Verizon FiOS to Offer Live Online Streaming of ESPN, ESPN2, ESPNU and Buzzer Beater

NEW YORK, Feb. 17, 2011 /PRNewswire/ -- As part of a wide-ranging agreement between the Walt Disney Company and Verizon, FiOS TV customers will be able to watch ESPN, ESPN2, ESPNU and ESPN Buzzer Beater live online beginning Thursday (Feb. 17). To access the online programming, Verizon customers must subscribe to FiOS TV.

The online rights to the ESPN networks are part of a broader agreement, which also includes the full suite of cable services from the Walt Disney Company: ABC Family, Disney Channel, Disney XD and the soon-to-be-launched Disney Junior, as well as retransmission consent for local ABC broadcast stations.

"Expanding our online video content to include the ESPN networks provides our FiOS customers with some of the best in sports programming, right at their fingertips," said Terry Denson, vice president of content strategy and acquisition for Verizon. "Whether watching FiOS on your TV, PC or mobile device, Verizon continues to make it easy for customers to view a growing amount of programming while on the go."

FiOS TV customers will be able to watch ESPN, ESPN2, ESPNU and ESPN Buzzer Beater live on their personal computers or laptops – at home or away – using any broadband connection. Buzzer Beater, which features live cut-ins and highlights from numerous top college basketball games during each Wednesday and Saturday of the college basketball season, is normally only available to FiOS TV customers who subscribe to the Extreme HD or Ultimate HD TV packages; but it is currently accessible to Prime TV package customers through a free preview.
ESPN Goal Line, a similar service for the college football season, will become available for online viewing by FiOS TV customers subscribing to the Extreme HD or Ultimate HD packages, when the season begins in September.

Users will have several viewing options for the channels, including picture-in-picture, simultaneous viewing of more than one channel, and full-screen viewing of a single channel. Verizon and ESPN plan to make the programming available on other Internet enabled devices, such as mobile phones and tablets, in the near future.
Using their Verizon Online user names and passwords, FiOS TV customers will be able to access the online programming at either www.verizon.com/fiostvcentral or www.ESPNnetworks.com.

This new content joins part of Verizon's high-quality, online video entertainment, which the company has been delivering since 2005. FiOS also offers a broad collection of programming on TV, with more than 520 all-digital channels including up to 142 HD channels and 19,000 monthly video-on-demand titles. FCC Gives Hollywood The Right To Break Your TV/DVR... Just 'Cause

For a couple years now, the MPAA has been asking the FCC to break your TV/DVR, and let them effectively put a type of DRM (by enabling "Selectable Output Control" or SOC) on video content, such that you will not be able to access the content via third party devices, such as your DVR or your Slingbox. Effectively, they want to break the ability of your equipment to work. You wouldn't be able to legally record the movie that was playing on your TV. The MPAA's argument here makes absolutely no sense at all -- and when they're called on it, the doubletalk comes out.

The MPAA's argument is that if it could block people from recording movies, they could release the movies on things like PPV before they release them on DVD, adding yet another window to the long list of windows that Hollywood uses. It's still not clear how more windows helps anyone but Hollywood, but they keep claiming this is some sort of consumer benefit. The thing is, their argument makes absolutely no sense at all when you look at the details. First of all, there was nothing whatsoever stopping them from releasing movies on PPV prior to the DVD release. Nothing. You don't need DRM to do it. In fact, some major studios already do this without breaking your TV in the process.

Of course, the MPAA's response is that it would never release movies this way without SOC, because then people would copy them and... um... piracy... oh mygod... Hollywood is dying. Or something like that. But that makes no sense. First, as noted, some studios already release movies this way. They don't need SOC. Second, the whole claim that this will lead to more unauthorized file sharing is a total red herring -- because all of the movies they're talking about were already in theaters -- and once a movie is in the theaters, it's already available widely on file sharing networks. There is no increase possible, because the content would already be widely available. On top of that, of course, as the GAO just noted, the MPAA's ridiculous claims of losses from "piracy" are totally bogus.

Given all that, it seemed ridiculous to think that the FCC would give in... but late last year the reports were that the FCC had already decided to give in to Hollywood, and today the FCC made it official (pdf):

10 Steps Towards the New Network TV

"These days, TV viewers have plenty of ways to watch the programs they want — when they want to watch them. And the changes have sent the TV networks into a tailspin. Profits are down. Programming is wildly uneven. Grappling with change, the TV industry is rewriting the rules it has played by for half a century, and viewers are already seeing the fruits of those changes.

