A Monmouth County Superior Court Judge lost all sense of justice when at the behest of caseworkers for New Jersey Division of Youth and Family Services, transferred custody of my minor son to the other parent without expert testimony, evidence, discovery or cross examination. My attorney, the DYFS attorney and judge at that time have been replaced.
The other parent arrived here illegally from Haiti. In 2001, police arrested and detained him for assault which resulted in a final restraining order. His criminal history also includes arrests for unlawful possession of weapon, a conviction for disorderly persons, drug possession and assault on his sister. He continues to subject me to hostility and verbal abuse. After the custody transfer, he exposed my son to a Megan's Law sex offender and another perpetrator of violence. This is all contained in the DYFS file the caseworkers withheld from state experts.
My son does not belong with this person. Please support me and The Law Office of Anthony J. Cafaro as we perform the meticulous task of bringing corruption - withheld documents, false and misleading information - to light in the court room. Please support Judge Flynn in restoring full primary sole legal and physical custody with me and granting a final restraining order to stop the hostility and violence which continues today. Legal Recognition of PAS
An increasing number of attorneys are publishing articles which recognize and seek to address the problem of parental alienation, variously using the term Parental Alienation Syndrome in the title, in the text or in the bibliography (30, 46, 47, 49, 50, 54, 55). California attorney Patrick Clancy posts his Points and Authorities for the Admissibility of PAS Testimony on his web site. An article by Wood opposes legal recognition of PAS (56). Family law judges have been producing a growing body of opinions which discuss PAS by name or include findings of parental alienation without giving it a special label (26, 46, 47, 54-57). A 1997 issue of The Judges' Journal included an article on managing visitation interference by Turkat (57), who has been referencing Gardner's work on PAS for several years. Judge Vernon Nakahara in Alameda County, California, spoke with author Deirdre Rand about his opinion that judges need to be made aware of Gardner's work on PAS. Judge Nakahara also shared his views on the role of the family law court in dealing with PAS and other high conflict cases.
A Florida attorney was the first to write about PAS after Gardner introduced the term in 1985. Palmer's article, published in 1988, described PAS as a strategy some parents were using to avoid their obligation to share parenting responsibility under Florida law (46). She discussed two legal cases, including Schutz v. Schutz in which the judge opined: "The Court has no doubt that the cause of the blind, brainwashed, bigoted, belligerence of the children toward the father grew from the soil nurtured, watered and tilled by the mother. The Court is thoroughly convinced that the mother breached every duty she owed as the custodial parent to the noncustodial parent of instilling love, respect and feeling in the children for their father. Worse, she slowly dripped poison into the minds of these children, maybe even beyond the power of this Court to find the antidote" (46; pp. 361-362). Palmer foresaw the need for early evaluation and intervention in cases of PAS and those with that potential, in order to prevent the development of completed, intractablealienation. She recommended the use of judicial sanctions to hold alienating parents accountable and to provide incentives for changing their behavior.
In 1991, a Canadian law journal published an article by Goldwater which strongly supports legal recognition of PAS (47). According to Goldwater, Gardner's 1989 book on family evaluation in child custody (48) "is certainly required reading for the family practitioner and should be considered the source document on the phenomenon of parental alienation syndrome...Indeed, there is a moral failure in smugly asserting that children have 'rights' without taking into account their evident lack of autonomy and their material and psychological vulnerability to control and manipulation" (47; pp. 121-122). Although the title is in French, most of the text is in English. Canadian law and case citations are discussed.
In 1993, two articles were written by attorneys; one from New Hampshire (49) and one from South Carolina (30). These articles took a practical approach to the special difficulties PAS cases pose to family lawyers, mental health professionals and to the courts. Ward and Harvey are a psychologist and an attorney, respectively (49). Their article distinguishes between "typical" divorce and "alienation". Alienation cases are distinguished by the nature and extent of a parent's willingness to involve the children.
According to Ward and Harvey, alienation family systems require their own specific interventions, a point Gardner continues to emphasize. They build on Gardner's concepts about PAS and synthesize them with Johnston's work on the divorce impasse and high conflict families.

