SALISBURY -- The state physicians board has suspended the medical license of a Salisbury psychiatrist after it determined he had engaged in sexual misconduct with a female patient.
The board suspended Dr. Daniel S. Smithpeter's license for three years when it made its ruling in December; however, the suspension could be lifted after a year if he completes a professional ethics course.
"Dr. Smithpeter used the authority and trust granted to him as a psychiatrist to subject this patient to his sexual overtures and acts while engaged in a medical appointment in his office," wrote John T. Papavasiliou, deputy director of the physicians board, in the board's written decision.
The patient was being treated at Delmarva Family Resources on North Salisbury Boulevard when the sexual relationship with Smithpeter started in 2005.
Smithpeter, who was licensed in 1996, is identified as the owner of Delmarva Family Resources in board documents.
The psychiatrist's license suspension came almost a month after a Salisbury pain management doctor's license was suspended in December.
Maryland State Board of Physicians suspended Dr. Brent Fox's medical license at the conclusion of a drug investigation.

The patient said Singh (Psychiatrist) asked her for naked pictures of herself!!
A Durban psychiatrist, who had a four-month affair with a patient in 2009, has been prevented from practising after unsuccessfully appealing against the one-year suspension for the indiscretion.
Dr Dinesh Singh, who pleaded guilty last year to unprofessional conduct for having a sexual relationship with the patient, lodged an appeal against the one-year suspension from practising imposed on him by the professional conduct committee of the Health Professions Council of SA (HPCSA).
The appeal was dismissed on Friday and his suspension was upheld.
The patient said Singh asked her for naked pictures of herself. The relationship reached a stage where she became obsessed with Singh and wanted to see him all the time.
When Singh terminated their relationship she had to be hospitalised for severe depression.
After several weeks of therapy with another psychiatrist the woman lodged a complaint with the HPCSA.
Implicated
“The interests of society are implicated in a case that involves a doctor-patient relationship and a serious degree of misconduct against a woman.
“As abuse against women is generally prevalent, society is entitled to expect of tribunals that they impose sentences that send the message clearly that abuse against the vulnerable will not be tolerated,” Maoka said.

A state psychiatrist has been fired from Terrell State Hospital for not disclosing a 2001 settlement banning him from working in other state of Texas mental health facilities.
The Austin American-Statesman first reported Jan. 4 that Dr. Alejandro Munoz was fired from the hospital in December. He had been employed in Terrell since 2006.
Carrie Williams, a press officer with the Texas Department of State Health Services, confirmed Tuesday that Munoz had falsified his application for employment, stating that he had left Rolling Plains State Operated Community Services in Graham in 1998 for personal reasons.
“When in fact, he had been dismissed,” said Williams, who added that the dismissal resulted in Munoz filing a grievance and lawsuit against the Texas Department of Mental Health and Mental Retardation. “He then entered into a settlement agreement in which he agreed never to seek employment with TDMHMR or any component facilities or contractors.”
According to Williams, Munoz was hired in Terrell in 2006 as part of a limited pool of applicants.
“His license was in good standing,” said Williams, adding that Munoz shouldn’t have applied to work for the state hospital and the facility shouldn’t have hired him due to the settlement agreement and abuse confirmation. “We should have picked up on the extent of the history and the issues with his application. Our practice is not to hire people with sexual abuse confirmations.”
The Department of State Health Services checked employment records for Munoz after he was mentioned in a newspaper story on state hospital psychiatrists and alleged sexual improprieties with patients, according to a report by The Associated Press.
Williams said that applicants for state hospital jobs are heavily scrutinized during the hiring process.
“At this point, Munoz appears to be an outlier that we discovered as part of our ongoing review of all our hospital doctors,” Williams said. “The vast majority of our employees are good hires doing great work, but there is always room to improve. Our hospital employees are heavily scrutinized, and we’re going through our process with a fine-tooth comb.”

The Alec Baldwin controversy has again brought media attention to the debate over Parental Alienation and Parental Alienation Syndrome.
In 2005, PBS aired Breaking the Silence, a film attacking fathers and Parental Alienation Syndrome. We organized a successful campaign against the film which led PBS to promise to make a balanced, fair documentary on the subject--a commitment PBS kept.
During the controversy over the film, the film's feminist supporters insisted that Parental Alienation Syndrome had been discredited and attacked by the American Psychological Association. In the documentary Joan Meier, a professor of clinical law at George Washington University and one of the film's chief spokespersons, states that PAS "has been thoroughly debunked by the American Psychological Association." Connecticut Public Television, one of the film's producers, put out a press release promoting the film which stated that PAS had been "discredited by the American Psychological Association."
Rhea K. Farberman, Executive Director of Public and Member Communications of the American Psychological Association, retorted that these feminist these claims are "incorrect" and "inaccurate," and that the APA "does not have an official position on parental alienation syndrome--pro or con."
Despite the enormous political pressure put on the APA by misguided women's advocates who oppose PAS, the APA has put out mixed messages about Parental Alienation Syndrome. During the controversy I asked shared parenting advocate Les Veskrna, MD to write an article for my site sorting out the truth about the APA and PAS. Veskrna asserts, "the APA has, in fact, heretofore made a significant endorsement of the validity of PAS."