They are making moves, big moves. And here are the 10 that will redefine network TV, this season and into the future:

1. Embracing the Internet, really: Soon, CBS research guru David Poltrack says, we can expect TVs with built-in Internet access, so streaming will be easy on our beautiful flat screens. That will lead to less DVR viewing. And that will make the networks happy because viewers won't be able to easily skip commercials.
2. Meeting the DVR on its own turf: The networks are making decisions in response to what works on DVR playback. (They get credit in the ratings for shows watched that way.) Turns out, science fiction and action are the most played-back genres. The demographics, who watches on DVR, who watches on the Internet, it's all in flux and may affect what entertainment is made.
3. Moving beyond the box: TV: It's not just for television anymore. CW Entertainment president Dawn Ostroff stressed her network's multiplatform push. CW is billing itself as "TV to tweet/IM/blog about." The 18- to 35-year-old females CW targets live on various platforms at once. CW wants to be more than a network, more than a website; it wants to be an enveloping experience.
4. Going global: Cross-border co-productions and replays of shows that have already aired abroad are inexpensive solutions to the programming problem. They're not necessarily hits, but they're cheaper in failure. Expect to see more of them.
5. When in doubt, imitate cable: This strategy is seen in some quarters as a response to cable's successful "brand filtering." In the same way Bravo seems to run "Top Chef" or "Project Runway" every time you turn around, the Leno brand will be available five hours a week on NBC.
6. Owning it: Ownership counts in tough economic times. "Medium," the show about a telepathic crime fighter, starring Patricia Arquette, is jumping to CBS after five years on NBC. Why? Because CBS Studios makes the show. The producer is about to become the broadcaster in a money-saving "vertical integration.
7. Converging, with profits in mind: Ashton Kutcher leads the way. The actor-producer now has 3 million followers on Twitter (a bigger audience than some prime-time TV shows) and has produced a Web show, "Katalyst HQ," that reached 9 million. He fully expects convergence to happen soon. "I think that the two mediums (TV and the Internet) will eventually merge into one, and I think our goal is to be there when they merge and already have an established understanding of that space," Kutcher said.
8. Cutting costs, cutting salaries:
CBS's Tellem said: "We're scrutinizing every aspect of the business. Whether network, studio or distribution side, we're all being challenged and, I think, actually in a very healthy way. That bubble burst in September, and just as everyone's reassessing how they're living their lives, we're reassessing how we're doing our work."
9. Staying patient, sticking with programming: The economic crunch sometimes results in a network having unaccustomed patience with what's on: Fox renewed the low-rated "Dollhouse," surprising even creator Joss Whedon, who assumed his show was dead. (Though it didn't save NBC's Kings, which hemorrhaged money from the network.)
10. In the meantime, medical shows: "Nurse Jackie," "Mercy," "Trauma" and "Three Rivers" this fall join existing medical shows "Grey's Anatomy," "Private Practice," "HawthoRNe" and "House" to make a ward full of TV doctors and nurses, saving, comforting and transplanting on several broadcast and cable networks.

Cablevision's DVR does not infringe copyright, appeals court rules

If you take the recording device of a DVR off the customer's premises and place it in an upstream transmitting station, does that constitute an unauthorized duplication? Last year, a US district court said yes. Today, it's a new ballgame.

In a ruling this afternoon that is very, very likely to be appealed itself, a three-judge panel of the US Second Circuit Court of Appeals unanimously reversed a lower court ruling in March 2007 in favor of movie and cable TV studios. That ruling stated that Cablevision Systems' plan to provide cable customers with a DVR-like system using its remote servers, constituted an illegal rebroadcast of their content. This afternoon, the judges strongly disagreed.

At issue is a key element of the language of the law: Everyone knows that electrical processes are required to produce a copy of a digitally recorded work. Plaintiffs, including 20th Century-Fox and various entities of Turner Broadcasting, and backed by the Motion Picture Association of America, had argued that such processes constituted transmission, and that implied in the concept of transmission of a recorded work was the performance of that recorded work. You can't have one without the other, plaintiffs argued; and a US District Court agreed last year.

But the Appeals Court called that permutation of the law an "error" today, ripping apart its technical basis (PDF available here, published by Public Knowledge). Specifically, it focused on Cablevision's proposed Remote Storage-Digital Video Recorder (RS-DVR) schematic, in which copies of a work in whole or in part were recorded on buffers prior to their being transmitted to customers' receiving equipment. The District Court presumed that those copies constituted the "embodiment" of the recorded work.

"The district court mistakenly limited its analysis primarily to the embodiment requirement," wrote Appeals Court Judge John M. Walker earlier today. "As a result of this error, once it determined that the buffer data was 'clearly . . . capable of being reproduced, i.e., that the work was embodied in the buffer, the district court concluded that the work was therefore 'fixed' in the buffer, and that a copy had thus been made."

But buffers are temporary storage media, Judge Walker went on, designed only to harbor portions of files for a "transitory duration" -- in other words, just long enough to get the file transmitted and removed from memory. He cited an earlier court decision in favor of a repair service that had rescued a customer's hard drive, and in so doing had copied that customer's software -- allegedly illegally. Since the rescue copy was only for a "transitory duration," that court ruled, the duplication wasn't really a "copy" for practical purposes.

In the case of RS-DVR, the transitory period was found to be no greater than 1.2 seconds. "While our inquiry is necessarily fact-specific, and other factors not present here may alter the duration analysis significantly," Judge Walker wrote, "these facts strongly suggest that the works in this case are embodied in the buffer for only a 'transitory' period, thus failing the duration requirement."

So if the buffer doesn't truly constitute a copy, then the transmission doesn't constitute a "performance" of that copy.If you take the recording device of a DVR off the customer's premises and place... more