We now live under Kleptocracy , Autocracy, Beauracracy, and Idiocracy.
'Autocracy' is a form of government by dictorships or oligarchies with excessive control, manipulation, propaganda and is well illustrated by George Orwell's book '1984'. If you do not have a basic understanding of that book, this blog won't make much sense. If you do understand '1984' then you should be able to easily find the connections with propaganda relating to the current wars in Iraq and Afghanistan, which replaced the 1990's era 'war on drugs', which followed the 'Cold War' era which ended in the 1980's, begging the question why our propaganda driven society seems focused on the perpetuation of a constant state of war, as if our nation would become unfrayed by peace.
Parents face a similar version of autocratic tyranny in the form of flippant government intrusion into the care and custody of our children. The corrupt and incompetant family courts distort thier destruction of the family, by rewarding and fueling high conflict custody litigations and sole custody decisions is somehow in the 'best interests' of the child, when in reality all they are doing is pilaging the family's savings, harming the child's future, and engaging in the deliberate, methodical emotional abuse of the child, thru parental aleination, violent parental detachment, and other means.
Pournelle's Iron Law of Bureaucracy states that in any bureaucratic organization there will be two kinds of people: those who work to further the actual goals of the organization, and those who work for the organization itself and in all cases, the second type of person will always gain control of the organization, and will always write the rules under which the organization functions.
Thus we see the natural progession of child care in a Bureaaucratic process will seize control from those seeking to help children, ie: parents, to give power and control to those seeking to enhance the beaucracy, ie: the courts, lawyers, experts, etc.

The overt fraud, corruption, and bungling incompetance of beauracracies, is illustrated by Kafka's nightmarish story 'The Trial'. Overt government corruption and greed describes the Kleptocracy government model, or rule by thieves. Kafka correctly identifies the incompetance and absurdity that often follows Kleptocracy in a form of beauracracy that can be described as Idiocracy. [form of government in which a country is run by fools]. The following video do not really capture the essence of 'Kafka', so you may need to watch the entire movie, either the old version with Anthony Hopkins and Orson Wells, or the newer remake. The book is very difficult to comprehend, and 'Kafka' is confusing. An important concept to grasp from 'The Trial' is that it warns of the coming tyranny of fascism, being written in 1925 Germany. More importantly it illustrates the corruption, incompetance, greed, and absurdly irrational nature of beauracracies that comprise the unjust and oppressive state of tyranny.
Orwell's '1984' envisions a Autocracy that is a brilliant conspiracy of a few genious arch villians controlling the ignorant masses. Kafka nails it better by illustrating the petty, greedy, incompetant, stupidity at the lowest levels on up that engage in beauracratic rituals aimed at strenghening thier own positions within the abusrd and corrput machine. The satirical Idiocracy described by Kafka makes no sense, which is exactly the point, and his works are often described to be more like an abstract nightmare for this reason.

Ohio NBC 4 Contines Updates on Fathers 4 Justice Crane Protest. There have been unconfirmed reports that police agencies may be mobilizing to take the crane by force to remove Donald Tenn, the last remaining father from a Crane in Columbus Ohio.
Paul Fisher was arraigned earlier this morning after climbing down from the Crane Monday evening for Felony Vandalism, under the accusation that bolt cutters may have been used to gain entry to the crane site where two Fathers 4 Justice members climbed atop a 100ft Crane.
According to Ohio Revised Code 2909.05 under Section (E) the applicable Felony could a be fourth or fifth degree offense brought against the protesters. These technicalities affect the severity of punishment. Along with other overriding provisions of ORC 2929.11 there can be a fine of up to $2500.00.
According to Ohio Revised Code 2909.11 pertaining to felony sentencing ..."The overriding purposes of felony sentencing are to protect the public
from future crime by the offender and others and to punish the offender. To achieve those purposes, the sentencing court shall consider the need for incapacitating the offender, deterring the offender and others from future crime, rehabilitating the offender, and making restitution to the victim of the offense, the public, or both."
Additionally, no matter the outcome of either trial, a conviction, or restitution assignment, nothing in these statutes prohibit the bringing of a civil action for additional damages against any of the alleged suspects or their associates which has been expressly preserved in the Ohio Revise Code under pertinent and numerous sections.

