GULFPORT -- A former Pascagoula heart surgeon, whose 2009 charges of growing marijuana at his farm were dismissed, has filed a federal lawsuit against Jackson County Sheriff Mike Byrd, the Jackson County Board of Supervisors and the Narcotics Task Force of Jackson County alleging civil, constitutional and human rights violations.
Filed in U.S. District Court in Gulfport, the lawsuit says David Bruce Allen was the victim of false arrest, false imprisonment for more than a year, slander and libel, assault and battery, emotional distress and irreparable loss of his property and reputation. He is seeking not less than $51 million in compensatory damages and $500 million in punitive damages. He's asked for a jury trial. Gulfport attorney Michael Crosby represents Allen.
"This was an extremely significant situation where a professional, being a doctor, was for political reasons incarcerated as a retaliation by law enforcement," Crosby said, noting in the lawsuit Byrd had removed a political sign of one of his opponents from Allen's yard and handed it to the doctor a short time before Allen's arrest. "This is an example of the most blatant abuse of power I've seen in my 27 years of practicing law."
Allen, who left the Coast in 2008 to open a medical-marijuana practice in California, was arrested in 2009 on charges of growing marijuana on his 50-acre farm on Mississippi 613 in the Escatawpa community. Allen was jailed until February 2011, when he went to trial. A judge declared a mistrial because the jury was unable to reach a verdict on two charges against Allen.
The judge dismissed four other charges -- bribery, witness tampering, possession of a controlled substance and trying to induce a witness to commit perjury -- for lack of evidence. The District Attorney's Office decided not to retry the case due to insufficient evidence, also noting "there was no actual grown marijuana found on the property …"
Afterward, Allen's property that narcotics agents had seized at the time of the raid was turned back over to him. He had been locked out of it for nearly three years.
The lawsuit outlines the events of Feb. 19, 2009, when task force agents raided the property, arresting Allen's sister and brother-in-law. Allen was in California at the time.
The suit says the agents "burned property in the front yard in a bonfire fashion, acted like hooligans yelling and screaming about this was going to be their property, how this would be their vacation resort and shooting range, campground, fishing place, scuba training facility, etc., (and) played pool and ping pong on the their tables."

The Free Sherry Peel Jackson: Taxation Is Theft! rally happening on Wednesday, Nov. 10th at noon just northwest of Orlando.
Sherry Peel Jackson, a former IRS agent, is a political prisoner being kept in a cage because she concluded that the wealth she earned was not owed to the criminal U.S. government. She’s featured in the late Aaron Russo’s Freedom to Fascism (see her at 1:55 in this trailer for the documentary) and here’s the first of a two-part video about Sherry and her situation.
She’s almost three-years into her four-year sentence and needs our support.

Pedro Luis Boitel died in 1973 while on hunger strike in a Castro Prison. It is said that just like Orlando Zapata Tamayo, his water was taken away. His mother who pleaded to anyone that would listened, could not help him. No one cared to hear her. He was one of 12 documented prisoners who died during a hunger strike.
His tortures never imagined that his death would resonate decades later. His memory is revered by the opposition. In fact a baby that was just assaulted by Cuban police a few weeks ago, when his mother and two others including Jorge Luis Perez Antunez were being arrested, was named after him.
Boitel was allowed to die of hunger and thirst, then his body buried in darkness in an unmarked grave, so that even in death they could humiliate him. To this day acts of civil resistance are performed in front of his tomb and honors are given in his name.
His mother who fought against Batista, and recalls her house being searched often by Bastista's police, lived to see the Castro Revolution devour her own son.
She said that at least with Batista, there was always a loop hole, an open door, but with Castro there was no bargaining. She knew that man like her son could not live long. His cellmates remember a man who retained his dignity till the end.
Pedro Luis Boitel died at a time when even those of us who lived in Cuba, didn't find out what was happening in Castro's dungeons.. A time when torture and murder happened in darkness while the world played footsies with a genocidal murderer.
His legacy will be that of a man who never abandoned the cause of freedom even when he was stripped of everything that he held dear. Pedro and so may others will be the ones who history will absolve. Man like Castro will join the ranks of Hitler and Stalin and their name will forever be recalled in shame.
A Revolution betrayed that swallowed our innocence and stained our soil with the blood of so many of our sons and daughters. Those of you who danced with the devil will have your own special place as accomplices to Genocine and torture.

