OBAMA's DOJ files 31 page brief: Stating DOMA is Unconsitutional!

(Note: Another late Friday filing!) Today, the Department of Justice filed a brief in federal court employee Karen Golinski's federal court challenge, supporting her lawsuit seeking access to equal health benefits for her wife and arguing strongly that the Defense of Marriage Act is unconstitutional in terms unparalleled in previous administration statements.

In a brief filed on behalf of the Office of Personnel Management and other federal defendants, DOJ acknowledged the U.S. government's "significant and regrettable role" in discrimination in America against gays and lesbians... DOJ lawyers today made an expansive case in a 31-page filing that DOMA is unconstitutional.Today's filing does more than acknowledge the federal government's role in discrimination, going on to detail specific instances of anti-gay and anti-lesbian discrimination, including the 1950 Senate resolution seeking an "investigation" into "homosexuals and other sexual perverts" in government employement and President Dwight Eisenhower's executive order adding "sexual perversion" as a ground for "possible dismissal from government service," in the brief's words. It also details the role of the Federal Bureau of Investigation and the U.S. Postal Service in investigations seeking information about government employees suspected of such "perversion."

The brief goes on to describe anti-gay and anti-lesbian state and local discrimination, as well as private discrimination, before discussing other considerations made by courts when deciding what level of scrutiny should be applied to laws classifying groups -- including immutability; political powerlessness; and whether the classification bears any relation to, as the brief puts it, "legitimate policy objectives or ability to perform or contribute to society."

DOJ's lawyers conclude that heightened scrutiny applies and argue how, under that heightened scrutiny, Section 3 of DOMA should be found to be unconstitutional. Heightened scrutiny, the brief details, would require that Section 3 is substantially related to an important government objective.

Obama Administration Caught Red Handed Torturing Americans

On Tuesday morning, a lawyer for Gulet Mohamed, an American teenager who's been detained in Kuwait for almost a month, sued the Obama administration for blocking his client's repatriation to the US. The allegation at the center of the suit, which names as defendants the heads of the Justice Department, the FBI, and the federal Terrorist Screening Center, is simple: By placing Mohamed on the no-fly list based on nothing but suspicion and refusing to allow Kuwaiti officials to deport him, the US government is denying Mohamed the most basic right of American citizenship—the right to actually reside in the US.

In response, the US government may claim that Mohamed's plight is not its responsibility. On December 20, according to the lawsuit, Mohamed was handcuffed, blindfolded, and taken away by "two men in civilian clothes." Deposited at an unknown location, "he was repeatedly beaten and tortured by his interrogators," the suit claims. Since December 28, he has been held in a Kuwaiti deportation facility. State Department spokesman P.J. Crowley has denied that Mohamed was "detained at the behest of the United States."

Between December 20 and 28, no one in Mohamed's family heard from him. During that time, Mohamed says his interrogators beat him with sticks, forced him to stand for hours on end, and threatened him with electrocution, while questioning him on his travels and past. Questions like: Why had an NBA-loving, video-game-playing American teenager traveled to the Arab world—especially Yemen and Somalia, two hotbeds of anti-American radicalism? Did Mohamed meet with Anwar al-Awlaki, the New Mexico-born Al Qaeda propagandist who is reportedly hiding out in Yemen? And how did Mohamed feel about terrorism?

Mohamed, for his part, has told the New York Times that like any "good Muslim," he "despise[s] terrorism." Mohamed, his lawyer, and his family claim that he was in Yemen and Somalia in 2009 to study Arabic and learn more about the family of his late father, a man who he never knew. They note that Mohamed faces no charges, or even allegations of wrongdoing, in either Kuwait or the US. And they say there is significant evidence that the US government is behind everything that happened to Mohamed. If Mohamed's lawyer, Gadeir Abbas, can prove that in court, he'll be well on his way to getting his client home to the US.

There's certainly circumstantial evidence to suggest that the US was and is involved in Mohamed's detention. Mohamed and his lawyer say his interrogators possessed detailed information that could have only come from US government sources. DoJ focusing on Comcast/NBC's effect on Internet video market

Online video may be wildly popular among the Internet savvy, but it is a minor part of the TV-viewing habits of the mainstream crowd. Because online video offerings are still catching on among the masses, the US Department of Justice is considering whether the proposed Comcast/NBC merger is really meant to lock up the market and keep the competition at bay, according to insiders speaking to the Wall Street Journal. If so, the companies could find themselves subject to certain guidelines from the DoJ or an antitrust suit, though the final ruling is still a ways away.

Comcast and NBC announced their plan to join forces late last year, sparking a DoJ investigation at the beginning of 2010. Since then, there has been plenty of debate over whether such a deal would hurt the online video industry—after all, Comcast is one of the biggest content distributors in the US, and NBC is one of the biggest content producers.

Comcast already owns a plethora of social networking- and online video-related ventures, and some critics expressed concern that Comcast might take over NBC's 32 percent stake in Hulu and subsequently cripple the service in favor of its own offerings. Additionally, companies that own content are required to offer shows to competitors at reasonable rates, but tight control over the online video market (and Comcast's already-in-motion plan to offer its own customers online access first) could affect how and when other TV providers get online access.

According to the WSJ's sources, the DoJ's investigations over the last eight months have been focused on such a possibility. "The concern is: Will Comcast's incumbent systems give them an incentive to slow down online distribution?" one unnamed person told the Journal.

Still, the same sources said that the department's investigations "aren't likely to kill the deal"—rather, they might result in certain restrictions on exclusive content, or guidelines for how Comcast must deal with NBC's rivals when it comes to licensing content.

Comcast has already promised that it won't pull a Tonya Harding on Hulu, and it seems likely that some sort of agreement will be made between the DoJ and Comcast before the merger is approved. If those options don't work out, the DoJ may eventually sue the two companies under the Sherman Antitrust Act, though that seems to be a last resort.Online video may be wildly popular among the Internet savvy, but it is a minor part of... more