Donald Tenn is a California father who says he “had to take action” for his young daughter Madison. He started his fourth day this morning on a wet construction crane in Columbus Ohio alone. Last night police warned of thunderstorms. John Fowler, national coordinator for Fathers 4 Justice was able to talk activist father Paul Fisher down.
Tenn refused. “I have nothing to lose”, he said through a walkie-talkie. Earlier he told me, “I’ve followed the law, been bounced back and forth between states, and been falsely accused of domestic violence. I finally won visitation in Illinois. The judge even reprimanded her mother. I had one visit. That’s it. She’s able to use services funded by the Violence Against Women Act to illegally keep me from my daughter.”
Until Madison’s mother illegally abducted her to Illinois, Tenn was her stay-at-home parent. It’s Madison he worries about, not himself. He says she’s being hurt by the family court system and he has to protect her. A member of Fathers 4 Justice, the gender-neutral civil rights group fighting for equal parental rights, he says he won’t come down until Governor Schwarzenegger agrees to a nonpartisan investigation into the family court system. Calls to the Governor’s office have yet to be returned.
Tenn’s Sacramento phone rings off the hook at all hours of the day. Friends say he always makes time to listen to parents trying to avoid or recover from the devastation of losing contact with their children. When he isn’t grieving for his own little girl Madison, he says, his heart aches for the thousands of other parents he knows who are experiencing the same thing.
Tenn has been sending Madison packages in the mail about 3 times a week. “I’ve probably sent over 300 packages so far,” he told me recently, “they include books, healthy snacks, small toys and stickers. She loves stickers”
When asked if he wants to keep Madison away from her mother when this is resolved, he says, “no.” “I’ve always wanted equal custody, equal parenting and equal responsibility, for each of us.” Asked if his case was unique he replied,”I’ve traveled the country talking to other parents. And what I hear all the time, from mothers and fathers, is that they want equal parental rights, equal physical and legal custody.”

URGENT REQUEST TO SUPPORT SUPERHERO'S - 4 - JUSTICE
As you should know, there are two superheros, Donald Tenn, from California, as Spiderman and Paul Fisher, from Ohio, as Batman, both members of Fathers4Justice, are currently atop a 100 foot crane outside the Ohio Stadium in Columbus. They’ve unfurled a 40 foot banner that says STOP THE WAR ON FATHERHOOD.
Like so many other Heroic Dads, they have concerns about what our family courts are doing to keep fit parents away from thier children. They are asking for your help. They would like the Governors of California and Ohio to show thier support for fatherhood and families with a non partisan investigation into gender bias and false allegations in the family court system.
Please, show your support for the Justice League and help these fine fathers get back to earth to be with thier kids. Please hurry, and help our Superheros, as they have been on this crane for days awaiting your reply.

