The Texas Court of Criminal Appeals granted a stay of execution to death row inmate Hank Skinner Monday, who was scheduled to be executed Nov. 9.
Multiple items from the crime scene have not been tested for DNA. The stay will determine whether the law allows the DNA to be tested.
Skinner, 49, was convicted of the 1993 deaths of his girlfriend and her two sons in Pampa, Texas. A group of current and former lawmakers, judges and lawyers called on Texas Gov. Rick Perry to order the testing of DNA to "ensure certainty." Skinner came within one hour of execution in March 2010 before the U.S. Supreme Court issued a stay.
Perry, who is running for the Republican presidential nomination, has declined to express an opinion about the upcoming execution, saying only that it's a matter for the courts.
The Huffington Post's Radley Balko reported on the Skinner case last week:
There is DNA from the crime scene that could exonerate Skinner -- or could affirm his guilt -- that has never been tested. That includes blood from the murder weapon, blood from a jacket left in Busby's home, a rape kit taken from Busby, scrapings from under Busby's fingernails and hairs she was clutching at the time of her death -- hairs that likely came from her killer. For more than a decade, Hank Skinner's legal team has tried to get that evidence tested, at no cost to the state of Texas. And for more than a decade, the Texas 31st District Attorney's Office has refused.
Skinner isn't exactly a poster boy for wrongful conviction. He had previously been convicted of assault, and by his own admission he was at the scene of the crime the night of the murders. Skinner's neighbor and ex-girlfriend told police that Skinner came to her home after the crime and implicated himself, then rattled off a number of contradictory stories.
But Skinner has maintained from the night he was arrested that he was passed out from a mixture of alcohol and codeine when the murders were committed. His defense team has produced testimony from toxicology experts who say Skinner had far too high a concentration of the drugs in his system for him -- a slight man at the time -- to have killed an adult woman and her two adult sons. At best he was groggy. He was likely unconscious. The state did conduct DNA testing on blood smears on Skinner's shirt, which matched two of the victims. But that could be consistent with Skinner's story, which is that he woke to find the bodies and tried to jostle the victims to see if they were still alive.
Skinner's lawyer, Rob Owen, issued a statement on the stay Monday:
The Court of Criminal Appeals with its decision today, has ensured that Mr. Skinner's request for DNA testing will receive the thorough and serious consideration it deserves. We are grateful for the Court's action and look forward to the opportunity to make Mr. Skinner's case for DNA testing in that forum.

Suave: “Oh.”
The frivolity doesn’t last long. Def Leppard‘s ‘Rock, Rock Til You Drop’ plays and PCW’s Extreme Equalizer Whiskey Tango Foxtrot runs down and choke slams ‘Kermit the Frog’, ‘Fozzie’, and ‘Miss Piggy’ through three separate flaming tables.
Don’t worry kiddies, the costumes only sustained minor burn damage. Anyways…
PCW CEO Barack Obama continued to exercise power via executive orders by mandating a PCW Title match between Champion Daniel-San (I) and Big Labor (D). Obama then blamed the ‘gridlock’ on Obstructionist Republicans as a justification of his actions.
Women for Women: Code Pink and Emily List (D) come out and demand a rematch with the PCW Women’s Champion Valora Salinas (I). Obama, via executive fiat, agrees and calls for the match.
Valora doesn’t come out (she’s out of town and not in the building) but The Mercenaries: Dawn McGill and Svetlana Kovaleski (I) do.
McGill and Kovaleski def. Women for Women in 5:15.
The God Squad: Rev. Oral Hinnrich, Pastor Buddy Flambe, The Right Reverend Randy Richardson, and Sister Mary Marlboro (R) attack PCW Men’s Champion ‘The One Man Hollywood A-List’ Stone Chism’s valet- The Skanky Rich Bimbos.
Suave wonders who spilled the beans on where the SRB were going to be. Then Kris Humphries, Kim’s husband, walks out. He drags Kim over to Rev. Richardson who delivers a Sermon on the Mount that leaves her unconscious in the ring.
Richardson blasts Kim for filing for divorce a scant 70 plus days into their marriage. He’s about to deliver a second Sermon on the Mount when Chism challenges Richardson one on one with the title on the line. Richardson accepts and the match begins.
Five minutes in, Courtney and Chloe whip open their tops and gives Richardson a Wardrobe Malfunction. Sneaking into the ring, former PCW Champion O’Beck Bahama (D) makes his return and puts Richardson in the Bahama Backbreaker.
Chism gets the pin at 11:51 to retain the men’s title.
Post match, Chism gets on the mic and shouts at the God Squad, “How about your Tim Tebow now? What happened to him? Oh, I know, he got destroyed by some Lions last week.”
Main Event:
PCW Champion Daniel-San (I) walks out with Mrs. Miyagi. But PCW CEO Obama announces on the jumbotron that per his executive order, she is NOT allowed to be at ringside for the match. Then Big Labor (D) and his minions attack and nearly win the match.
American Heartlander Charlie Blackwell, wife Kenzie, and ‘No Frills’ Chris Escondido run in to help Daniel-San and the PCW Champion retains at 9:07.