The film explores experiences of death row and the death penalty in South Korea during the years of political upheaval before democracy. The film contains extracts from an interview with Kim Dae-jung, former president of South Korea who died in August of 2009. Kim Dae-jung was sentenced to death during the struggle for democracy and went on to be awarded the Nobel Peace Prize and to become President of South Korea. The film includes other testimonies from political prisoners Kim Song-man and Yoo In-tae, and interestingly from Bok Ki-man who was a prison guard tasked with guarding Kim Dae-jung during his time on death row. The film focuses on the emotions of being a condemned man as well as the impact that the death penalty has on those tasked with carrying it out. The film was shot in 2009. Reina Luisa Tamayo today told Radio Martí that her son, the political prisoner Orlando Zapata Tamayo, is suffering from pneumonia, but that she doesn't know his exact condition because the authorities will not let her see him.
Doctors told Tamayo that her son, who is suffering the effects of a hunger strike he started Dec. 3, is too sick to receive visitors. He was transferred this week from a hospital in Camagüey to the medical unit at the Combinado del Este prison in Havana.
Tamayo, who has been her son's most forceful advocate, thought she might be able to see him today.
"I felt really bad, because it was my hope to see my son, and it wasn't possible," she said.
Meanwhile, more Cubans are uniting on behalf of Zapata.

Kari Ann Cowan, Asst. Coordinator of The Leonard Peltier Defense Offense Committee has accepted an invitation by a Delegate of the U.N. to attend the 64th General Assembly of The United Nations, being held in New York City on September 21-23 2009.
Ms. Cowan plans to network with the Members of the United Nations on behalf of Leonard Peltier, a Native American Political Prisoner of the United States, who was recently denied parole after serving 33 years in prison.
Ms. Cowan graciously accepted the invite, which also included the traditional drum group, Red Day, from the Black Hills of South Dakota.

For a formidable and growing global community of supporters, the prospect of Native American activist Leonard Peltier finally leaving prison inspires a longing that cuts to the depths of the soul.
So Peltier’s first parole hearing of the Obama Era — on Tuesday, July 28 — inspired hope of an intensity that will have a major impact on the new presidency. A decision must come from the Federal Parole Commission within three weeks. His attorney is calling for a surge of public support that would create an irresistible political climate for Leonard’s release.
The relationship between Peltier and those who have followed his case over the decades can be intensely personal. His imprisonment has come to stand not only for five centuries of unjust violence waged against Native Americans, but also for the inhumane theft of the life of a man who has handled his 33 years in jail with epic dignity, effectiveness and grace.
Peltier’s latest parole hearing convened at the federal penitentiary in Lewisburg, Pennsylvania, where he is currently held. According to Eric Seitz, Peltier’s Honolulu-based attorney, Peltier spoke for more than an hour “with great eloquence” about the nature of his case, his imprisonment and his plans for freedom. “The hearing officer seemed to listen carefully,” said Seitz. “We thought it went very well.”For a formidable and growing global community of supporters, the prospect of Native... more

As attorney Eric Seitz has said regarding parole, the Peltier case is one of “original jurisdiction”. That classification is the result of a number of factors–including the seriousness of the “offense,” the fact that Mr. Peltier is serving life sentences, and also because this is such a high-profile case.
Procedurally, this means the examiner made a recommendation sometime following the hearing on July 28. The application for parole was then forwarded to the regional commissioner apparently, who also reviewed the case and made a recommendation (the same as a vote, in this instance). The case was then forwarded to the four sitting executive commissioners in Washington (or Chevy Chase, MD, right outside of DC). The parole decision will be made by majority vote.
According to parole guidelines:

Greetings. I just got off the telephone with Leonard. He asked me to tell you that we must 'keep up the pressure, we can't relax' so I'm passing on that message.
On a personal note - he sounded good. His health continues to be an issue but nothing deeply pressing at the moment (ie we will be dealing with this later - parole first) - so your thoughts, prayers and sage have worked. Of course, he's wondering about the future and there was discussion around that. He expressed deep gratitude to everyone - certainly to the witnesses of the day - Peter, Thom and the Turtle Mtn representative. To the people who were at Lewisburg that day. Of course his family members who continue on this journey with him. To the many around this country and the world that held gatherings, vigils.And to you - all of the online supporters who have made, and continue to make such impact. He liked the idea of what we all did last week with The White House suggestion emails. Said to say thank you to all the supporters from the various foreign countries, such as this week's push from Canada.
Much of our conversation centered around the messages I needed to pass on from you and that he wanted to be clear with me you know how grateful he is to everyone. I told him that you feel the gratitude; hope that's all right.