For Many, Joe Biden is now very much the reason NOT to support Obama, just as Hillary was the reason why Obama gained thier support. Obama's rise to the Presidency is credited to the way the nation mobilized to block Hillary from office, and Obama recieved the overwhelming support of white men, to nuetralize Hillary's feminist base. Biden is poorly regarded by all those who oppose the radical feminist agenda of Hillary and her ilk. A conerstone of the radicalized femininst movement is the VAWA - The Violence Against Women Act - which Biden has championed. Biden and Hillary represent exactly the sort of change that many americans do NOT want, and the Biden choice is viewed as a sell out by many of Obama's supporters. We may view radical feminism as an exension of the WKKK who used lewd sexual imagry to villify black men as dangerous, violent, rapists, etc... urging white men to the dirty task of discrimination and violence against blacks, to save the sanctity of "white womanhood". A good example of this is the Rosewood Fl massacre that resulted from a false attack claim by a white woman against a black man made the day of a KKK rally in nearby Gainesville, with hundreds of hooded klansmen parading under a burning cross and banner reading 'first and always protect womanhood' . The WKKK, who's membership numbered in the tens of millions, dissolved after women got the vote, the same slogans agenda and tactics seamlessly morphed into radical feminism of the 1960's - simply dropping 'black' from the jargon. The VAWA provides billions in funding to propogate this femi-NAZI style demogoguery and is no less inflamatory and prejudiced as would be a 'Violence Against White's Act' that provided billions in funding to promote discrimination against blacks, and allow for special laws and programs for whites only to seize the homes, income, and children of blacks merely by claiming hysterical fear of blacks. With Biden as VP, Obama can now only expect the support of foolish, feminized, men. For real men, who defend the family and thier place in society as fathers, there is no place in Obama's camp, considering the feminist rhetoric found in Obama's blueprint, and the only passing remark about 'Fatherhood' is a promise to spend more enforcing child support. Parents should be alarmed that Obama's policy advisor, who wrote his blueprint, is touted as a staunch 'feminist' by the head of NOW, who also claims Obama's platform is the strongest 'feminist' platform ever. Both Parents are best for children, incentives to wreck homes are as devastating as failed welfare policies that discourage employment. Radical feminists seek to destroy the family and replace it with all government to whom all are dependent and enslaved. Any delusions that working men once had thinking Obama would bring about the sort of sea change needed to revive our economy and make an enviroment conducive to productivity and prosperity now fades on the cold reality that Obama, like Biden, seeks only to maximize bloated spending on failed government special interest funding, such as VAWA and welfare which both attack the family and the role of men in the american family. It's very hard for men, especially working men, to get fired up about being Biden's boy, or whipping boy, in his world that centers around the funding and support drummed up by instilling a paranoid female hysterical fear of men. Biden represents the most pathetic sort of fool. Biden represents the sort of fool that we would regard a member of another very obscure KKK auxilliary - the colored man's auxilliary to the KKK. what were those fools thinking? Viewing Child Custody as a jurisdictional issue provides a simple unified doctrine that can be applied always and everywhere:
1] Parental Rights are Absolute and Inviolate Constitutional Liberties.
2] The Government has no right to interfere with a fit parent's care and custody of thier children unless evidence of the highest order shows a clear and present danger to the child. [not the frivilous crap of the typical family court circus]
3] Thus, regardless of all else, if at anytime a court maliciously interferes with a fit parent's care and custody of thier child, they lack jurisdiction.
4] A court acting without jurisdiction is unlawful, the courthouse and judge and others are open to lawsuits and civil damages, ... and other redress...
5] Jurisdiction of a court may be challenged at any stage of a proceeding, even on appeal. [U.S. v. Anderson, 60 F.Supp. 649 (D.C.Wash. 1945)]
In politics, authority (Latin auctoritas, used in Roman law is often used interchangeably with the term "power". However, their meanings differ: while "power" refers to the ability to achieve certain ends, "authority" refers to a claim of legitimacy, justification and right to exercise that power. Regarding this word "authority" Carl Freidrich's analysis is enlightening: The word Authority comes from the latin to 'expand an argument with reason'. Thus, the true, exact, literal and gramatical meaning of the word, shows that authority is lacking where there is no reasonable argument or justification behind the exercise of power, and that unjust power, such as Judicial Tyranny, lacks any real authority. In the case of parental rights, the Tryanny of a typical court refusing to release a child to a fit parent is an example of tyranical 'power' that lacks any reason or 'authority'. Since our nation is centered upon the ideals of liberty, we may rightly regard all such tyrants as traitors, from whom all loyal patriots are duty bound to protect our nation.

A portion of Broadview Avenue near Dundas Street East was still closed as of 4:45 p.m. Friday afternoon as two men staged a protest atop Toronto-Danforth MP Jack Layton's constituency office.
The protesters, one of which was dressed as Plywood Man and the other clad in a red and blue Spider-Man superhero costume, were expressing their disapproval with what they perceive as Layton's opposition to divorced or separated dads having equal access to their kids.
The men also draped a banner across the top of the federal NDP leader's East Toronto Chinatown's office.
A spokesperson from the Fathers 4 Justice group, an organization that advocates for the rights of both parents to raise their children despite separation or divorce, was also on hand. The group is believed to be behind the protest.

Dressed up as "Cash Gordon" and "Captain Conception" Fathers 4 Justice activists, Mark Harris and Jolly Stanesby, from Devon, unfurled a banner from the top of Harriet Harman's house reading, "A father is for life, not just conception".
How on earth these guys continue to get where they do astounds me, but they're making the headlines at least. Do they prove that not all press is good press or are they making waves in all the right places?