PCW Tag Team Champions Jack and Joe Schmidt (R) w/Ron Paul (R-TX) defeated Paul Ryan’s Raiders: Kevin Collins and Nick Ray (R) w/Paul Ryan (R-WI)
PCW CEO Barack Obama is backstage. He plans to announce sweeping changes to programs and bypass the PCW Executive and Competition Committees. The initiatives are allegedly going to be revealed during PCW shows starting this month. Obama tried to meet with Democrats but for some strange reason, they walked away before he could reach them.
PCW Champion Daniel-San (I) walks out with Mrs. Miyagi. Suave interviews him in the ring and congratulates him on achieving the #1 in the Championship Wrestling Council rankings. Daniel-San thanks Suave and the PCW fans. He hopes that the fact he is an Independent will inspire others to walk away from extreme partisanship and walk their own path.
‘The One Man Hollywood A-List’ Stone Chism (D) comes out holding a belt of his own. Suave asks Chism what this is about. Chism says that because of his party affiliation and loyalty to Barack Obama, he’s been rewarded with a new title belt- the PCW Men’s Champion. Suave mocks Chism for winning a belt without winning it in the ring. Chism responds that Obama is the PCW CEO and thus has the right to bypass the Executive and Competition Committee if need be. Suave objects- Chism knocks Suave aside and attacks Daniel-San.
Charlie Blackwell (I) and his Les Miserables make the save. PCW Competiton Committee Chief John Boehner (R-OH) made a title match right on the spot.
Blackwell defeats PCW Men’s Champion Stone Chism by count-out. Chism refused to wrestle and walked back to the dressing room.
Main Event: PCW Women’s Champion Valora Salinas (I) destroyed Women for Women: Code Pink and Emily List (D) in a non-title handicap match.

This is serious, major and should not be overlooked. After the last Republican debate, which I watched all of on Youtube, I was more frightened then ever. I felt after they booed the gay soldier, and then no candidate on stage come to his defensem that if they were in the same room as him I would feel for his safety. It's very frightening to hear people be cheered on stage splurging out such hateful remarks and fascist principals that we fought against during world war II.

If you read through the article and compare Side by Side the views of the "Tea party" and the way the republicans are being forced to lean the trend is becomming more and more obvious.
We need to fight this now. We can not sit here idly by and let this happen, fascism should not be allowed to grow this freely. We have to rise up and put an end to this before they take control of the government. Even Moderate Republicans can see the trend. We have to fight this or I fear for our country in 2012 when the tea party takes the House/Senate/Presidency.

