Playstation 3 PSN Update Stymies Class Action Lawsuit

On Thursday, Sony added another mandatory update for the PlayStation Network. It was the usual half-hour affair to download and install the update, preempted by the terms of service that no one ever reads. However, Scott Grill from the Examiner found it to be a very interesting read, pointing out this juicy tidbit:

“ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL LEGALACTION, UNLESS BOTH YOU AND THE SONY ENTITY WITH WHICH YOU HAVE A DISPUTE SPECIFICALLY AGREE TO DO SO IN WRITING FOLLOWING INITIATION OF THE ARBITRATION. THIS PROVISION DOES NOT PRECLUDE YOUR PARTICIPATION AS A MEMBER IN A CLASS ACTION FILED ON OR BEFORE AUGUST 20, 2011.”

Sony was subjected to multiple class action lawsuits this year when the PSN’s security was breached by hackers, and previously experienced a series of lawsuits when they removed Linux compatibility with a mandatory firmware update. Making it impossible to opt out of future lawsuits is not exactly allowed, so Sony added another section to the update:

“IF YOU DO NOT WISH TO BE BOUND BY THE BINDING ARBITRATION AND CLASS ACTION WAIVER IN THIS SECTION 15, YOU MUST NOTIFY SNEI IN WRITING WITHIN 30 DAYS OF THE DATE THAT YOU ACCEPT THIS AGREEMENT. YOUR WRITTEN NOTIFICATION MUST BE MAILED TO 6080 CENTER DRIVE, 10TH FLOOR, LOS ANGELES, CA 90045, ATTN: LEGAL DEPARTMENT/ARBITRATION AND MUST INCLUDE: (1) YOUR NAME, (2) YOUR ADDRESS, (3) YOUR PSN ACCOUNT NUMBER, IF YOU HAVE ONE, AND (4) A CLEAR STATEMENT THAT YOU DO NOT WISH TO RESOLVE DISPUTES WITH ANY SONY ENTITY THROUGH ARBITRATION.”

Instead of making it impossible, they chose to make it difficult. You can mail a letter stating that you do not want to take part in the arbitration part of the new PSN update. If you already updated, you better send that letter now – your thirty days are passing by. (As a side note, I recommend you keep a copy, send it through registered mail, and have signature delivery confirmation; keep records of everything. You wouldn’t want Sony to lose your letter.)

Sony’s PR representative, Patrick Seybold, claims the update is “designed to benefit both the consumer and the company by ensuring that there is adequate time and procedures to resolve disputes.” Many gamers disagree, as evidenced on articles and forums, as the literature clearly leans towards preventing lawsuits against Sony and not towards helping users get the protection or justice they deserve.
