits are a good way to grab media attention, but Cox and his fellow AGs may end up with egg on their faces if these challenges actually go to court.

Reform and the Constitution

Some anti-reform activists allege that health care reform is unconstitutional because the government doesn’t have the right to force people to carry health insurance (aka the “individual mandate”). On, The Breakdown podcast, Chris Hayes of the Nation interviews Gillian Metzger a professor of constitutional law at Columbia who explains why the constitutionality of health care reform is “pretty much a no-brainer.” Another Nation contributor, Aziz Huq, puts it this way: “Among constitutional scholars, the puzzle is not how the federal government can defend the new law, but why anyone thinks a constitutional challenge is even worth making.”

SEIU Sues Dissident Local

Speaking of lawsuits, Carl Finamore of Working In These Times is covering a major court battle in California between two large health care unions. The 1.8 million-member Service Employees International Union is suing the former elected officers, staff and organizers of its third-largest national affiliate, United Healthcare Workers–West (UHW). The 26 defendants defected from SEIU to form a new union, National Union of Healthcare Workers (NUHW), which is also being sued. The conflict started a few years ago when national SEIU decided to remove 65,000 health care workers from a UHW local without the local’s consent. Finamore sees this lawsuit as a test of the principle of local self-governance: can SEIU sue a dissident local into submission?

"Showdown In Chicago": Protesters Crash Bankers Convention, (VIDEO, IMAGES)

Via National People's Action, here is some footage from the protesters at the ABA conference. From the footage, it's clear there are some strong emotions from the protesters.

At one point a protester grabs a megaphone and says:

"The American Bankers Association has helped loosen the rules that protect us, allowing the unfettered greed that has brought us to the brink of a recession. And for those bankers who are members and support the ABA's war against the working and middle class, shame on you!"

The crowd soon begins chanting "Shame On You!" in unison.

Via Progress Illinois' Twitter feed, here's more video of Sen. Durbin's speech. In this section, he calls for a "showdown" with Wall Street.

According to the Twitter feeds of National People's Action and the SEIU, the protesters are headed to the ABA's "Roaring '20s"-themed cocktail party. (Perhaps the ABA is not aware of the irony of having such an event.)

Sen. Dick Durbin spoke in front of the protesters earlier today. Here's a clip from the video, in which Durbin tells the story of homeowner who was struggling to stay in her home -- and was apparently talked into agreeing to a seemingly atrocious mortgage. The woman's mortgage was riddled with hidden fees and by, "the types of things even a Wall Street lawyer couldn't explain to anyone," Durbin said.

The American Bankers Association's annual convention in Chicago has become the scene for a series of major protests, which are set to continue through Tuesday. Dubbed "the Showdown in Chicago." (http://www.showdowninchicago.org/index.html) (Check back here frequently for updates on the protests.)

Groups like the National People's Action, the Service Employees International Union, Americans For Financial Reform and the AFL-CIO are expected to turn out with thousands of protesters. Sen. Richard Durbin (D - Illinois) is scheduled to address the protesters Sunday evening. Conference speakers include Newt Gingrich, conservative columnist George Will and FDIC chairman Sheila Bair.