Much of the nation watched last night with breath held, waiting to see the recall results in Wisconsin. In the end, two WI Senate Republicans were replaced with Democrats, falling short of the three needed to take control of the Senate.
While this wasn't the outcome many hoped for, it was still a bit of a victory. No longer are politics played on an even field, and the situation in Wisconsin makes this clearer than any other state. But despite the slanted scale, working people in Wisconsin were still able to change two seats out of six. It is movement in the right direction.
What I mean about there no longer being an even playing field in politics is the vast amount of control and power money now has in our democratic system. While Scott Walker has pushed so extremely to rob working people of their basic rights and protections, he's been cushioned in support of endlessly flowing money backing his efforts.
Brave New Foundation's work on Koch Brothers Exposed has told the story of the corrupting role of big money in politics. How the Koch brothers politically spend their money, in order to get policies that will support their bottom line of billions, is a story we will continue to tell. The Koch brothers are a key example of this phenomenon, but they are far from the only wealthy individuals to control the outcomes of our political system. The represent a disease that is much larger than them alone.
This isn't a game played fair. While organizers go door to door to have conversations with voters, big money can pay for endless ads to run on TV.
While democracy has rules and has traditionally been a structure respected for its importance in our country, the Kochs treat our political system as a game to be won at all costs.
A perfect example of this? Here is a clip of Stephen Colbert telling of the Koch-funded American For Prosperity's work in Wisconsin around this recent election.

The Kochs gave enough money for Americans For Prosperity to mail Democratic voters information about how they should send their ballots in -- days after the election -- and how, instead of sending them to the appropriate office, they should send them to a fake right-wing run PO Box. Those using their money to corrupt our political system have no shame at this point.
We need some series changes made in order to save our political system from the destruction it is headed for. A citizen's ability to influence our democracy cannot continue to be defined primarily by the size of their net wealth. The only thing that can fix this is a structural policy change that redefine politics' relationship to money.
As we as a country wrestle with the need for these major changes, the game will continue to be played on an unequal field. But one positive thing that Wisconsin has shown us is that those who try to buy our democracy for their own gain are no longer able to do it in complete secret. When characters such as the Koch brothers, and their ruthless efforts to take political power away from working people, are so commonplace that Colbert can run a whole segment mocking them, things are changing.
We at Brave New Foundation will continue to work to tell these stories. We will continue to expose the unjust role of money in politics, and how the Koch brothers are a key example of how democracy can be bought to benefit one's bottom line. The more we know and understand these stories, the more we can fight back. It's an unequal battleground in politics in our country right now. The outcome of Wisconsin should be read as a reminder of that. A reminder of the fight still left to had, but also of the willingness of working people to not give up this fight. Why Washington is Talking about Deficits While the Rest of the Country is Talking About Jobs and the Shrinking Middle Class
"Today's Republican Party has three wings: the psychiatric wing, the corporate wing, and the Democrats.
The first wing, the psychiatric wing, is defined by severe psychological and intellectual impairments, exemplified by the inability to read a birth certificate. Sarah Palin's recent foray into American history, replete with her description of Paul Revere as the man who rang alarms, bells, and buzzers to signal his support for the Second Amendment years before there was either a United States or a Bill of Rights, provides an example of the kind of "gaffe" that is, in fact, psychologically meaningful. This level of intellectual dysfunction, equally common in the pronouncements of Michelle Bachmann, once disqualified a candidate for high office. That was until the "lamestream media" decided to turn elections into reality shows, where the only real criterion is celebrity (defined as the state of being or becoming famous), and where commentators may poke occasional fun but no longer communicate to the public the seriousness of intellectual deficits in someone running for high office who would actually have to make decisions in which "facts" occasionally matter. (The dangerousness of that level of media indifference to reality should have been a lesson of George W. Bush's tenure in office, but things have sadly only gotten worse since then.)
This is the wing of the Republican Party that most endangers the party's chances to turn a dismal economy into an electoral victory in 2012, because it is so far to the right of mainstream America that you can see Russia from its porch (even if it locates that porch in Minnesota). The problem for the Republicans is that this wing of the party constitutes such a large percentage of GOP primary voters that it is hard to imagine any nominee emerging from the primaries without having had to produce so many general election campaign ads for the Democrats that President Obama may well defy political gravity and get re-elected no matter how high the unemployment rate drifts."...................................
