It's was reported earlier in the week, the police over used and carried out illegal searches by using section 44 of the Terrorism Act.
"Earlier this year, the European Court of Human Rights ruled that indiscriminate Section 44 searches were illegal, but the Government sought permission to appeal."-Yorkshire Post.
The Guardian article says thousands of people are believed to be on the list, which the Yorkshire post highlights are made up of protesters and photographers. In one example, in a stated uncleared use of the act, 840 people were stopped within a 48 hour operation. The information was discovered after a freedom of information act request. http://www.ico.gov.uk/what_we_cover/freedom_of_information.aspx
It sounds like from the news, the use stop and search is being investigated by the Home Office, leaving open the possibility of compensation.
"The 14 forces are trying to contact tens of thousands who were unlawfully searched on the streets in operations going back to 2001, when the powers were introduced. Mass gathering of the "I'm a photographer, not at terrorist" campaign in Trafalgar Square in central London at 12 noon on Saturday 23rd January, 2010 to protest against anti-terror legislation which impacts photographers. Section 44, or s44, is used by police to stop and search photographers, both amateur and professional. The concern is that it'll impact greatly on the visual historical record of our times.

Thursday 26 February 2009: At the London PhotoForum NUJ member and photographer Andrew Wiard spoke on the history of the UK Press Card.
In this NUJ-funded film - Wiard talked about the creation of the press card without state control and the long campaign to get it in place, the problems and benefits of the card, the future of the UK press card system and the need to hold on to the press card in increasingly difficult social and political times.

Thursday 26 February 2009: Following the arrival of the new 2008 Counter Terrorism law and the introduction of Section 76, the London PhotoForum held a meeting on photographers rights.
Section 76 allows for the arrest and imprisonment of anyone who takes pictures of police officers, and some other public servants, “likely to be useful to a person committing or preparing an act of terrorism”. The maximum sentence is ten years.
This NUJ-funded film comprises of two speakers on the issue of photography rights, Anna Mazzola from Hickman and Rose solicitors and photographer Peter Macdiarmid. Experiences of working the streets of the UK, police guidelines, Section 76, stop and search powers and what to do if you detained by police are all covered in this vital reference film for photographers and other lens-based media, both amateur and professional.
