While millions of Americans will continue to enjoy their modest payroll tax cut, many of them will now have to submit to drug testing as part of the deal struck between the two parties in Congress. As part of the compromise reached to extend the tax cut, Democrats agreed to a Republican provision giving states the right to require those seeking unemployment benefits who were fired for drug use to undergo testing administered by the state. What’s strange about this concession is that workers who are fired for drug use are not eligible for unemployment benefits anyway.
However, a second section of the bill is likely to impact hundreds of thousands of individuals. This section applies to workers applying for jobs in industries where drug testing is prevalent even if the workers have never been laid off because of drug use. Any state that chooses to apply this rule will shift the financial burden of drug testing from employers to state taxpayers. The Department of Labor has not yet announced which industries will qualify for the drug testing provision
Some opponents of the bill have proposed that members of state legislatures who approve drug testing applicants for unemployment benefits should themselves be tested for drugs since they too receive government benefits.

A disposable drugs test that allows parents to check if their children have been taking cannabis or cocaine by analysing a droplet of saliva has been developed by British scientists.
The handheld device, which resembles a pregnancy testing kit, costs just £1.50 and produces an accurate result within five minutes.Its creators say it could be available within two years.
The Vantix sensor was developed to help police carry out speedy roadside drug-driving tests, but it could just as easily be used by parents who are worried their children are taking drugs.
News of the breakthrough comes just days after the conviction and jailing of singer George Michael for possessing cannabis and drug driving.
Kevin Auton, of Universal Sensors, has admitted that the test would be controversial and could have 'huge implications for society'.
He said: 'In America, parents are taking samples of their children's saliva and hair and sending them off to labs to see if their children are taking drugs. If there is demand for it here, it would be an interesting market.
'It is controversial but the test can be used in the home for worried parents to test if their children are taking drugs.
'We are very focused on getting the test out of the laboratory and on to other platforms. It is as simple to use as a pregnancy test.'
The devices are designed to be used at the roadside, in a police station or in the home.

Fani Halkia, the reigning Olympic champion in the women's 400-meter hurdles, told reporters she was "shocked" to learn she had tested positive for the banned substance methyltrienolone and would be unable to defend her gold medal.
Halkia spoke to Greek journalists early Sunday morning at a central Beijing hotel. She said she was summoned by the head of Greece's Olympic delegation and told of the results of the first sample she gave to World Anti-Doping Agency doctors.
"I am shocked," she said, according to Greek media reports. "I have undergone more testing than anyone else."
Halkia was tested a few days before the Beijing Olympics in Japan, where Greece's track and field team had been training. She said she had volunteered to take part in WADA's pilot program in which athletes submit themselves voluntarily to regular testing.
Halkia, who has moved out of the Olympic Village, said she was sorry she could not take part in the games and that she had expected to make the 400-meter hurdles final.
Preliminaries in that event were scheduled to begin Sunday afternoon.
Halkia said she did not know how the banned substance was found in her sample.
A total of 15 Greek athletes, including Halkia, have tested positive for methyltrienolone. They include 11 weightlifters, swimmer Yannis Drymonakos, 400-meter runner Dimitrios Regas, and sprinter Tassos Gousis, who was sent home a few days before the Olympics. The International Olympic Committee has also barred sprinter Katerina Thanou from the games for her role in a drug-testing scandal at the Athens Games four years ago.
